The findings and conclusions on which these decisions are based are noted in Section V of this decision. NOTICE OT DEICISION PAGF 1 OP 4 ADJ2021-00009 MOTLEY SE"IBACK AIllJUSIMI?NT SECTION I1I. BACKGROUND INFORMATION Site Information and Proposal Description: The subject property is located at 12765 SW Watkins Avenue,on the northwest side of SW Watkins Avenue, south of SW Walnut Street, and north of SW Derry Dell Court. According to a recorded partition plat from 1999 (Washington County Document No. 99008289),the property is 18,587 square feet in size,and was originally created as "Parcel 1" of a three-lot partition. The site contains an existing single detached house with an attached garage, paved driveway, swimming pool, and associated landscaping. The property is zoned Low-Density Residential (R- 4.5), as are surrounding properties. In August 2020, the applicant obtained a building permit to construct a new 240-square-foot accessory structure (Case No.MST2020-00220).The site plan submitted with the building permit showed that the structure would meet the minimum five-foot side and rear setbacks for a residential accessory structure (CDC 18.290.050), and the applicant states that the property boundaries were marked on site prior to installation. However,the applicant states that the structure was incorrectly installed by contractors within the side setback in September 2020. Accordingly, the applicant requests a Type II Adjustment to reduce this five-foot side setback requirement down to 2.5 feet and 3.5 feet. SECTION IV. COMMENTS FROM PROPERTY OWNERS WITHIN 500 FEET The Community Development Code of the City of Tigard requires that all property owners of record within 500 feet of the subject site be notified of the proposal, and be given an opportunity to submit written comments prior to issuance of the decision. Staff mailed notices of this Type I1 application to affected parties on March 1,2021. On March 4, 2021, staff received an e-mail from a neighboring property owner inquiring about the adjustment process, and staff responded the same day with the requested information. On March 15,2021, staff received an e-mail from another neighboring property owner requesting a map showing his estimated property boundaries, and staff responded the same day with the requested information. No other public comments were received. SECTION V. APPLICABLE REVIEW CRITERIA AND FINDINGS 18.715 Adjustments 18.715.050 Approval Criteria The approval authority will approve or approve with conditions an adjustment application when all of the criteria in either Subsection 18.715.050.A or B are met. A. Criteria for demonstrating substantial compliance. 1. The proposed adjustment results in development that is generally consistent with the purpose of the development standard to be adjusted; and a. Has only minor impacts on surrounding properties or public facilities; or b. Addresses a site constraint or unusual situation; or c. Utilizes innovative design or results in sustainable development. The applicant requests to reduce the side setbacks for an existing accessory structure from five (5) feet to 2.5 feet and 3.5 feet (CDC 18.290.050).The applicant states that the structure was incorrectly installed by contractors within the side setback in September 2020. The purpose of a setback requirement is to provide for airflow,light,and privacy between adjacent properties and between structures. The area directly adjacent to the structure belongs to a separate property(12755 SW Watkins Avenue;WCTM 2S10213C,Tax Lot 8100),and this area serves as an existing accessway and contains no structures. There are also existing mature trees along the boundary between the two (2) properties, which provide adequate screening and preserve privacy. Accordingly, staff finds the applicant's adjustment request is NOTICIS OP DECISION PAGI's 2 01,4 AD120214)(009 MOTLFY SETBACK ADJUSININNT consistent with the purpose of the setback requirement, as airflow, light, and privacy will continue to be maintained. Because the area adjacent to the structure is adequately screened by existing trees and contains no structures, staff finds this proposal will have no impact on surrounding properties. Additionally, the structure is located more than 75 feet away from the public right-of-way; therefore, this adjustment will also have no impact on public facilities. This criterion is met. 2. The proposed adjustment does not have a greater impact on city-designated sensitive lands than would otherwise occur if the adjustment was not approved; and There are no city-designated sensitive lands located on the subject property, or the area immediately adjacent to the existing accessory structure.This criterion does not apply. 3. If the proposed adjustment addresses a site constraint or unusual situation, utilizes innovative design, or results in sustainable development, any impacts from the proposed adjustment are mitigated to the extent practicable; and The subject lot is irregularly shaped because its northeastern side property line contains multiple curves and ninety- degree bends. Because of the unusual shape of this property line, the applicant attempted to measure and mark the property boundaries before the accessory structure was installed. However,the applicant states that the structure was incorrectly installed by contractors within the side setback in September 2020. Accordingly,the proposed adjustment addresses an unusual situation with the irregular shape of the property line directly adjacent to the accessory structure, which may have made it more difficult to measure the five-foot setback during installation, and the fact that the structure was incorrectly installed in this setback area.Because the area adjacent to the structure is adequately screened by existing trees and contains no structures, staff finds this proposal will have no impact on surrounding properties. Additionally,the structure is located more than 75 feet away from the public right-of-way; therefore, this adjustment will also have no impact on public facilities. This criterion is met. 4. If more than one adjustment is proposed, the cumulative effect of the adjustments results in development that is generally consistent with the existing development pattern of the surrounding area and the overall purpose of the base zone. The applicant does not request more than one (1) adjustment. This criterion does not apply. SECTION VI. They sent (via-email)the contract and parameters needed for the structure. We cleared the area and their instruction said they would need two feet for the setback. I (Pete)contacted the City of Tigard Planning Division to find what I needed to do to proceed with the process. At this time I was made aware that the setbacks needed to be at least five feet from the property line. I measured and marked off the area per the City of Tigard requirements. April-Ordered the Site Plans from Better Built Barns using their Architect Leonard Looder Registered Architect#3908. Which were approved by the C.O.T. 7-24-2020. We started preparing the foundation area per BBB requirements. May-Waiting for plans-things were slower than because of Covid 19. July- Received Site Plans and submitted to C.O.T., approved on 7-24-2020. Scheduled with BBB for installation. The site plans included the 5 feet set back. Our plot was measured and staked with marker points for the construction people. August-Installation was completed 8-24-2020. 1 painted the exterior and caulked the windows. This was to be done before the warranty could be issued. The workers were given the copy of the site plans.They took it upon themselves to move the boundaries that had been marked. September-Cohn Electric installed all electrical and did permitting. C.O.T. Inspected and passed in October. We have talked to our neighbor Ero George who lives behind us 12755 SW Watkins Avenue. She is fine with the building were it is. Her property that is backed up to our shed is used as a sanctuary/meditation area. There are no buildings in this area.
