Resolution to increase fire sprinkler rates from $5 to $10 per month for services 6-inch and below. and from $5 to $15 per month for services 8-inch and above. effective May 1. 1974. This increase will effect the 26 establishments shown on the next page. Additional revenue will amount to $2,460 annually which will contribute toward paying the bonded indebtedness. It should be noted that these were the firms which gained the most in savings on insurance premiums when the fire district was re-graded from a Class 6 to Class 4. The water district was instru- mental in attaining this excellent rating which required extensive capital improvements at high costs. For example, Fought and Company or Gerber Blades who are each assessed close to a million dollars, the amount of savings realized is about $420 annually, depending upon the type of construction. It is believed that they should share some of this savings with the water district. Resolution to annex 58 acres for development called "Windsor, Heights" consisting of 24 homes to be constructed near West Colony Park, south of Bull Mountain Road. This development was discussed by the Board on February 8, 1972 (2 years ago) at which time George Scott, Chester Warnock and Fred Warnock, developers, appeared before the Board. At that meeting the Board agreed to serve water to the area, but not to annex it. A. plot plan has been submitted and the developers are now requesting annexation so that the matter can be approved by the Boundary Review Commission. Under present statutes, no water mains can be extended outside district boundaries without the Boundary Review Commission's approval. Map on page 8 shows the area. 6. Other business. a. Tour of Lake Oswego treatment plant has been arranged low immediately following the meeting. I think you will enjoy viewing this facility and understand why John Miller and I are sold on this source of water. I intend to invite others to take this tour, including Hugh Brown, Les Rawls, Martin Johnson, Al Popp, Bill Bieker, Bill Heppner, George Guthrie, Duane Meyer, Pete Gerber, Arden Manning, and any others who may be interested. Wives are invited too. The tour should start about 8:30 p.m. to be Others,/invited are the budget committee, George Maleta, Floyd Bergmann, Gertrude George, Bill Masters, and George Penrose. b. Budget meeting. The first budget meeting has been scheduled for 8:00 p.m., Tuesday, May 14th, immediately following the regular Board meeting. The proposed budget will be sent to each member of the committee prior to that date. Since there will be several new members on the budget committee, the budget message may be more lengthy than usual. -3- Nov ADMINISTRATOR'S REPORT (Continued) 7. Report of resolution to recommend to Tri-County Water Districts Association that an attorney be retained to determine the merits of filing a lawsuit against Portland Bureau of Water Works on water rates. The Association met on March 21st at the Hazelwood Water District office. The proposed resolution was discussed and met with disaster. There was absolutely no support for it. George Birnie, attorney, attended the meeting and expressed the belief that Portland was vulnerable by applying the Systems Development Charge (SDC) to outside customers. He thought Portland could not be challenged on the rate increase because they were entitled to a profit. A court would have to decide if the profit were arbitrary or unreasonable. Ken Baines has indicated that, among other things, since Portland is not supported by property taxes, that the disparity in rates could be attacked. A consensus of the water districts indicated that, by a 10 to 1 margin, they preferred the SDC versus the additional rate increase. Most desired this charge because they have very little growth, and thus, would cost their district nothing. For example, West Slope had negative growth last year, and the actual number of meters decreased. If Portland approves the SDC, those districts with high growth will bear most of the burden. Other reasons for not challenging the City of Portland included: (a) Proposed city-county merger. (b) Proposed merger of 6 water districts by the Boundary Review Commission. -- Powell Valley, Hazelwood, Menlo Park, Gilbert, etc. (c) A belief that both the rate increase and SDC are justified and that Portland needs the additional funds to build their system. (d) A belief that if the Association were successful in court in eliminating the SDC, that Portland would merely impose the additional rate increase. Since most of the districts are happy or at least satisfied with the new rate structure there is no reason to fight the case. Certainly, it will effect us the least as we intend to use as little Bull Run water as possible. It would appear that a likely candidate to file or support a lawsuit would be the Oregon Homebuilders Association with its 900 members. They, in effect, will be paying most of the cost to construct the improve- ments for the Bull Run system. -4- `rr ADMINISTRATOR'S REPORT (Continued) 8. Work accomplished during March 1974s a. TWD installed 800 feet of 8" C.I. + 2 fire hydrants from 90° bend to south and west along Bull Mountain Road to replace 4" and 6" O.D. steel pipe. (Pipe replacement, General Fund). b. Teeples and Thatcher Construction Company installed for TWD 140 feet of 20" steel casing under Pacific Highway at Durham Road to complete circulation loop. (Bond Construction #lA). c. TWD installed 150 feet of 12" D.I. pipe in 20" steel casing as noted in "b" above. (Bond Construction #lA). d. TWD installed 33 meters. ( 4133 - 4101). District also serves 115 meters in Metzger Water District. 11. Work to be accomplished during remainder of FY 1973-74. Noe April 1974: a. TWD install 4600 feet of 12" D.I. pipe + 4 fire hydrants along Bull Mountain Road, between reservoir #2 and 132nd Avenue. (Bond Construction #IA). b. TWD install, along with Cornell Manufacturing Company, a 100-hp pump station at #2 reservoir to pump water to Hi Tor reservoirs. (Bond Construction #lA). c. Private contractor install 2800 feet of 8" G.I., 1700 feet of 6" C.I., and 1000 feet of 4" C.I. + 9 fire hydrants in the Summer- field development, Townhouses (Phase II), for Tualatin Development Company. (Developer's). May 1974: a. TWD install 400 feet of 6" C.I. in 36" steel casing under 2 sets of railroad tracks along Bonita Road, between 74th and General Chain Bar Company. (Pipe extension, General Fund). b.
