Resolution to approve annexation of four parcels of land, subject to approval of property owners. Several persons have requested water service, but are outside the boundaries of the water district. One was Herbert A. Stark who owns a small airport on the northwest side of the district. His well has become polluted and he is now being served on a temporary *y basis by the district. Other property owners along S. W. 135th, south of Scholls Ferry Road, have also requested water service. Of course, the property owners will have to bear the cost to extend mains across the front of their property. Before any such construction can commence, the Boundary Review Commission must approve either the annexa- tion or the main extension. Water districts or cities cannot legally extend mains extraterritorially without the express approval of the Boundary Review Commission. Another area that desires water service is located to the south- west near Beef Bend Road. A subdivision is located there called "Rivermeade" with about 35 homes, north of the Tualatin River. Two other areas to the southeast should also be considered for annexation if specifically requested by the property owners. One is an unincorporated area located just south of Upper Boones Ferry Road. (Sherwood Inn). The other area is the entire City of Durham. The Lake Grove Water District presently serves approximately 35 customers in these two areas on an out-of-district basis via a single 12-inch main in Upper Boones Ferry Road. It is believed that these areas will not be approved for annexation to Lake Grove Water District because of the natural boundary, 1-5 freeway, and the county line between Clackamas and Washington Counties. As a result, these users pay about twice the normal water rates because Lake Grove's out-of-district charges are so high. W. Upper Boones Ferry Road. The main was installed and paid for by the City of Tualatin when they previously purchased water from Lake Grove (Bull Run). It was subsequently deeded to Lake Grove Water District in accordance with a prior agreement. The staff at the Boundary Review Commission states that the TWD can assume ownership of all mains if the territory is annexed and served by the district. On November 5th I appeared before the City of Durham Planning Commission. They will submit a recommendation to the city council whether to approve TWD serving Durham. Nimmw Of importance to the district is the fact that Tualatin and TWD would have an inter-tie along Upper Boones Ferry Road. We should be connected to all adjacent water purveyors if possible. If the district is to serve the unincorporated area and the City of Durham a 12-inch main will have to be extended southerly along S. W. 72nd Avenue from Pre-delivery Service Company to Upper Boones Ferry Road. Funds for the project could be budgeted for the next fiscal year, com- mencing July 1, 1976, and construction started immediately thereafter. Of paramount consideration in all of the four areas mentioned above is the desire of the property owners. Letters have been sent to each one, except for the City of Durham. The city council should approve of the concept prior to corresponding with those citizens. Following is a tabulation of the acreage and net worth of each area: Acres Assessed Valuation (1). Annexation is therefore recommended, subject to the approval of the property owners. 5. Resolution to approve addendum dated September 16t 1975, to the existing contract with the City of Portland regarding system development charge. Enclosed is a copy of the City of Portland's revised letter regarding implementation of the system development charge to TWD. A new paragraph has been inserted referring to the applicability of Ordinance No.139971, Section 2, which is shown below: Section 2. SYSTEM DEVELOPMENT CHARGE SCHEDULE (1) A System Development Charge will be imposed for each new water service connecting to the Portland water system both inside and outside the City limits. Such charge will be the size of service charge or the per unit charge,whichever is the greater, (b) Per Unit Charge Schedule payable at the time of application for service. Neither Ken Baines nor I particularly like the language "upon authorized withdrawal",but it is doubtful that the city council will change the wording specially for TWD inasmuch as the amounts due will be minimal. At the last meeting you requested information on meter installa- tion charges of adjacent and surrounding water districts and cities. Metzger (Bull Run) 750 950 A correction in the district's meter connection charges was approved at the last meeting to account for the system development charge. It appears that these changes will have to be made annually as more and more Bull Run water is used. To make a determination whether to increase meter connection charges it is best to review where the district is and the future needs of the water system. The three basic elements of a water system are: (1) Distribution (2) Storage (3) Source (1) Distribution For several years the district has been budgeting from the General Fund for the installation of pipe line replacements and extensions. On June 30, 1979 this program will be finished and the entire distribu- tion system will be either cast iron or ductile iron pipe, all adequately sized. The required replacements and estimated costs are summarized at the end of this report. These are categorized as follows: Noir FY 1976-77: Fern St. and 135th Avenue $91,000 FY 1977-78: Gaarde St. and 121st Avenue 85,600 FY 1978-79: Bull Mountain and Sunrise Lane78,500 -4- livor ADMINISTRATOR'S REPORT (Continued) Plans for most of these main replacements have been prepared and it is just a matter of time to perform the work. Sufficient funds should be available in the General Fund, without a rate increase, to accomplish the tasks as programmed. (2) Storage On September 9, 1975 the Board of Commissioners resolved to request voter approval in May 1976 to issue General Obligation bonds totalling $1.6 million to construct a 10-million gallon reservoir. If approved, and the reservoir constructed, it would meet the storage needs of the district until 1991. On July 1, 1976 the outstanding bonded indebtedness of the district will be $1.386 million. Of significant note is the fact that some of these bonds will be paid off within a few years, commencing in 1979-80. Annual principal and interest charges of any new bond issue will be at least 107. of the value of the bonds. Therefore, a $1.6 million bond issue will cost about $160,000 annually. The annual payments must :rw be budgeted for fiscal year 1976-77. (3) Source If the Willamette River at Wilsonville is developed as a source of water, several million dollars will be required. At this date it is unknown what the district's pro-rata share might be, however, if such a project is implemented, additional revenue will be needed to pay off those bonds. In view of the above, an increase in meter connection charges would appear appropriate, effective January 1, 1976. In view of the anticipated bonded indebtedness the meter rate increases suggested above are considered minimal, and will have to be reviewed again at a later date, along with the district's entire revenue and tax structure. 