minimum acceptable emergency standby fee can be negotiated.
In view of the fact that Clackamas River water is now being
supplied to the district and that the direct connection to Bull Run
at Bradley Corner will be operational by July 1st it was deemed
advisable to request a modification of the existing agreement with
Capitol Highway Water District. 90 days advance notice must be given
to terminate the contract which expires on October 1, 1973. (A copy
of the existing contract is enclosed).
It would be desirable to have the connection to Capitol Highway
Water District in case of an emergency; however, the district should
pay only a small monthly charge for such service.
A letter was prepared and signed by the Chairman, after review
by Ken Baines, in which the Board of Commissioners, Capitol Highway
Water District, was informed of this district's desire for a change.
It was believed necessary to send the letter prior to the June 12th
meeting of the Capitol Highway Water District so that their Board
of Commissioners could take appropriate action prior to July 1st.
(90 days before October 1st).
It is hoped that a favorable response will be received prior to
441,,.. July 1st. However, if not, this district should officially advise them
that the agreement will be terminated on October 1, 1973.

6. Resolution to approve lowest, acceptable bid for purchase of a
diesel generator to provide auxiliary power for the pump station
on Little Bull Mountain.
The Oregon State Board of Health sent a letter dated April 24,
1973 (copy enclosed) in which this district must comply with specific
requirements before any more pipe line extensions will be approved.
These requirements are:
a. Master map updated.
b. Auxiliary power for pressurized system on Little Bull Mt.
c. Auxiliary power for pressurized system on Bull Mountain.
Elden Carter was retained to accomplish the 1st requirement since
he had the master print on file. The map had not been updated since
1966. This task has now been completed.
Installation of a diesel generator at reservoir #1, Little Bull
Mountain, would resolve the problem there. It should be designed to
N'w have the capacity to provide power to operate the well pump also in
case of an emergency.
A 6 month's delay in delivery will be requested so that the unit
can be properly installed in the new shop addition which will be con-
structed this summer.
Funds for this generator must be appropriated from the General
Fund. I do not desire to estimate the cost, but bids should be received
by the date of the Board meeting.
Auxiliary power for the Bull Mountain pressurized system is a
different matter. A larger pump station is needed to adequately serve
the present and future residents on that system. Further, the pump
station and auxiliary power unit must be installed below ground because
of the restrictions imposed by the county commissioners in approving
the "conditional use" permit.
A self-contained unit, similar to the Lake Oswego pump station,
would be advisable. Cost of such a unit is estimated at $35,000, funds
for which are not available in the budget for the ensuing fiscal year;
nor can bond construction funds be used for this purpose. Perhaps a
resolution to the effect that the Board would budget and install the
appropriate equipment in FY74-75 would satisfy the Oregon State
Board of Health. Only about 20 meters are presently on the system

3-phase power is being installed to the Hi Tor pump site this week
and John Miller has installed the plumbing for the future pump station.
Evidence can be presented that the district is preparing to install the
auxiliary power and it will be accomplished when funds become available.
7. Resolution to absorb overhead and engineering fees to City of
Tigard for the 8-inch main installation from Tigard High School to
Cook Park on 92nd Avenue.
The City of Tigard must install an 8" main to Cook Park for domestic
water service. Cost is estimated at $20,000. Many of the Tigard Water
District customers who are outside the city utilize Cook Park as a
recreation area. Also, it is a good community project in which everyone
will benefit. It is believed that tax supported bodies should make all
efforts to assist and cooperate with one another. A waiver of the 107.
overhead and 87. engineering fees would be appreciated by the city and
provide the water district's contribution toward this community project.
8. Other Business.
a. Resolution to make a temporary loan to General Fund from Bond
Construction #lA due to large inventory of pipe and fittings for Bond
Construction projects, funds of which will be returned prior to June 30,
1974.
Due to such a large inventory of pipe and fittings for future bond
construction projects it appears that the General Fund will be short on
cash on June 30th. The Auditor advises that a temporary loan can be
made from the bond construction fund, but must be returned prior to
June 30, 1974.
We have not exceeded the budget appropriations for this year so such
temporary transfer is legal.
The exact amount to be transferred temporarily will be determined
by the date of the meeting. I would prefer to establish a maximum amount
to be transferred at the meeting, but actually only transfer that amount
needed on June 30th.

