RESOLUTION NO. 22-08
A RESOLUTION INTERPRETING TIGARD CHARTER CHAPTER III, SECTION 7 REGARDING
CONSECUTIVE YEARS
WHEREAS, the Tigard Charter, Chapter III, Mayor and Council, Section 7, states, "No councilor shall serve
the City as councilor for more than eight consecutive years, not shall the Mayor serve as Mayor for more
than eight consecutive years. In no case shall any person serve on the City Council for more than twelve
consecutive years.These limitations do not apply to the filling of an unexpired term; and
WHEREAS,under Oregon law,a city council is charged with interpreting ambiguities in its own charter;and
WHEREAS, the Council has received public testimony and evaluated the Charter language using principles
of statutory interpretation and reached consensus among participating members to resolve the ambiguity
over the meaning of"consecutive years;" and
WHEREAS, the Council also seeks to clarify what break in service is required to reset "consecutive years" and
that the limitations do not apply to the filling of an unexpired term,regardless of whether the unexpired term is
filled by appointment or election.
NOW,THEREFORE,BE IT RESOLVED by the Tigard City Council that:
SECTION 1: The Tigard City Council interprets the phrase "consecutive years" to mean "successive
calendar years."
SECTION 2: The Tigard City Council interprets the Charter to require a two-year break in service in order
to reset"consecutive years."
SECTION 3: The Tigard City Council interprets the statement "[t]hese limitations do not apply to the
filling of an unexpired term" to apply to the filling all vacancies, regardless of whether the
vacancy was filled by election or appointment.
SECTION 4: This resolution is effective immediately upon passage.