7. However, since you estimate that the Tigard Water District will use approximately 10 percent of their future consumption from the Bull Run system, we are agreed to make the effective date of the System Uevelopment Charge October 1 , 1975 and will charge you for new connections to your system on the percentage of your use of Bull Run water to your overall consumption . For example , should all new service connections on tow your system for one year total $20 ,000 as per our System Development Charge schedule , we would then apply the 10 percent figure (or whatever the percentage factor proves to . be) and expect payment on that basis . We would also agree that under these circumstances it would prove more feasible to collect annually than quarterly. The System Development Charge will be applied in accordance with Ordinance No. 139971 , Section 2 , which establishes service charge schedules , authorizes refunds upon authorized withdrawal from the Portland system with- in ten years and exempts fireline connections . We will require you to supply us with a list of all new service connections after October 1 segregated into the categories of single family dwellings , duplexes , dwellings of 3 or more units , commercial , industrial and private fireline services , and the size and location of the meter for each service connection. Please have your Board of Commissioners sign the approval below and return the original as an addendum to our present agreement. Thomas, Chairman Board of Commissioners Tigard Water District 8841 SW Commercial St. Tigard, OR 97223 Dear Mr. Thomas: At our last board meeting it was the unanimous opinion of our commissioners that Metzger Water District make a firm proposal regarding our mutually expressed desire to improve relations and communications. We propose, therefore, that before any action is taken on any proposal, problem, policy, etc., that might affect the non-acting *1.1, district, the non-acting district will be advised of the proposed action, in writing, with a reasonable length of time for response. We further propose that copies of the minutes of our respective open meetings be automatically sent to each other within three days after a given meeting, recognizing, of course, that such minutes would be unofficial as not yet approved. Advice would therefore be given of such things as rate changes, petitions for annexation or boundary changes, filings with com- missions and boards, lawsuits, mergers, and bond issues. Even though the decisions on questions relating to such matters are usually strictly unilateral, we feel that the improved comm- unications and ability to respond will go far toward reducing misunderstandings, eliminating rumors, and in some instances may result in actual cost savings or more viable decision-making. We feel that our respective district managers can be delegated the responsibility for most of the communications as they generally know what actions might directly or indirectly affect the adjacent district. We would appreciate hearing from you, apd trust you will find such an arrangement desireable and valuable. Commercial Tigard, Oregon 97223 Re: Willamette River Water Supply Dear Bob, Enclosed is a copy of a letter from the District Engineer of the Corps of Engineers. This letter was addressed to Carter and came at the time we were doing the update of the Washington County Water Study. We thoughtyou should have it for your project file, and we suppose that the contents of the letter are as appropriate i o the Water District as they would be to the County. We thought that last night's meeting was a good one and appreciated the opportunity to appear. Smythe's comments weren't entirely appreci- ated inasmuch as he had previously approved the report. After the meeting, Carter asked him if he had any knowledge of inorganic or organic chemicals in the river, and he told Carter that,they did not have any knowledge of such chemicals but that they were worried that they might be there. This pretty much confirms what I learned or didn't learn yesterday in talking to the DEQ, EPA, USGS, and State Department of Agriculture. None of them have any information on organic chemicals and the reason for this absence of information seems to be that nobody has cause to think of them as a problem. If water quality monitoring is required as a part of the treat- ment system, we do not think it will have a significant or even noticeable effect on the cost of the undertaking. We don't think that it's very useful to look into other sources than the Willamette or Bull Run because the distances to be traveled are quite great. This would have a far more significant effect on the cost than the possible requirement f6r raw water monitoring. Do you think it would be a good idea to get in touch with Smythe and find out what further requirements the Division of Health may have, or would you rather let the matter rest for the time being? In order to permit such a determination, it would be desirable that the county furnish, at an early date, an assurance of intent to make future use of stored water. Such an assurance would not be a binding commitment to contract for use of a specified amount of water at a specified time. Rather, it would he a letter of intent showing that: a. Me potential user is aware of the existence of the storage projects, a„d of the requirements of the 1958 Water. Supply Act, and b. The potential user intends to make use of a specified amount of water, under terms of the Act, at an unspecified future time. Under such an assurance, the county would protect for the future a source of supply. At the same time, it would have full and sole au- wry, - thority to determine when the consummation of a contract for all or a part of that supply would be to its advantage. Inclosure 1 is a copy of the Water Supply Act of 1958. Inclosure 2 to i__. ---- this letter is a copy of a standard form for the provision of an assurance t•.. of future use. Inclosure 3 is a copy of a letter of intent furnished by the city of Sweet Home and accepted by this office in connection with future use of stored water from Foster Reservoir. An assurance from Washin;,ton County might be in either of those forms, or in some other mutually acceptable form which would provide the indicated degree of as- surance. In addition to contracting for repayment at such time as future use of stored water would he initiated, the county would have to obtain a right for diversion and use of stored water.