11. Lake Oswego connection.
On June 5th the pumps for the Clackamas River water were officially
started to provide water to our customers. John Miller continues to check
out the system, but from all indications, our pump station and distribu-
tion system are capable of taking all the water Lake Oswego can provide.
12. Bradley Corner connection.
At the last meeting I indicated that it would be in the district's
best interest to construct the 16" main to Bradley Corner now instead of
waiting until this winter. Construction now would save at least $15,000
in boring costs under the approaches to the Beaverton-Tigard freeway at
Greenburg Road. With the chairman's concurrence, work has commenced.
The "pieces have fallen together" unbelievably well on this project.
The plans were prepared on May 15th. Approval was obtained from the
Oregon State Board of Health, Oregon State Highway Department, and Wash-
ington County. The pipe and fittings were delivered in record time by
U. S. Pipe Company. On May 30th one contractor was boring under the
freeway while another contractor was laying pipe. The bore is now
finished and if all goes well the pipe line should be completed by July
1st.

Cornell Construction Company later advised that they could not

Elden Carter has been "pushed" to start work on the common meter
vault which will be constructed by Portland Bureau of Water Works for
both Metzger and Tigard Water Districts. All of the fittings have
arrived except the master meters which are due within 2 weeks. I want
to get started before the master meters arrive. They can be"dropped
in" anytime.

RESOLUTION ADOPTING BUDGET. MAKING APPROPRIATIONS. AND LEVYING TAXES
1. BE IT RESOLVED that the Board of Commissioners, Tigard Water
District, hereby adopts the budget approved by the budget committee
on May 17, 1973 now on file in the office of the Tigard Water District.
2. BE IT RESOLVED that the Board of Commissioners, Tigard Water
District, hereby levies the taxes provided for in the budget adopted
in Paragraph 1 of this resolution in the aggregate amount of $46,600
and that these taxes are hereby levied upon all taxable property within
the Tigard Water District as of 1 a.m., January 1, 1973.

several water pipeline extensions, all referenced above, have been
reviewed and are approved subject to compliance with the standard
provisions on the attached sheet. We will await your reply when

projects are in conformance with the comprehensive water plan for
Washington County.
The plans, with provisional approval noted, are retained for our
files.
We note that the main to be constructed at S. W. 109th Avenue and

Oregon Administrative Rules Chapter 333 Section 2 (4) states:
. . when a person who would otherwise be a customer takes
water from a distribution system at his meter and furnishes
that water to more than three single residences or other
users for the purpose of drinking, culinary or household uses,
such person is operating a community water supply system
whether or not a charge is made for the water used. In the
case of water pipelines serving condominiums or other multiple
unit dwellings, the water distribution system piping shall
include the water pipelines to within 10 feet of the buildings.
Therefore, before constructing the pipelines from your water main to
serve these buildings, plans must be submitted to and approved by
this office for the meters and piping to within 10 feet of each
building. These plans must be prepared by a registered engineer and
clearly specify the proposed work. Meters and pipelines must be
sized to avoid excessive velocities. Sewer pipelines must be shown
so that it is apparent that no conflict will exist. Special
construction will be required if proper water and sewer pipeline
separation is not possible.
A review of our files reveals that no up-to-date water system map is
present. In conversations with you we learned that the originals Of
this map have not been kept current.
0. A. R. Chapter 333 Section 9 (2) (a) states:
Maps: Complete and up-to-date maps of the utility system,
drawn to adequate scale, shall be maintained. They shall.
show locations of pipelines, valves, fire hydrants and service
connections, and shall include notations as to size and kind
of pipet Plans or drawings shall be kept of all facilities
showing in detail piping, pumps, motors, appurtenances,
electrical wiring and structures.
Therefore, in order to comply with the above cited rule, it is
necessary that an as-built map be drawn of the system and a copy
s,ibrnitted for our files. We would suggest that a scale be chosen
that will allow street names to be included and also allow
additions as new construction is completed. The pressure systems
should be shown separate from the gravity system to avoid confusion.
While we do not require submission of detail intersection water
pipeline maps we believe that good water system management practice
would require that these maps also be complete.
O. A. R. Chapter 333 Section 8 (1) states:
. . . All equipment shall be of adequate size and capacity
and be correlated with the available supply from storage to
supply adequately, dependably and safely the total water

requirements of all consumers at maximum consumption without
exhausting the supply at the source. The units of source
facilities shall be of such capacity that an outage of any
individual unit during a period of peak demand will not
result in reduction of supply in the distribution system
below the requirements for an adequate, dependable and safe
supply for all consumers. Duplicate or standby emergency
equipment shall be provided at the time of construction and
thereafter maintained as necessary to insure this...
Most of the Tigard Water District customers are served reliably
from the reservoirs by gravity. The source of supply for many
users, however, is a booster pump station serving upper elevations.
In order to comply with the above cited rule in these cases, at
least two pumps are required and in addition provision must be
made to maintain service in case of electrical failure in the
utility system. This is usually accomplished with a gas driven
pump or electrical generator. These units must be permanent
facilities in each pump station where electrical failure would result
in the loss of adequate water pressure. We would suggest the use
of liquid petroleum or natural gas as a fuel.
We have set forth the requirements for maps and booster pump
reliability above. These items must be satisfactorily resolved
before additional pipeline extensions can be approved by this
office. We will await receipt of your plans.

