5. Resolution to authorize administrator (with guidance of chairman)
to act as general contractor and sub-let construction of shop
building addition on a "time and material" basis.
It is desirable to commence construction on the shop addition as
soon as possible after July 1st. Plans are being drawn and should be
available for your approval by the date of the meeting. In addition
to the shop we are planning to construct 3 offices on the 2nd floor
of the building. These are programmed to be for the foreman, bookkeeper
(shop), and a future draftsman.
Considerable funds can be saved if we act as our own general con-
tractor and hire the sub-contractors as needed. Clarence Nicoli has
volunteered to assist in the selection of these specialists. Some of
the work can be accomplished by our own personnel which will also save
money.

7. Postponement of systems development charge.
The Portland City Council by a 3-2 vote (Ivancie, Jordan and
McCredie -- aye; Goldshmidt and Schwab -- nay) agreed to postpone
implementation of the systems development charge until February 1,
1975. In the meantime, water rates and the system development charge
will be studied and a report submitted prior to that date. Our goal
now is to have the system development charge abandoned permanently for
out-of-city wholesale users.
We cannot complain about a reasonable increase in water rates.
However, there are two other areas which are subject to discussion:
a. Disparity in rates between inside and outside City users.
b. High pumping charges to outside users.
The first matter has been discussed previously and will be men-
tioned again if we are given an opportunity to respond to an inquiry.
The pumping charges are presently 70 per 100 cubic feet and will
+r. be reduced to 60 per 100 cubic feet on July 1st. This is excessively
high and one can only conclude that the pumps have gold bearings and
diamond-tipped impellers. Further, it is discriminatory to outside
users because in-city users on the same pumping system do not pay an
additional fee for pumping. As a comparison, our pumping charges
average about 2¢ or 30 per 100 cubic feet, including amortization of
capital improvements, depreciation, electrical costs, etc.
8. Annexation to water district.
My statement about 6 months ago regarding fewer annexations to the
water district has been reinforced with recent decisions of the boundary
review commission.
Our latest request to annex 58 acres on Bull Mountain (Windsor
Heights) has been disapproved. No longer is the commission concerned
about eliminating islands and squaring off boundaries. Proper land use
planning is the name of the game now. Before approval, all public
utility elements must be present. With the sewer restrictions presently
in effect for Washington County there are very few new -areas eligible
for annexation.

a. TWD install 280 feet of 8" C.I. + 1 fire hydrant at the ter-
minus of 98th Avenue, near Tigard Avenue, including the crossing under
two sets of railroad tracks with 14" steel casing. Also, install one
fire hydrant along 98th Avenue, mid-way between railroad tracks and
Greenburg Road. (Pipe replacement, General Fund).
b. TWD install 400 feet of 6" C.I. and plastic main in 36" steel
casing under two sets of railroad tracks along Bonita Road, between 74th
and General Chain Bar Company. (Pipe extension, General Fund)
c. TWD install 50 feet of 6" C.I. near Hiranport, Inc., on S. W.
Hunziker to complete circulation loop between 12" main and 6" main.

RESOLUTION ADOPTING BUDGET. MAKING APPROPRIATIONS, AND LEVYING TAXES
1. BE IT RESOLVED that the Board of Commissioners, Tigard Water
District, hereby adopts the budget approved by the budget committee on
May 14, 1974 now on file in the office of the Tigard Water District.
2. BE IT RESOLVED that the Board of Commissioners, Tigard Water
District, hereby levies the taxes provided for in the budget adopted
in Paragraph 1 of this resolution in the aggregate amount of $66,000
and that these taxes are hereby levied upon all taxable property within
the Tigard Water District as of 1 a.m., January 1, 1974.
3. BE IT RESOLVED that the amount for the fiscal year beginning
July 1, 1974, and for the purposes shown below are hereby appropriated
as follows:

Oregon, and the State Tax Commission at its office in Salem, Oregon,

of the budget as finally adopted.

We are the attorneys for the Tigard Water District.
Our client has executed a contract with the City governing the
purchase of surplus water. Although the District presently pur-

chases no water from the City, it anticipates doing so in the
y}I� future.
The District also favors amending Ordinance 137679 by excluding
all provisions of the System Development Charge because we feel
4E01 ; it is inequitable. As you know, the City's water system was
neither developed nor is it maintained by tax revenues. The
1! source of income is user charges, which have been paid at a
higher rate by non-City users than by residents of the City of
Portland. Therefore, non-City users have been developing the
City'e system at a higher percentage rate in the form of monthly
(� r; user charges.
1\`'`�`! We recognise that the City needs additional revenue to improve
its water system, and our client is willing to pay its fair
shares however, we believe Ordinance 137679 imposes an unfair
burden upon the user who is a non-resident of the City of Port-
land.

