the decision is based are noted in Section IV.

CONDITION OF APPROVAL
THE FOLLOWING CONDITION MUST BE SATISFIED:

1. The applicant must record the lot consolidation with Washington County, and submit copies of
the recorded survey map and updated deeds to the project planner within 15 days of recording,
to be incorporated into the land use case file.
SECTION III. BACKGROUND INFORMATION
Site Information:
The subject properties (WCTM 1S135AC,Tax Lots 3500,3600, 3700, 3800,3801, and 3900) are located on
the south side of SW Oak Street, north of Highway 217, east of SW 95th Avenue, and west of SW Hall
Boulevard. In March 2020, the City of Tigard Planning Division approved a site development review on the
subject properties for a new four-story senior living facility (Master Case No. SDR2019-00005). This
approval also included an adjustment to the parking lot screening standard,and a sensitive lands review for
ground disturbance in the Federal Emergency Management Agency special flood hazard area. The
properties are zoned Mixed-Use Employment 1 (MUE-1), and are located in the Washington Square
Regional Center Plan District.
SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS
18.810 Lot Line Adjustments and Lot Consolidations
18.810.030 Approval Criteria.
A. Approval criteria. The approval authority will approve or approve with conditions an
application for a lot line adjustment or lot consolidation when all of the following are met:
1. An additional lot is not created by the lot line adjustment or lot consolidation, and the
existing lot or lots are not reduced below the minimum lot size.
An additional lot will not be created as a result of this application. The applicant proposes to consolidate
six (6) lots into one (1) lot that will be 4.08 acres in size. As explained in Master Case No. SDR2019-
00005, the approved senior living facility on the subject site was reviewed using the apartment
development standards in CDC Table 18.230.1.There is no minimum lot size requirement for apartments
in the MUE-1 Zone.This criterion is met.
2. The reconfigured lots and existing structures comply with all applicable development
standards.

As demonstrated in the table above, the consolidated lot and all proposed development comply with all
applicable development standards for apartments in the MUE-1 Zone (CDC Table 18.230.1). As
determined in Master Case No. SDR2019-00005, density standards do not apply to the approved senior
living facility on the subject site.This criterion is met

b. The minimum lot width is met. The minimum lot width for residential and
nonresidential development is provided in the applicable development
standards chapter in 18.200 Residential Development Standards or 18.300
Nonresidential Development Standards.In the case of a flag lot,the minimum
lot width and depth is 40 feet and is measured as provided in Section 18.40.080.
There is no minimum lot width requirement for apartments in the MUE-1 Zone.This criterion is met.
c. The minimum lot size is met. The minimum lot size for residential and
nonresidential development is provided in the applicable development
standards chapter in 18.200 Residential Development Standards or 18.300
Nonresidential Development Standards. In the case of a flag lot, the access is
not included in the lot area calculation as described in Section 18.40.080.
There is no minimum lot size requirement for apartments in the MUE-1 Zone. This criterion is met.
d. Each lot intended for quad, rowhouse, or single detached house development
is rectilinear in shape with straight side lot lines at right angles to front lot
lines, and straight rear lot lines parallel to front lot lines, except where not
practicable due to location along a street radius or because of existing natural
features or lot lines. Side and rear lot lines that are segmented may not contain
cumulative lateral changes in direction that exceed 10 percent of the distance
between opposing lot corners, as measured using the process of Subsection
18.40.060.C.
The applicant is not proposing quad, rowhouse, or single detached house development on the
consolidated lot.This criterion does not apply.
e. Each lot has a minimum of 40 feet of frontage on a public or private right-of-
way,except for the following types of lots:
i. Flag lots and rowhouse lots have a minimum of 15 feet of frontage on a