STANDARD PROVISIONS

The following numbered paragraphs are standard provisions which are general in scope
and pertain to all community water supply construction.
1. All materials and workmanship must be in strict complaince with the
provisions of the Oregon Administrative Rules 42-005 governing "Pro-
duction and Delivery of Water for Domestic Use".
2. All potable water lines and wells, reservoirs or tanks which will produce
or hold potable water, must be adequately flushed and sterilited in con-
formance with the Health Division standards, and tests must indicate that
the water is free of bacteriological contamination prior to use as set forth
in Oregon Administrative Rules 42-025, paragraph (4,d).
Highly chlorinated water shall not be discharged to streams in such a manner
as to damage aquatic life as set forth in Oregon Administrative Rules 41-025,
paragraph (5).
3. The construction of the project shall be under the supervision of, and shall
be thoroughly inspected by the registered engineer, who at the completion of
the project shall certify in writing to the State Health Division that such
construction was inspected by him and found to comply with the approved plans.
4. The installation of the project must comply fully with the regulations of
"'r"` the State Health Division and the Department of Environmental Quality regard-
ing the relative location or separation of water and sewer lines. This
requirement is set forth in Oregon Administrative Rules 42-025, paragraph (4,d).
5. Construction of the proposed project must be in conformance with the approved
plans and specifications and with applicable codes. No changes or deviations
shall be made without the written approval of the State Health Division as
set forth in Oregon Revised Statutes 449.220, paragraph (3).
6. All piping must be sized to carry maximum design flows at reasonable velocities
and friction losses. The system must be able to supply water at a minimum
pressure of at least 20 psi to all points in the system during periods of
maximum water demand as set forth in Oregon Administrative Rules 42-025,
paragraph (1) and (2) and also paragraph (4).
7. No piping arrangement shall exist which permits contaminated water or other
fluids to enter any domestic water supply or its piping system as set forth
in Oregon Administratice Rules 42-017, paragraphs (1) to (8).
8. Dead-end runs shall be provided with means of flushing to prevent deterioration
of water quality as set forth in Oregon Administrative Rules 42-025, para-
graph (4,b).
AGREEMENT
This AGREEMENT made and entered into as of this 1st day
of October, 1968, by and between CAPITOL HIGHWAY WATER DISTRICT, a
municipal corporation of Multnomah County, Oregon, and hereinafter
called CAPITOL HIGHWAY, and TIGARD waTER DISTRICT, a municipal
corporation of Washington County, Oregon, hereinafter called TIGARD.
WITNESSETH:
Capitol Highway and Tigard are each municipal corporations
organized under the provisions of ORS 264, and are engaged in the
supply of water for domestic purposes to the residents in their
respective areas. Tigard is in the process of constructing a 12-inch
cast iron water main from its S. W. 66th Avenue and Baylor Street
reservoir site to a terminus in the vicinity of S. W. 47th and Arnold
Street, within the boundaries of Capitol Highway, and is desirous of
purchasing from Capitol Highway some of the surplus water whic1460 h
Capitol Highway might have. Capitol Highway is willing to sell said
surplus water to Tigard at the point of connection at S. W. 47th and
l Arnold Street, in consideration of which and in consideration of the
covenants and agreements herein contained, the parties agree as follows:
(1) Capitol Highway agrees to furnish and sell water to
Tigard under the terms and provisions of this agreement delivered at
Tigard's connection at S. W. 47th and Arnold Street. The obligation
on the part of Capitol Highway to sell and furnish water is subject

(3) Tigard shall pay to Capitol Aighiay a sum of money
equal to .33e for each 100 cubic feet of water delivered pursuant
to the provisions of this Agreement. In addition, Tigard shall pay
it
to Capitol Highway the monthly demand charge which the City of Port-
land may allocate to Tigard under this Agreement. The rate of charge
for water service is based upon the current charge for water service
furnished by the City of Portland to Capitol Highway and it is under-
stood that any change in the rata tido by the City of Portland to
Capitol Highway and any change in thl dcz end charge, whether increased
or decreased, shall work an appropriate pro-rata increase or decrease
in the rate and charges made herecnaT.
Should the water meter fail to register accurately the
quantity of water passing through it, the charges for water delivered
during the period of inaccuracy shall b3 ootir±atcl by Capitol Highway
from data showing the average daily vola^eof water passing through
this meter when operating accurately.

