Thank you for speaking with me today regarding the permit process to connect your property to public sanitary sewer.
Per our conversation, I assisted you with the forms found on the city website and here is a summary list of items
required:
• PFI Permit: If work is proposed for the sanitary lateral within the public right-of-way,then a Public Facilities
Improvement (PFI) permit is required. The sanitary lateral work ROW is processed as a Type 2 PFI application
(application is located here). The PFI application and associated plans/documents for the submittal can be
emailed by the applicant to rowpermits@tigard-or.gov.
• Plumbing Permit: Complete the plumbing permit application (found on website), including licensed contractor
information,and email to TigardBuildingPermitsC«@tigard-or.gov for processing.
• Contact your licensed plumbing contractor for information regarding:
o Septic system decommission to obtain certificate that system was properly abandoned. This certificate
must be provided to the city inspector to pass final plumbing inspection.

o Video of sanitary sewer line installed on the private property without permits. This video will need to be
provided to the plumbing inspector to pass final plumbing inspection.
• Sewer Permit: A sewer connection permit will be created to collect the connection, inspection and
reimbursement district fees due.
• Fees Due: Below is an estimate of the permit fees due so that you can secure a cashier's check next week:

Ok, I called Mr. Nelson — he was disappointed but truly grateful for all you did to help. I told him
we did everything possible to brainstorm alternatives that were allowable in our MuniCode and he
shared his thanks again for the teamwork and caring.
Saul — he asked me for links to complete the paperwork he needs to decommission the tank and
hook up. The contractor is coming Friday. He asked me if payment is possible there or if he needs
to go to another site.

Hi All,
I agree with all the info below. Installment payments are an option according to Code, but if that's a nonstarter for the
homeowner, I don't know of any other options. We don't have a process for fee deferrals or waivers, though I suppose
Council could always take action to do it. I would have concerns about that route, namely setting the precedent and the
admin costs of creating the documents, recording, and making sure the City is protected in being able to recoup all its
costs.
I recognize this is a huge hit to the property owner, but it seems to me that in this real estate market, discounting the
purchase price by$57k would still land the sellers with multiple offers.

Thanks Saul. If he's trying to sell his home and decommissioning the septic/connect to public
sewer is the roadblock to solve, given the demand in the housing market a long-term repayment
plan doesn't seem realistic. I don't see any other allowable options to offer.

Did some further digging on this. Under TMC 13.04.060 for Local Improvements does provide an allowance for payment
in installments as outlined in TMC Section 13.04.070.2.
2. Installment Payments.
a. The owner of any property assessed for an improvement in the sum of five hundred dollars or more, at any
time within ten days after notice of such assessment is first given,may file with the Finance Director a written
application to pay in installments.
b. The Finance Director shall accept the written application to pay in installments unless the amount
remaining unpaid on the current assessment together with the unpaid balance of any previous assessments for
improvements against the same property exceeds the real market value of the property.
c. The written application shall:
(1) State that the applicant and property owner does waive all irregularities or defects,jurisdictional or
otherwise, in the proceedings to cause the improvement to be constructed or made for which the
assessment is levied and in the apportionment of the cost; and
(2) State that the applicant or property owner understands the terms and conditions of the City's
payment policies including the penalties for nonpayment.
d. The Finance Director shall set interim and final interest rates for the financing of improvements,
assumption of payments resulting from a transfer of ownership,and service charges for late payments.
(1) The interim interest rate shall be equal to the U.S. Government Bond Ask Rate for the expected
financing maturity date or an equal index as determined by the Finance Director as of the 1st of the month
in which the application for installment financing is signed,plus 2%.

(2) The final interest shall be equal to the interest rate the City is charged on bonds issued to finance the
assessment,plus 1.25%.
e. The Council by resolution shall declare a payment due and payable after one year of delinquency, and the
entire balance shall become immediately due. The resolution shall give the name of the owner then in default in
the payment of the sums due,either principal or interest,together with a description of the property upon which
the sums are owning and declaring the whole sum,both principal and interest, due and payable at once. The
Finance Director is then directed to proceed at once to collect all unpaid installments and to enforce collection
thereof, with all penalties added thereto, in the same manner as described in 13.04.070.1.b.3 of this Section.
f. Whenever the owner of property changes through the sale or transfer of land, or the division of land,the
total assessment balance plus interest may be assumed subject to the following conditions. The City shall not
allow an assumption, if the assessment balance is less than$3,000. An assumption fee, which shall be set by
resolution of the City Council, and fees for recording the lien and the release of the lien will be charged. The
City shall not allow an assumption, if the buyer of the property has a history of slow or delinquent payment on
other debt to the City. Assumptions for assessments shall be at the rate charged to the owner of the property at
the time of assessment.

Shelby said it's doable if we can find permission in the code. We allow deferred SDCs with a lien,
but there are administrative costs and recording fees with the county that will increase the work on
our part and the fees on his part. Shelby suggested researching the code further to tie it to that.

Great idea, I was just writing to the team that bringing requests for fee waivers are fraught with
angst from staff, and understandably, the fees are tied to services we provide, so I get it. But this is
a huge blow for any homeowner. From my chats with Mr. Nelson, it's a matter of cash flow and
loan repayment.
He went to his bank and he said they are worried about two retirees ability to repay the loan. If
Shelby thinks your idea is doable, I think he'd be amenable to it t!
How do you want to proceed? Do you want to talk to Shelby or should I?

I just wanted to add that the sewer reimbursement district fee is$32,973.15 as of today and does go up every year until
it expires on August 11th, 2024.This would obviously be on top of the$6,085 sewer connection fee and the amount he
has to pay the contractor,which according to him is roughly$18,000 to do the work of connecting to the sewer and
decommissioning the septic system.That totals about$57,000.
I spoke with him this morning and he expressed how impossible it will be for his and his wife to come up with this
money and that they might consider abandoning the home if they can't solve the issue.

I just spoke to James Nelson at 10455 SW Hoodview Drive (503-887-6185) whose home is on
septic. A year ago he had a contractor pump and verify that the system was working well and
received a thumbs up. This year, he and his wife, now retired, tried to sell their home and the
inspection revealed that the tank has rust holes and must be de-commissioned immediately before
seepage appears. He said they've lost two sales because of the issue and because he's on a
retirement income, they are hoping the city can waive some fees and help them connect to public
sewer quickly. He noted that Saul was very helpful and shared that the estimated fee for connection
would be approximately $20,000-ish.
I shared that the Hoodview LID is completed, and not a candidate for assistance. Then he shared
that a few years ago, his homeowners policy provided him with money to correct a problem with
runoff from his gutters. As a retired contractor, he used a company he knew, and asked if when
making the repairs,would they be able to install a lateral for an eventual connection to the public
sewer. They did, and he confirmed that the contractor he used obtained permits from the city to

Given the steep grade and high cost of connections on Hoodview, and since the infrastructure is
already in place and just needs a tie-in, can I get your thoughts on a) expected cost to connect and
