"First, I want to acknowledge the great loss the Macduff family has endured, and my heart goes out to them. We recognize that any loss of life is tragic. I know this has been a long process and they've been waiting for answers for a long time," Chief Kathy McAlpine said. "This has also weighed heavily on the greater Tigard community and on our officers as we all waited for more information in this case." The Oregon Attorney General's Office issued this press release outlining the findings in this case. After reviewing all investigative materials collected by the Washington County Major Crimes Team and hearing testimony from involved witnesses and officers, a grand jury returned a "not true bill," which means they believe criminal charges against former Tigard Police Officer Gabriel Maldonado are not warranted. Now that the outside investigation is complete, the Tigard Police Department will be conducting an internal review of the case, which is routine department policy for every use of force. That process is outlined by Department Policy 302 - Use of Force Review Boards, which can be found here. The policy establishes a process for the evaluation of deadly use of force, the composition of the board, and the roles of those involved in the review process. The Board will be made up of five people who were not involved in the officer-involved shooting, including a sworn peace officer from an outside law enforcement agency. Board members are selected based on their roles in accordance with Policy 302. The Board will review all investigative materials available in this case, with a focus on department policies relating to use of force, including: training, tactics, supervision, equipment, decision -making, firearms/tools available, resources, and any other relevant areas the Board believes would Page 1 of 2 • ' Tigard Police Department .0 PRESS RELEASE be instructive as a thorough review of the incident. The Board may also identify opportunities for specific changes to training or other recommendations based on the actions of not only Officer Maldonado, but all the officers and supervisors who responded that evening. The Board's findings will be presented to Chief McAlpine once the process is complete, which may take several weeks. Violations of any rules of conduct, policies, or procedures will also be evaluated for corrective action within the Chief's discretion and current employment law. "We appreciate the independent work of the Washington County Major Crimes Team, the Washington County District Attorney's Office, and the Oregon Attorney General's Office in thoroughly reviewing this case," Chief McAlpine added. "As we now transition to our internal review of these events, I will thoughtfully consider any findings of the Board in continuing to develop best practices and effective training opportunities for all of the police officers who serve the Tigard community." In accordance with Oregon public records law, the investigative materials related to this case are now available for public review and can be requested through the Washington County District Attorney's Office.