(4) This agreement shall be for a term of five (5) years
ending October 1, 1973 and may continue thereafter indefinitely
1 4111# until cancelled by either party upon giving to the other 90 days
prior written notice of this intention to cancel. This agreement is
subject to immediate cancellation by Capitol Highway if Tigard or
any of it' s users fails to comply with the rules and regulations
descriLed herein or if Tigard fails to comply with the terms of this
agreement or fails to pay the full charges for water furnished when
the same are duo.

Re: Water Rate Increase
Gentlemen:
Effective July 1, 1971, the City of Portland will increase water rates
25 percent. Also, the electric rate has recently increased approximately
10 percent. As a result of the increases mentioned above, the water

rate to Tigard Water District has been increased.
At the regular monthly meeting of the Board of Commissioners held on
June 9, 1971, a motion was made, seconded and passed to increase the
Tigard Water District water rate 15 percent, which will increase the
rate from $0.33 per hundred cubic feet to $0.38 per hundred cubic feet
and a $200.00 per month and/or a $20400.00 per year minimum or standby
rate. This will be effective with the July 1971 billing.
Our next meeting is on July 14, 1971, and we would like to extend to you
an invitation to meet with us.

modify the existing agreement, dated Ontobsr 1, 1963, between Capitol
Highway Pater District and thin district. The reed for surplus water
beyond Capitol Highway Pater Distufct'L capability to provide and cost
considerations indicate that a chc730 in deemed advisable. The present
agreement is due to ernire on October 1 , 1973.

The average daily demand of the district is 1.5 mgd with a peak con-
sumption of 4 mgd. It is believed that the needs of the Tigard Water
District can be net until about 1980 without purchasing water from Capitol
Highway Water District. However, it would be advantages to keep the eon-
netion available for emergency purposes.
The Board of Commissioners would prefer an arrangement for a standby
connection, effective July 1, 1973, with cost therefor similar to Portland's
charges. The standby charge for unused water service is described on pages
16 and 17 of the Water antes beet for the. Portland Bureau of Water Works
and is the sum of S5 per month, providing no water is uncd. If there is
any water used during a month, the ninimu71 charge in $189.15 so described
on page 7 of said book.
The Capitol Highway Water District has served the Tigard Water District
well end to the host of Ito capability during the past several years. The
efforts and cooperation of you end your staff in sincerely appreciated by
the Board.

Dear Mr. Seegers
The 16-inch pipe installation between the City of Lake Oswego
(Waluga reservoir) and the Tigard Water District (Bonita and Hall Blvd)
was completed this date, except for the telemetry system at the Lake
Oswego treatment plant. The telemetry system will be furnished and
installed by Mr. David Fry, Autocon, Inc., when the equipment is received
from the manufacturer. Unfortunately, Mr. Fry states that it may be
several months before the appropriate equipment becomes available.
All water system improvements, including master meter, valves, con-
! `► trols, end appurtenances were installed as approved by the City of Lake
Oswego. All mains have been satisfactorily pressure tested and sampled
by the Oregon State Board of Health.
In accordance with the agreement dated October 17, 1972 the City of
Lake Oswego is hereby deeded ownership of the main to the outlet side of
the master meter located on the east side of the 1-5 freeway.
As is the normal procedure, Tigard Water District agrees to be
responsible for any repairs or replacement costs in the main due to
workmanship or materiel deficiencies for a period of one year. In this
regard, the district is covered by a contract bond issued to Arndt-Colt
Construction Company by General Insurance Company of America. (See
enclosure 1).
All costs of the project were borne by the Tigard Water District.
Also, this district will assume those future charges for the telemetry
system to be installed at the treatment plant by Mr. Fry.
The cost of that portion of the project from Waluga reservoir to,
and including, the master meter, was $87,193. Your Auditor should be so
advised so that this capital improvement can be added to the City's asset
account.

The Director of Public Works requested that a 24-inch main be
installed in lieu of a 16-inch main along Stone Avenue, near the Waluga
reservoir. The difference in cost of this oversizing should be paid by
the City of Lake Oswego and amounts to $2,959.05. (See enclosure 2).
The figure of $84,234 ($87,193 minus $2,959) or $16.65 per lineal
foot can be utilized as a basis in determining costs for future service
connections which may be mutually agreed upon.
The Administrator has advised me that 5 copies of "as-built" draw-
ings will be delivered this week to your Director of Public Works.
Also enclosed are copies of permits issued by the Oregon State
Board of Health, Oregon State highway Department, end Clackamas County.
All mains and appurtenances were installed on State, County, or City
right-of-ways without need of casement agreements. The permits authorized
construction on these public streets and roads.
We are deeply grateful to you in your efforts, cooperation, and
understanding in making this inter-tie possible. We look forward to a
long and mutually rewarding relationship.