public or private right-of-way;
ii. Lots with curved frontages along cul de sacs or eyebrows have a
minimum of 20 feet of frontage on a public or private right-of-way as
measured along the arc of the front lot line; and
iii. Lots at the terminus of a private street have a minimum of 20 feet of
frontage on a private right-of-way.
The consolidated lot will have more than 570 feet of frontage on SW Oak Street,which is a public right-
of-way. This criterion is met.
f. All setback requirements are met. The setback requirements for residential
and nonresidential development are provided in the applicable development
standards chapter in 18.200 Residential Development Standards or 18.300
Nonresidential Development Standards.
As addressed under Section 18.810.030.A.2 of this decision, the consolidated lot and all proposed
development comply with all setback requirements for apartments in the MUE-1 Zone. This criterion is
met.
g. Lots using the density and dimensional standards for cottage cluster,
courtyard unit, quad, and rowhouse development must record a deed
restriction that prohibits any type of development other than the type proposed
with the lot line adjustment or consolidation application. This deed restriction
cannot be removed except through another land division or lot line adjustment
process.
The applicant is not proposing cottage cluster, courtyard unit, quad, or rowhouse development on the
consolidated lot. This criterion does not apply.
4. With regard to flag lots:
a. The applicant may determine the location of the front lot line, provided that
no side setback is less than 10 feet. Structures must generally be located so as
to maximize separation from existing structures.
b. A sight-obscuring fence must be provided along the property line of a lot where
the paved access is located within 10 feet of an abutting lot.
The applicant is not proposing to create a flag lot through this lot consolidation. These criteria do not
apply.
5. Where a common drive is to be provided to serve more than one lot, a reciprocal
easement that will ensure access and maintenance rights must be recorded with the
approved lot line adjustment or lot consolidation.
The applicant is not proposing a common drive to be provided to serve more than one (1) lot. This
criterion does not apply.
6. Any access must comply with Chapter 18.920,Access, Egress, and Circulation.
The applicant is not proposing to modify any existing accessways or create a new accessway with this lot
consolidation.This criterion does not apply.

CONCLUSION: Based on the analysis above, staff finds the approval criteria for a lot consolidation
are either met, satisfied through conditions of approval, or do not apply. The
proposal is in compliance with the requirements of this Title.

AND BECOMES EFFECTIVE ON MARCH 30, 2021.

I. INTRODUCTION
Background information: The property owner is requesting approval of a Type I Lot Consolidation. The
subject site is located at 9020-9360 SW Oak Street and consists of six (6) parcels. The site is located on
the south side of SW Oak Street. The site is 4.08 acres in size and is zoned Mixed-Use Employment
(MUE-1). Surrounding properties to the north, south, east, and west are also zoned Mixed-Use
Employment (MUE-1). The site was recently approved for a new residential care facility by the City of
Tigard (City File Numbers: SDR2019-00005/ADJ2019-00018/SLR2019-000003).
The property owner proposes a lot line consolidation between all six (6) parcels to create one parcel of
4.08 acres.
TIGARD MUNICIPAL CODE
Title 18- COMMUNITY DEVELOPMENT CODE (the Code)
CHAPTER 18.810 LOT L /NE ADJUSTMENTS AND LOT CONSOLIDATIONS
Section 18.810.020 Approval Process
A. Approval process.Applications for lot line adjustments and lot consolidations are
processed through a Type I procedure, as provided in Section 18.710.050, using approval
criteria in Section 18.810.030.
B. Approval period. Expirations and extensions of approvals are provided in Subsection
18.20.040.G. (Ord. 18-28§1; Ord. 18-23§2; Ord. 17-22§2)
RESPONSE:The property owner is submitting a Type I application, pursuant to Section 18.810.020 A. of
the Code. The property owner intends to record the lot consolidation as soon as approval is received,
thus negating any lapses of approval or the need to request any extensions.
Section 18.810.030 Approval Criteria
A. Approval criteria. The approval authority will approve or approve with conditions an
application fora lot line adjustment or lot consolidation when all of the following are met:
1. An additional lot is not created by the lot line adjustment or lot consolidation, and the
existing lot or lots are not reduced below the minimum lot size.
RESPONSE: The subject site currently consists of six (6)tax lots totaling 4.08 acres in size. With this
proposal, the Applicant is seeking to consolidate all six(6) tax lots into one (1) 4.08-acre tax lot. No
additional lots are being created as part of the proposed lot consolidation request. The subject parcels are
located in the MUE-1 zoning district which does not have a minimum lot size requirement.
2. The proposed lots and existing structures comply with all applicable development
standards.
RESPONSE:As mentioned previously, the subject property was recently approved for a new residential
care facility by the City of Tigard (City File Numbers: SDR2019-00005/ADJ201 9-0001 8/SLR2019-

