4. Resolution to approve concept of ST&R en3ineerinf study to
either singly or jointly develop the Willamette River water source
at Wilsonville and to invite the Cities of Wilsonville and Tualatin
to participate.
A tentative final draft of the ST&R study is enclosed with this
report. Additional copies will be made if you approve of the content.
The water district must make a commitment to develop this source
of water before the Oregon State Engineer will investigate or approve
any application for water rights on the Willamette River. It would
be beneficial, at an early date, to know if Tualatin and Wilsonville
desire to participate in funding this venture. Approval must be
obtained from the Boundary Review Commission and other governmental
bodies so planning cannot begin too early.
This action should prompt Washington County to make a decision
whether to form a county-wide wholesale water service district. If
affirmative, TWD can always withdraw its application for approval.
5. Resolution to request approval of the voters to issue general
obligation bonds in May 1976 totaling $11 million 4or less if other.

A bond issue election is planned for May 1976 which will provide
ample time to inform the public about the project. It will require a
major selling job, but I am convinced the public will approve this
bond issue if all the facts are known and the alternatives clearly
presented.
If the bond issue is approved it will take 3 years to construct
the facilities and water should be available for the summer of 1979.
(Please note discussion below where our contract with Portland expires
on June 30, 1978).

7. Portland's System Development Charge.
Portland has again taken a hard line on outside users desiring
*ow to purchase Bull Run water.
You were informed last month that the System Development Charge
(SDC) would be implemented by Portland on June 1, 1975. Consultation
with Mr. Hyle, Manager, Portland Bureau of Water Works, revealed that
they intend to charge districts in our category with other sources of
water that percentage of the SDC as the amount of Bull Run consumed
versus all other sources. For example, if our annual total consumption
was 100 million gallons and 1 million gallons were Bull Run water, the
fraction would be 1/100 of the following charges:

A system development charge will be imposed for each new water
service connecting to the Portland water system both inside and outside
the City Limits. Such charge will be the size of service charge or the
per unit charge, whichever is the greater, payable at the time of appli-
cation for service.
It would appear that, for this year, since we have no historical
data of Bull Run consumption that if any amount is due at the end of
the year the district will have to absorb it.
8. Long term contracts with Portland.
Copies of Portland's new ordinance on long term agreements, the
new 10-year contract agreement, and our existing contract agreement
are enclosed.
This new 10-year agreement is again solely for the benefit of
Portland. Although a source of surplus water is assured for the dura-
"` tion of the contract, there are no guarantees on future rate increases.
Portland is requiring all outside water districts to agree to these
terms when existing contracts expire. Fortunately, our contract does not
expire until June 30, 1978. By that time it is hoped that the Willamette
River source will be only a year away.

a. TWD installed 130 feet of 4" C.I. + 3 fire hydrants along Green-
Ietf Terrace in Summerfield for Tualatin Development Co. (Developer's).
b. TWD installed copper services for pipe replacement on 96th Avenue,
between Murdock and Sattler Road.
c. TWD installed fire hydrant at Ash Drive and Frewing Court.
d. TWD installed 22 meters. (4441 - 4420). District also serves
113 meters in Metzger Water District. Total: 4554.

a. TWD install a pump station with 3 - 25 hp pumps at new Hi Tor
reservoir site to provide adequate pressure in the area for up to 500
homes.
b. TWD install 700' of 12" D.I. including 20" steel casing under
two sets of railroad tracks along S. W. Hall Boulevard, between Burnham
and Commercial Street, to replace 6" O.D. steel pipe. (Pipe replacement).
c. TWD install 400' of 12" D.I. + 1 fire hydrant along S. W. Pacific
Highway, Park to School Street (in front of new McDonald's restaurant)
to replace 6" O.D. steel pipe. (Pipe replacement).
d. TWD install 745' of 12" D.I., 1540' of 6" C.I., and 880' of
4" C.I. + 7 fire hydrants for 67 single family dwellings plus multi-

Dear Sirs:
The City of Tigard is in receipt of your letter dated June 11, 1975 in which
you explain that the Water District will not expend or appropriate funds for
water relocation in regard to Hunziker Local Improvement District. Since
that time we have been in contact with the Administrator and have verbally
advised that the project will commence and have inquired as to whether the
District would prefer to order the pipe and make the necessary relocation or
whether it would be preferable for the City to order this work performed by
our contractor. Mr. Santee indicates that it would probably be less expensive
and be desirable for the Water District' to do the relocation. He has requested
W that I appear before your Board meeting July 8 to obtain an answer to this
inquiry.
Based upon research we have had performed it appears to us that the City has
the legal power to require the relocation of the mains as necessitated by
street improvement projects, however we would prefer to defer a final determination
until a future date. Our first concern is that construction commence immediately
that the street improvement may be accomplished prior to fall rains in order to
keep the cost to the abutting property owners at a minimum. It is desirable that
the water line be relocated as one of the first utility locations in order to
adequately protect your mains which are located in close proximity to the gas
main. We are deeply concerned about any further delays in undertaking this work
and would point out that our records indicate that a set of plans were provided
to the Tigard Water District on October 7, 1974 and that this project has been a
matter of local general knowledge by virtue of newspaper articles, legal ads and
continued staff contact since last October.
It would be greatly appreciated if the Board would advise me at its meeting as to
whether it would prefer to perform the relocation with its staff and materials
or whether the City should take action to cause the line to be relocated by its
contractor. I plan to be in attendance at your meeting and will be happy to
discuss the situation further as you may desire.
