1. Resolution to approve minutes of last meeting.

period July 1, 1972 to June 30, 1973.
Mr. Jim Savage has revised the original contract to include provisions
for cost of audit services in addition to a time limit on submission of the
annual report.
Comments of Ken Baines on the proposed contract are attached.

5. Resolution to adopt revised rules, rates. and regulations.
Copies of the revised rules, rates, and regulations were sent to each
commissioner prior to the last meeting.
It would be appropriate to include the following paragraph in the
regulations in that portion relating to rebates on main extensions:
"Water. District shall make all reasonable effort to
collect for such connections and shall pay over such
amounts collected to the person or persons who paid for
such extension. No connection shall be made until pay-
ment is received unless Water District is ordered to
allow a connection by a court order. In the event suit
or action is filed against Water District which challenges
the right of Water District to make or collect the con-
nection charge or challenges the reasonableness thereof,
the person or persons who paid for the main extension will
assume the defense of this litigation and to hold Water
District harmless from any loss or expenses resulting
therefrom."
Ken Baines recommended a similar paragraph in the rebate agreement
"` with School District #23J.

6. Resolution to authorize $51.18 per month to George Beaudry while he
is incapacitated to work.
On October 24, 1972 George Beaudry, an employee of the TWD, injured
his left knee seriously while transporting 6" C.I. pipe on a trailer.
Evidently, he slipped and struck his knee cap on the concrete curb. No
bones were broken, but he severely damaged ligaments and tendons which
required surgery. He is convalescing now, but it may be 4 to 6 months
before he can return to work.
State Industrial Accident Insurance will take care of all hospital
and doctor bills and will pay him $17 per day ($85 per week) while he is
disabled.
TWD's insurance policy covers retirement and life insurance, but no
provision for lost wages due to disability. George Beaudry has been an
employee of the water district for 4 years and has a wife and 4 children.
He is very concerned and worried about his finances while disabled. He
has expressed a desire to cash inhis retirement policy so that the family
will have enough to live on.

From the $17 per day he must continue to contribute each month $24.51
for his retirement program and $26.67 for Blue Cross coverage for his
family.
To relieve a major concern of George Beaudry it is recommended that
the district assume the payments as noted above, a total of $51.18 per
month, while he is incapacitated.
7. Other business.
8. City of Lake Oswego approved contract.
On November 6, 1972 the City Council of Lake Oswego unanimously approved
the contract to sell surplus water to TWD. It is a relief to have this accom-
plished prior to installing mains beyond the district boundaries.
It is ironic that Lake Grove Water District now expresses a desire to
annex to the City of Lake Oswego to obtain water and sewer service. Mr. Carl
Green, engineer for Lake Grove Water District, requested that TWD slow down
in construction of the water main and provide Lake Grove with an opportunity
to reach an agreement with Lake Oswego. Lake Grove has about 700 connections.

Mr. Green was advised that TWD cannot afford to slow down because the
connection must be operational by May 1973. (It means about a $35,000
savings in water purchases the first year). Pipe deliveries take about
2 months from date of order. If the Teamsters go on strike next Spring
there could be a delay in pipe shipments. Accordingly, it is full steam
ahead with a target date of May 1st.
9. Construction progress on Lake Oswego connection.
For convenience I have divided the construction of the 16" main to
Waluga Reservoir into 4 phases as follows:
Phase I: Hall & MacDonald to Bonita & 74th,
including a Fanno Creek crossing 4,000 feet
Phase II: Bonita & 74th to I-5, including
crossing of 2 sets of railroad
"" tracks and I-5 2,500 feet
Phase III: I-5 to Upper Boone's Ferry Road 3,300 feet
Phase IV: Upper Boone's Ferry Road to
Waluga Reservoir 1,750 feet
Total: 11.550 feet
Phase I is finished and work is proceeding on Phase II. All pipe
construction will be accomplished prior to installing the master meter
on the east side of I-5 and the pump station on the west side of I-5.
10. Status of Bull Run connection at Bradley Corners.
Although this matter has been tabled indefinitely you should know about
recent developments.
There are three different developers interested in constructing large
housing projects in the area of 121st and Scholls Ferry Road.
(1) Commonwealth on the 40 acres south of Scholls Ferry Road; (2) The
Robinson tract of 53 acres north of Scholls Ferry Road; and (3) a Washington
wow firm on 29 acres south of Scholls Ferry Road, west of 121st Avenue. The

latter parcel should probably be served by TWD. Commonwealth is resigned
to have Progress Water District serve their development, but the Boundary
Review Commission has indicated that TWD should serve this area. There is
a controversy as to whom should serve the Robinson tract: Beaverton or
Progress Water District.
Elden Carter has been in contact with these developers and all have
expressed a willingness to contribute to the cost of the 24" main from the city
limits of Portland to Bradley Corners if they can be assured of being served
water. They would also have to extend adequate mains to their projects,
including internal mains.
According to Carter, if Progress Water District serves both the Common-
wealth and Robinson properties, Progress Water District would also be expected
to pay a larger share for the 24" main. Without Winmar's contribution, the
original percentages and costs were estimated as follows:
Tigard Water District: 50% $43,000
Metzger Water District: 30% $25,800
v""` Progress Water District: 20% $17,200
Total: $86,000
In summary, if these developments are served by Progress Water District
the pro-rata share for TWD should decrease significantly in two areas; namely:
percentage-wise and actual dollars contributed by developers.
It would appear that the Board might be willing to participate in some
amount between $1 and $43,000 in construction of the 24" main and thus eliminate
any doubt or gamble of not being served from this source. A vested interest
in the cost of this main would ensure TWD the right to connect at the district's
leisure. A vested interest would also be accompanied with a contract with the
City of Portland to purchase surplus water, including at peak demand periods
only, if desired.
Construction is not scheduled to begin until March 1973 so there remains
ample time before a decision must be reached. I shall keep you informed of
developments.

