1. Resolution to approve minutes of last meeting, as written.
2. Visitors
A representative from Peavy Oil Company, McMinnville, Oregon,
intends to appear before the Board regarding his water bills at the
Texaco Service Station on Pacific Highway in Tigard. His bills had
been averaging between $6 and $8 when in August 1974 it jumped to
$72. In October 1974 it was $78.
John Miller visited the premises on several occasions and noticed
that the meter was spinning rapidly. An inspection revealed that
faucets for the toilets and urinals were constantly running water due
to defective washers. This was reported to the attendants en duty on
each occasion. I presume a plumber repaired the fixtures in early
December.

In the meantime, since the meter was old, a new one was installed
about December 15th. Subsequent water bills were as follows:
December 1974: $ 30.80
February 1975: $ 10.00
April 1975: $ 8.80
It is difficult to determine whether the leaky fixtures or a
faulty meter was the cause of the high water consumption. The facts
show that the fixtures were leaking and it is very unusual to find a
meter that over-reads. My letter to him dated February 20, 1975 is
enclosed. I gave him credit for $40.80, his December and February
bills.
He now claims that he should have more credit. I do not think so.

4. Election of officers for fiscal year 1975-76. commencing July 1.

With the re-election of John Schwartz on May 6th, all five
commissioners presently in office will serve during the next fiscal
year. It would be helpful in preparing the annual booklet on Rules,
Rates, and Regulations, if the officers were listed.
In selecting the officers, you should be aware that at least 2
of the 3 need to be readily available for signatures. Secondly,
retaining Clarence Nicoll as Treasurer would solve administrative
problems in bonding, etc.
5. Other business
a. The meter installation program whereby two or more houses
are being served by one meter has been completed. In the final
"'"a"` analysis, 9 new meters were installed, 2 property owners signed liens
to install another meter if and when one of the houses is sold, and
one customer was granted permission by the Board to continue serving
two houses on one meter until such time as sewers are installed and/or
the tax lot is sub-divided.

8. Work accomplished during April 1975.
a. TWD installed 6 crossings of Durham Road at Hall Blvd.,
98th, 2 at Summerfield, 104th, and 113th with a fire hydrant.
Washington County will be re-surfacing Durham Road in June and it
was believed wise to make these crossings prior to the new black-
topping.
b. TWD installed 6" sprinkling (fire) connection for Ted
Nelson Company located on 72nd Avenue
c. TWD installed 12 meters. (4368 - 4357). District also
serves 116 meters in Metzger Water District. Total: 4484.
9. Work to be accomplished during remainder of fiscal year 1974-75.
May 1975
a. TWD install 1200' of 8" C.I. and 720' of 6" C.I. + 1 fire
hydrant along S. W. 96th Avenue, Murdock to Sattler Road, to replace
4" O.D. steel pipe.
b. TWD install 550' of 8" C.I. along Pacific Highway, between
Johnson and MacKenzie Streets.
c. Private contractor install 1320' of 6" C.I. + 3 fire hydrants
along Greenleaf Terrace in Summerfield for Tualatin Development Company.
June 1975,
a. TWD install 2400' of 6" C.I. + 5 fire hydrants along S. W.
Greenway Avenue and Fairview Lane, near 115th and Gaarde, for develop-
ment of 46 single family homes, called "Terrace Trails", for Mrs. Lee
Fritz and Mr. Began.
b. TWD install, along with Cornell Manufacturing Company, a pump
station, with 3 - 25hp pumps at new Hi Tor reservoir site to provide
adequate pressure in the area.

About two months ago an official from your office inquired about the
high domestic water bi +.1s at the gas station on Pacific Highway for the months
of August and October 974 for the subject property. It was decided to wait
until the December 1974 and February 1975 bills were established to gain his-

An investigation was mad'• upon avarenesR of the first high water bill
in August. 1974. On several oc, asions, district personnel inspected water
facilities at the site and foutd toile' and urinal valves leaking on a 24-
hour basis. Appropriate atten'ants were notified, but corrective action was
not taken until several months later.
In the meantime, about December 15th, a new meter was installed to replace
the old one. As a general rule, old meters get less efficient with use and do
not over-read.
It is very difficult to make a judgment where the unaccounted for water
might have gone. Perhaps it was the wasted water used in the lavoratories or
a defec' ive meter, or both. However, I believe some adjustment is in order.
Mt. paid the October 1974 bill on November 16th and were current to that
date. The hills for December 1974 and February 1975 were $30.80 and $10.00,
respectively. The tote]. amount, $40.80, will be credited to your account as
the adjustment and ,your balance on that account is now zero. Your next bill
for this account will be forwarded on April 20e 1975.

Dear Mayor Graham:
In reference to our recent telephone conversation, enclosed is a
copy of my letter to you and the city council dated December 11, 1974.
I believe it accurately describes the events which resulted in Tigard
Water District purchasing surplus water from the City of Lake Oswego.
It is the unanimous opinion of the Board of Commissioners that Lake
Oswego's proposal to increase wholesale water rates to other public
agencies by 784 is unrealistic and cannot be justified. Prior to utiliz-
ing Lake Oswego's water, our business was promoted and encouraged by
representatives from Lake Oswego. We expended a quarter of a million
dollars of public funds to make the necessary capital improvements with
err+ the belief and confidence that Lake Oswego would be fair and reasonable
in future rate increases. In this regard, we expected moderate rate
increases from time to time.
Both Mr. Santee, water district administrator, and I have met with
Mr. Eppley and Mr. De Haas. Results of these meetings have indicated
that there will be no negotiation nor reconsideration by the city council
on the proposed rate increase which will become effective on July 1, 1975.
As a last resort, the Board of Com ►issioners has authorized our
attorney, Mr. Kenneth W. Baines, to ini ,iate litigation to resolve the
matter. It is believed that the City o ' Lake Oswego cannot justify,
either morally or legally, a 78 increa 'e in rates due, solely, to in-
creased costs for the production and di tribution of surplus water as
defined in our existing contract dated October 17, 1972.
I appreciate your attention in this matter and I am available, at
your convenience, to discuss the problem.