The Portland City Council has agreed to postpone implemen-
tation of the System Development Charge a d has requested
the Bureau of Water Works to further study both water rates
and the System Development Charge by February 1, 1975.
The rate increases as authorized last January will go into
effect July 1, 1974, exclusive of the System Development
Charge.

The territory to be annexed is located on the western edge of the
district on the south edge of Bull Mt. Rd. near SW ltilst . .Ave. The
territory contains 58 acres, 3 single family residences, an estimated
population of 9 and is evaluated at $177,200.
Reason for Annexation. Several property owners within the area to be
annexed have requested water primarily to serve a proposed subdivision
on TL 2303. The subdivision is called Winsor Heights and would consist
of 24 lots on 15 . 28 acres .
Land Use and Zoni_ . Current zoning in .%e area ins R-20, single family
resaentaai . The proposed subdivision would comply with this zoning.
The Washington County Framework Plan identities this area as being
within its urban intermediate area. The county sees this area as
being developable over a 20-40 year period depending on the availa-
bility of services and the need for the particular development. Their
interpretation in this case is that the development is premature and
that a need has not been established.
The CRAB' Interim Regional Development Policy places this area in
Priority Area 5 . The policy states that no utility extensions should
be made in this area unless a health problem exists.
The CRAG Sketch (Radial Corridors) Plan currently under detailed study
tentatively places this area in a rural residential cr agricultural
category. This has not been specifically defined in terms of density
but would presumably allow for residential uses only on larger lots of
perhaps 1 -S acres .
Utilities and Services . e, The district has an 8 inch water line in Bull.
' Mt. Rd. running along the entire northern portion of thn property.
There are no sewers in the area and none are programmed for the near
• future.
The territory is within the Tualatin RFPI).
Other. The following pertinent information is quoted from a letter to
We-It by Martin Cramton, Director of the Wash. Co. Planning Dept. :
"A preliminary subdivision on TL 2300 for 24 single family lots was
approved with conditions by the Planning Commission on March 14, /972 .
• The proposal indicated development of 20,000 square ft. lots with
individual septic tanks and drain fields . The proposal also indi-
cated water would be provided by Tigard Water District. Although
the preliminary plat was approved subject to several conditions , the
conditions were not fulfilled within the one year period as pre-
,,, scribed to maintain the validity of the subdivision preliminary
approval . It appears the proposed subdivision, Winsor Heights , does
not have Planning Commission approval , and the subdivision proposal
must be resubmitted to the Planning Commission for approval.

"Soil Conservation Service soil information indicates the predominate
soil association as Olyic-Tolke Association and Aloha-Quatama-Huber Asso'
iation. Both soil associations indicate severe limitations for septic
tank and filter field use.
"According to the Tualatin Basin Water and Sewerage Master Plan,
extension of sewer service would not be considered until after 1980."
Recommendation. The staff recommends that Proposal No. 727 be denied.
TEE summary below lists a number of facts concerning this Proposal as
well as several reasons supporting the above recommendation.
a) the territory to he annexed contains 58 acres, 3 single family
dwellings , an estimated population of 9 load :is evaluated at
$177 ,200 ;
b) some property owners desire annexation to acquire water supply
for a proposed 24 lot subdivision on IL 2303;
c) Washington County' s Framework Plan places the territory in the
urban intermediate area; according to the County Planning Dept.
this development does not meet the criteria established for
allowing development in an urban intermediate area;
d) previous preliminary subdivision approval for the proposed de-
velopment by the County Planning Commission has expired ; further
consideration of the development would require a resubmission of
the plat ;
e) the Health Department has indicated any residential development
on septic tanks in this area will have to be reviewed on an
individual basis in accordance with revised State Health Stan-
dards and requirements ;
f) according to S.C. S. soil information the subject area is character-
ized as having severe limitations for septic tank and filter field
use ;
g) the CRAG Interim Regional Development Plan indicates this site is
in a Priority Area 5 and is not suitable for consideration of any
annexation proposal at this time.
