Baines, Attorney The meeting was called to order at 7:35 p.m. by Chairman Wied. A motion was made to approve the minutes of the last meeting, as written. Motion carried. Mr. James Harris (Harris & McMonagle Engineers) Mr. Roland "D" Dorval (Carter, Bringle Engineers) Mr. Lee Ascher (Carter, Bringle Engineers) Mrs. Kathy O'Neil (Oregonian) Representatives from following firms: Keiser Construction Company Everett L. Wiggins Coast Contractors, Inc. Gene H. Settergren Schrader Construction Co., Inc. Mr. and Mrs. Merrifield and Mr. Hausperger inquired about when the contractor would move his equipment at the new High Tor reservoir site, and the proposed dates for the construction of the fence and landscaping. The Administrator was directed to order the contractor to move his equipment within 5 days or forfeit $100 per day from the retainer fee. The visitors were advised that the cyclone fence would be installed next week and planting of shrubs would commence in late Fall or early Winter. -1- Dr. Bissett stated that he was convinced that either the con- tractor, Mr. Wiggins, or Tigard Water District would ensure that the dirt which was dumped on his property from the High Tor reservoir excavation would be leveled. It was suggested that the matter be w.• returned to the Administrator, that the district assume responsibility for leveling, and that the Administrator work it out with the con- tractor. A motion was made to negotiate with the contractor for a settlement between the district and the contractor as to the leveling of the dirt dumped on Dr. Bissett's property. Motion carried. Mr. James Harris requested to know the district policy on other engineers designing water systems with the district. He was advised that it was district policy for all engineering design work to be accomplished by the district staff. The motion was made that Mr. Harris' request for an exception to the existing district policy be denied. Motion carried. A motion was made to pay the vouchers. Motion carried. Action on approval of revised rules, rates, and regulations was deferred until the Administrator has sufficient time to review and incorporate the recommended changes into the master copy. The attorney advised that if the regulations are changed, statutory procedures must be followed. The motion was made to accept a contract to purchase surplus water from Lake Oswego. Amendment #1: Motion was made to amend the motion to add the language "acceptance contingent upon satisfactory negotiation of Para- graph 1, Page 2, whereby agreement is reached that rate will not be changed for Tigard unless an equal or pro-rata change is also made for all other users of the Lake Oswego supply. Amendment #2: Motion was made to amend the motion to eliminate the word "balanced" in Paragraph 3, Page 1. Amendment #2: Motion carried. Amendment #1: Motion carried. Motion: Motion carried. Bids to raise the elevation of reservoir #3 by 12 feet were opened and announced as follows: Keiser Construction Company $59,339 *Everett L. Wiggins 50,244 Coast Contractors, Inc. 73,800 Gene H. Settergren 55,000 Schrader Construction Co., Inc. 109,360 -2- Motion was made to award the contract to apparent low bidder, subject to review by Administrator. Motion carried. A"` Bids were noted to install 4,000 feet of 16-inch ductile iron pipe along S. W. Hall Boulevard, from MacDonald to Bonita, and along Bonita Road, from Hall to Fanno Creek (75th Avenue), as follows: *Cornell Construction Co. $3.50/ft Arndt-Colt Construction Co. 4.37/ft Bunyard and Pettitt No Bid Motion was made to award the contract to apparent low bidder, subject to a favorable legal opinion from legal counsel. Motion carried. Motion was made to table indefinitely the proposed agreement with Metzger, Progress, and Winmar, Inc. for district participation in the cost of a 24-inch main from the Portland city limits to Bradley Corners. Motion carried. Motion was made to approve solicitation of bids for $480,000 of bonds and approve the notice of the bond sale. (See complete resolution attached). Motion carried. The Administrator was directed, whenever practicable, when writing a letter to a body, such as the Washington County Board of Commissioners, or Boundary Review Commission, or other governing authorities, an advance draft will be sent to each Commissioner. Further, if no negative response is received within 24 hours, the letter may be mailed. The Administrator was instructed to attend the meeting on September 20th at the Hillsboro City Hall regarding participation with other pur- veyors of water in Washington County for a 45-inch main and reservoir from the Scoggins Dam project. It was suggested that it would be more economically feasible for Tigard to remove the augmented water flow from the Tualatin River. It was mentioned that the district did not have sufficient funds to participate in the project. Motion was made to authorize Nancy L. Larson, Bookkeeper, to receive and receipt to the District's Paying Agent for cancelled bonds and coupons of the District. Motion carried.