000003). As such, all previously existing structures have been or will be removed from the property to
make way for the construction of the new residential care facility. After the proposed lot consolidation, all
new structures associated with the approved residential care facility will comply with all applicable
development standards of the MUE-1 Zoning District as approved through City File Numbers: SDR2019-
00005/ADJ2019-00018/SLR2019-000003.
3. The proposed lots comply with the following:
a. All lots created for housing meet the density requirements for the housing type
proposed.
b. The minimum lot width is met. The minimum lot width for residential and
nonresidential development is provided in the applicable development standards
chapter in 18.200 Residential Development Standards or 18.300 Nonresidential
Development Standards. In the case of a flag lot, the minimum lot width and depth
is 40 feet and is measured as provided in Section 18.40.080.
c. The minimum lot size is met. The minimum lot size for residential and
nonresidential development is provided in the applicable development standards
chapter in 18.200 Residential Development Standards or 18.300 Nonresidential
Development Standards. In the case of a flag lot, the access is not included in the
lot area calculation as described in Section 18.40.080.
RESPONSE: The subject properties are zoned MUE-1, which is a mixed-use commercial zone. The
existing structures located on the six (6) parcels will be demolished to make way for the approved
residential care facility, which complies with the MUE-1 density requirements as approved by the City.
The MUE-1 zone does not have a minimum lot width or a minimum lot size per the CDC. As proposed,
the Applicants lot consolidation complies with the MUE-1 Zone standards.
d. The depth of all lots does not exceed 2.5 times the average width, with the
following exceptions:
i. The lot is less than 1.5 times the minimum lot size, or
ii The lot is for a proposed cottage cluster or courtyard unit development.
RESPONSE: The above criteria do not apply to the Applicant's proposal because the MUE-1 zone does
not have a minimum lot size or minimum lot depth,therefore, it's not possible to determine if the proposed
lot consolidation exceeds 2.5 times the average width.
e. Each lot is rectilinear in shape with side lot lines at right angles to front lot lines,
and rear lot lines parallel to front lot lines, except where not practicable due to
location along a street radius or because of existing natural feature or lot shape.
Side and rear lot lines must be straight where practicable. Side and rear lot lines
that are segmented may not contain cumulative lateral changes in direction that
exceed 10 percent of the distance between opposing lot corners, as measured
using the process of Subsection 18.40.060.C.
RESPONSE: Given the configuration of the existing parcels, the Applicant's proposed lot consolidation of
six (6) lawfully created lots is rectilinear in shape to the greatest extent practicable. After the proposed lot
consolidation, the 4.08 acre lot will be rectilinear in shape with its side lot lines at right angles to front lot

