08/14/1973 - Minutes Tigard Water District law 326th Regular Meeting August 14, 1973 PRESENT: Clarence F. Nicoli, Chairman Don W. Thomas, Secretary John M. Wied, Treasurer R. Verne Wheelwright Harold A. Myers Robert E. Santee, Administrator John P. Miller, Foreman The meeting was called to order at 7:38 p.m. by Chairman Nicoli. Harold A. Myers was sworn in as Commissioner to assume the position vacated by Commissioner Lester Rawls to expire on December 3, 1973, the date of the next regular election, by Chairman Nicoli. `""' Motion was made to approve the minutes of the last meeting, as written. Motion carried. Visitors: Mr. George Marshall, Tualatin Development Company Mr. James Harris, Engineer, Tualatin Development Company Mr. Gus Anderson, Chairman, Metzger Water District Mr. Jesse 0. Lowman, Manager, Metzger Water District George E. Birnie, Attorney, Metzger Water District Mr. Al Chavez, Metzger Water District Al Donnelly, Tigard Times Approximately 12 boy scouts from Troop 228 with Leader Bob Hughes (8:30 p.m.). George Marshall presented his case for possible financial rebate to Tualatin Development Company from Tigard Water District or property owners for installing a 12" main along the Spine Road and laterals to Durham Road in the Summerfield development. He was informed that since the main installations did not front on property "other than his own" there was no basis for a rebate from other property owners. He was advised that the district's attorney would be consulted to determine the legality of future rebates from other property owners. Mr. Marshall also requested relief from the 18% construction fees because of extra costs incurred due to oversizing of mains, laterals installed to Durham Road, and completion of the circulation loop to Pacific Highway. Total construction costs were not available so the matter was tabled until the ,e next meeting. 441110, -2- Letter dated August 14, 1973 from Metzger Water District was reviewed. (See attached letter). Lengthy discussion was held with representatives from Metzger Water District. In regards to turning on now the 12" valve at 72nd and Hunziker for immediate fire flows to the industrial area it was decided to request an opinion from Ken Baines if the district would incur a liability from such action. Mr. Birnie mentioned that even if those property owners in the industrial area withdrew from Metzger and annexed to Tigard Water District they would continue to carry the tax burden of Metzger Water District. It was decided that Board members from Metzger should hold a special meeting, contact representatives of the companies in the industrial area, and arrive at a course of action which would be in the best interests of all concerned. Metzger was to keep Tigard informed of events. Motion was made to pay the vouchers. Motion carried. Motion was made to award contract for pump station at #2 reservoir to Cornell Manufacturing Company for $36,850. This contractor was the only one to respond for bids for the specified equipment. Mitchell, Lewis S. Stayer declined to bid on this pump station. Motion carried. *41110, In the future the Administrator was instructed to seek bids from out- of-town manufacturers if those in this vicinity do not respond with bids. Motion was made to authorize the Administrator, with the assistance of the Chairman, to accept the lowest, acceptable bids and hire sub- contractors for the construction of the shop addition on Little Bull Mountain. Motion carried. The Chairman stated that he thought it would be a good idea to obtain all of the sub-contractors bids and arrive at a total estimated cost of the structure. Commercial St. Tioard, OR 97223 Gentlemen : At the regular meeting of the Metzger Water District Board of Commissioners, August 13, 1973, the Board reviewed your correspondence dated Autust TO, 1973, regarding your pro- posal for the solution of S. W. 72nd Avenue fire flow prob- lems . The intent of the letter was not fully realized by our Board. As in the past , we feel there has been ranch mis- understanding between our Districts. ‘41110, Hopefully, you can appreciate our present Board' s con- cern over a matter with which they have not been currently informed since the merger of the three Water Districts . There have been measures taken to correct these problems and we should have a better line of communication in the future. As we stated in our last correspondence, we would like an interim agreement for an immediate opening of- this valve on S. W. 72nd Avenue and S. W. Puniker, If you could, or would , grant in writing a special CO day agreement to open the ahove mentioned valve , we are prepared to pay a reason- able fee based on the estimated flows to this area and also to proceed immediately with a TO- meter installation at the S. W. 72nd and Ponita ,Road intersection to meet the require- ments of fire flows at this point. This would give us a loop- ed system, the same as you propose, and when our current con- struction projects are final in regards to our connection on Oleson Road and Hall Boulevard, we would be able Co surpass the fire flows that were previously available. 4100, — — %o w Governing Board Tigard Water. District August 14, 1973 Page 2 We feel that by working together in this area and allow- ing our connection to your system, which is basically how we all worked together on the meson Road and Fall Boulevard connections , we can resolve this in a fair and equitable mann- er to our customers, as well as the Metzler and Tigard Water Districts .