11. Proposed merger of Garden Home. Progress, and Metzger Water Districts.
The recent edition of the Tigard Times covered the proposed merger of
these three water districts. A hearing will be held on November 15th at
Portland Community College.
It should be noted that if the merger occurs, water rates will be
reduced to $3.50 for the 1st 600 cubic feet and 44¢ per 100 cubic feet
thereafter. This compares with TWD rates of $3.00 for the 1st 600 cubic
feet and 400 per 100 cubic feet thereafter.
The combined "Metzger" District will have a total of about 3900 con-
nections compared with about 3700 for Tigard Water District.
12. TWD service to Metzger area on 72nd Avenue.
Metzger Water District is presently constructing the 12" inter-tie
along 72nd Avenue, north of Hunziker Road, in anticipation of adequately
serving the industrial area with fire protection. This action was in
response to TWD's ultimatum that free water service to this area would be
discontinued after June 30, 1973.
13. Bond Construction #1A.
The remaining funds, $480,000 of Bond Construction #E1, were received
on November 1, 1972 (Actually $470,400). It was designated Bond Construc-
tion #lA to distinguish it from Bond Construction #1. Funds were deposited
as follows:

14. Supplementary Budget.
It will be necessary to prepare a budget for Bond Construction #1A.
Also, there are some corrections that need to be made in the General Fund
budget. This will be accomplished in January when the snow comes and
construction is curtailed.
15. Construction Progress on #3 reservoir.
Everette Wiggins has finished the walls of the reservoir extension
(12-feet), and should be pouring concrete for the new top this week,
weather permitting. He has indicated that he will complete all con-
struction work prior to the end of the year except for installing the
stainless steel bands around the circumference of the lower (pre-existing)
portion of the tank. This will require extensive excavation and it may be
March before finally accomplished.
16. Shrubs for new Hi Tor reservoir.
130 Pyramidal Arborvitae trees have been ordered from Klupenger
Nursery in Aurora. Mr. Klupenger lives across the street from the new
reservoir and he assures me that the trees are nice. He has to look at
them more than we do.

Re : Savage & Co. - Tigard eater istrict Audit Contract
Dear Bob:
I have reviewed the captioled Audit Contract dated November 14 ,
1972 , and approved it as t ) form.
410 Paragraph 1 provides that this Contract can be terminated during
any year; however, the party wishiIg to terminate the Contract
must give written notice of its intention to do so on or before
January 1 of the year in which the Contract is to be terminated.
Although I have no objection to this provision, I wonder whether
or not the Board feels it is necessary.
This Contract also provides that the fee for the audit of years
subsequent to June 30, 1973 , shall be an amount not to exceed the
budget estimate for subsequent years; therefore, it appears that
the fee for subsequent years will be set by the District based
upon the budget estimate. I don't know how the Budget Committee
estimates this annual charge.

AUDIT CONTRACT
THIS AGREEMENT, made this 14th day of November 1972, in accordance
with the requirements of Oregon Revised Statutes 297. 610 through 297. 740
between. Savage and Company of Oregon City, Oregon hereinafter known as
the Party of the First Part, and Tigard Water District of Washington County,
Stale. of Oregon, hereinafter knownas the Party of the Second Part.
1. IT IS HEREBY AGREED that the Party of the First Part shall
conduct an audit of the accounts and fiscal affairs of the Party of the Second
Part for the fiscal year beginning July 1, 1972, and ending June 30, 1973,
and for each fiscal year thereafter, in accordance with the prescribed
Minimum Standards of Audit Reports, Certificates and Procedures. It is
agreed further that termination of this agreement shall be only by written
notice by the Party of the Part wishing to terminate this agreement given
w the Party of the other Part not later than January 1 of the year in which
this agreement is to be terminated.
2. Party of the First Part agrees that the services he has contracted
to perform under this contract shall be rendered by him or under his personal
supervision and that the work will be faithfully performed with care. and
diligence.
5. It is understood and agreed that, should unusual conditions arise
or be encountered during the course of the audit whereby the services of the
Party of the First Part are necessary beyond the extent of the work contemplated,
written notification of such unusual conditions shall be delivered to the Party
of the Second Part who shall instruct in writing the Party of the First Part
concerning', such additional services.
4. The audit shall be started as soon after this contract is executed
as is agreeable to the Parties hereto and shall be completed and a written
report thereon rendered by September 1 each year. Twelve copies of such
report shall be rendered to the Party of the Second Part and its form and
content shall be in accordance with and not less than that outlined in the
Minimum Standards of Audit Reports, Certificates and Procedures.
5. In consideration of the faithful performance of the conditions,
covenants, and undertakings herein set forth, the Party of the Second Part.
hereby agrees to pay the Party of the First Part a fee of $1400. 00 for the
fiscal year. ended June 30, 1973 and an amount not to exceed the budget:
estimate for subsequent years. The Party of the Second Part hereby affirms ,AN
that proper provision for the payment of such fee has been or will be duly made
and that funds for the payment thereof are or will be made legally available,