line; however, the rear lot line will be at roughly a 45-degree angle to front lot line, thus creating more of a
triangular lot configuration. Since the proposal is to consolidate six (6) existing legal lots into a single tax
lot,the final configuration of the property is predetermined based on the lot shapes of the existing six(6)
lots.
The Applicant's proposal satisfies the above criterion.
f. Each lot has a minimum of 40 feet of frontage on a public or private right-of-way,
except for the following types of lots:
1. Flag lots and rowhouse lots have a minimum of 15 feet of frontage on a public
or private right-of-way;
ii. Lots with curved frontages along cul de sacs or eyebrows have a minimum of
20 feet of frontage on a public or private right-of-way as measured along the
arc of the front lot line;and
M. Lots at the terminus of a private street have a minimum of 20 feet of frontage
on a private right-of-way.
RESPONSE: As proposed, the lot resulting from the proposed lot consolidation will have approximately
507-feet of street frontage along SW Oak Street. The Applicant's proposal satisfies the above criteria.
g. All setback requirements are met. The setback requirements for residential and
nonresidential development are provided in the applicable development standards
chapter in 18.200 Residential Development Standards or 18.300 Nonresidential
Development Standards.
RESPONSE: As mentioned previously, the proposed lot consolidation is part of a larger residential care
facility project that was recently approved by the City (City File Numbers: SDR2019-00005 I ADJ2019-
00018/ SLR2019-000003). By consolidating the existing six(6)tax lots into a single tax lot, it will allow
for the approved residential care facility to be constructed on a single tax lot and meet all applicable
setback requirements of the MUE-1 zone as approved by the City. All existing structures will be
demolished to make way for the approved residential care facility. The Applicant's proposal satisfies the
above criterion.
h. Lots using the density and dimensional standards for cottage cluster, courtyard
unit, quad, and rowhouse development must record a deed restriction that
prohibits any type of development other than the type proposed with the lot line
adjustment or consolidation application. This deed restriction cannot be removed
except through another land division or lot line adjustment process.
RESPONSE: The above criterion does not apply to the Applicant's proposal because the Applicant is not
reconfiguring the existing lots using the density and dimensional standards for cottage cluster, courtyard
unit, quad, and/or rowhouse development.
4. With regard to flag lots:
a. The applicant may determine the location of the front lot line,provided that no side
setback is less than 10 feet. Structures must generally be located so as to
maximize separation from existing structures.

b. A sight-obscuring fence must be provided along the property line of a lot where
the paved access is located within 10 feet of an abutting lot.
RESPONSE: The proposed lot consolidation does not create any flag lots. This section is not applicable.
5. Where a common drive is to be provided to serve more than one lot, a reciprocal
easement which will ensure access and maintenance rights must be recorded with the
approved lot line adjustment or lot consolidation.
RESPONSE: No common drives are proposed as part of this application. The lot consolidation is part of a
residential care facility that was recently approved by the City (City File Numbers: SDR2019-00005/
ADJ2019-00018 I SLR2019-000003). All access to the site from SW Oak Street will be constructed
pursuant to the approvals granted by the City for the residential care facility.
6. Any accessway must comply with Chapter 18.920, Access, Egress, and Circulation.
RESPONSE: As mentioned above, any access to the consolidated lots will be in compliance with Chapter
18.920 as approved by the City for the residential care facility pursuant to City File Numbers: SDR2019-
00005/ADJ2019-00018/SLR2019-000003.
B. Exemptions from dedications. A lot line adjustment or lot consolidation is not considered
a development action for purposes of determining whether special flood hazard area,
greenway, or right-of-way dedication is required.
RESPONSE: The property owner(s)acknowledges their exemption from right-of-way dedications since
the proposed action is a lot consolidation.
18.810.040 Recording Lot Line Adjustments and Lot Consolidations
A. Recording requirements. Upon approval of the proposed lot line adjustment or lot
consolidation, the applicant must record the lot line adjustment or lot consolidation with
Washington County and submit a copy of the recorded survey map to the city, to be
incorporated into the record.
B. Time limit. The applicant must submit the copy of the recorded lot line adjustment or lot
consolidation survey map to the city prior to the issuance of any development permits on
the re-configured lots.
RESPONSE: The property owner(s) acknowledges they will record the lot consolidation with Washington
County and submit a copy of the recorded survey map to the City upon recordation. It is further
acknowledged that the Applicant/Owner will submit the recorded survey map to the City prior to any
development permits being issued for any development on the re-configured lots.
