Resolution to pay vouchers. 4. Resolution to accept lowest approved bid to purchase self- contained pump station for installation at S. W. Bonita Road and I-5 for Clackamas River water (City of Lake Oswego). Specifications for the new pump station with associated telemetry equipment have been prepared and sent to three independent pump manufacturers for bids. So that you will not be shocked, it is estimated that the total cost will be about $30,000. This pump station will provide a capacity of 4.3 million gallons per day (mgd) utilizing 2 - 100 hp pumps. Provision for a future 3rd 100 hp pump is included which will provide a total capacity of 6.45 mgd. As a comparison, the ST&R Study of 1971 proposed a pump station of 12 mgd at a cost of $95,000. Of course, this was utilizing a 30" transmission main in lieu of a 16" main. The pump station will include associated telemetry equipment so that the pumps can be controlled remotely (automatically or manually) from both Lake Oswego's treatment plant and/or Tigard Water District shop. Recording devices will reflect the level of #1 reservoir, flow rate, pumps in operation, and pump failure alarm. The installation of this telemetry equipment constitutes the 1st phase of the district's electronic controls which were included as an integral part of the last few bond issues. -1- ADMINISTRATOR'S REPORT (Continued) 5. Resolution to approve participation in cost of 24-inch main from Portland city limits to Bradley Corners. 1/3 of remaining construction costs or approximately $30.000: that the main be deeded to City of Portland; that Tigard Water District be guaranteed the opportunity to connect to the main at some future date; and that Tigard Water District become direct users of Bull Run water. Enough has been said and written about this project. In summary, is it worth $30,000 to be guaranteed a Bull Run connection at Bradley Corners? Time is running out and the matter must be resolved at this meeting. 6. Resolution to approve agreement with City of Portland to purchase surplus water. effective when connection is made at Bradley Corners and appropriate meter installed. wow If the above connection is authorized, the district should enter into a standard agreement with the City of Portland to purchase surplus water. We definitely want this contract consummated prior to expending funds on the 24" main. Ken Baines has reviewed the contract and has approved it as to form. 7. Resolution to approve a surcharge of $50 per 1-inch meter and smaller. and $100 for meters larger than 1-inch. effective July 1. 1973. exclusive of Bull Mountain system. Your approval now of the meter surcharge concept would be of assist- ance in preparing the new budget. New meter charges would be as follows: Meter Surcharge Total Cost 5/8"x3/4" 150 $50 $200 1" 225 50 275 above 1" Cost + 25% 100 Cost + 25% + 100 Funds derived therefrom would go into a Capital Improvements Fund. The $200 now received for each meter installation on the Bull Mountain system goes into the Bond Sinking Fund to pay off bond issues. -2- 4.4600 ADMINISTRATOR'S REPORT (Continued) If you approve of reduced summer rates from 400 to 300 per 100 cubic feet, it is estimated that the district will lose about $30,000 annually. The surcharge on meters will regain about $15,000, and the remaining $15,000 can be recouped in savings by purchasing Lake Oswego water versus Bull Run. 8. Resolution to declare George Beaudry physically disabled from future employment with the district; and that portion of his retirement fund contributed by the district be retained with the insurance company for his future retirement. Because of his disabling injury, George Beaudry has qualified for the Oregon State vocational rehabilitation program. He will enroll at Portland Community College next month where he intends to major in accounting. His doctor has verified the fact that he cannot return to his prior duties as a pipe fitter because of his injury to the left knee. im r The life insurance policy in effect for TWD employees provides for the employee to pay 3% and the district 7% of the monthly wage into a retirement fund. If an employee's services are terminated prior to 5 years with the district, the employee retains his 3% contribution plus interest and the district recoups the 7% with interest. After 5 years, employees can retain some of the district's contribution based upon a graduated scale. There is a clause in Beaudry's life insurance and retirement policy (Northwestern National Life Insurance Company) which provides that a disabling injury deemed permanent authorizes the injured party to retain the 7% contribution of the water district (about $1200) in a retirement fund and the insurance company must waive all subsequent premiums. George Beaudry has terminated his employment with the water district as of February 1, 1973. His injury has permanently disabled him from returning to his former duties and it appears he qualifies for the additional benefits as noted above. 9. Appointment of budget officer and one new member for budget committee. One commissioner must be selected as budget officer to supervise the preparation of the FY73-74 budget. -3- ADMINISTRATOR'S REPORT (Continued) The following named individuals are presently members of the budget committee: Name Term expires Harold A. Jenovich 1975 As a preview of major equipment to be proposed for purchase on the next budget, the following list is submitted: 1. 1-ton dump truck to replace 1953 Ford (Budgeted for in present budget, but not purchased) $5,800 2. Homelite pump 600 3. Electric threader (pipe) 750 4. Chain saw 250 ,.w- We are hopeful that the shop can be expanded to the rear for additional storage room and working area. Estimated cost: $5,000. 10. Other business. 11. Construction progress on Lake Oswego connection. Only 2700 feet of 16" ipe remains to be installed to complete this connection. (75% completed). It is the area between the railroad tracks (General Chain Saw Company) and Bangy Road on the east side of I-5. (The 36" casing has been installed under I-5). The Oregon State Highway Department intends to purchase additional land adjacent to Bonita Road where the main is to be located. Condemnation proceedings are scheduled to commence within 6 weeks. In the meantime we cannot proceed unless an easement is obtained from the private owners. Easement documents have been sent to the parties involved, Mr. Krick and Southern Pacific Transportation Company, but no response of an encouraging nature has been received. The last components of this project will be the installation of the master meter and the self-contained pump station. Delivery date for the Aa r meter is April 1 while the pump station cannot be ready prior to April 1 . Commercial Street Tigard, Oregon 97223 Dear Mr. Santee: Confirming our conversation of last week, I am enclosing a sample agreement to be executed between the Tigard Water District and the City of Portland for direct water service to the Tigard Water District should they jointly ,, participate in the cost of the proposed 24-inch water line to Bradley's corner. As soon as the size, type and location of meter are agreed upon, the document could be formalized except for the effective date. I am also enclosing a copy of the Portland water rates schedule which itemizes the applicable rates to be charged under Schedule 2 on Page 7 covering rates for water served from tanks with a base elevation under 875 feet. Hyle Manager RCH:mka Enclosures AGREEMENT• THIS AGREEMENT, made and entered into this day of , .L9 , by and between the TIGARD WATER DISTRICT hereinafter referred to as Purchaser and the CITY OF PORTLAND, a municipal corporation of the State of Oregon, hereinafter referred to as City, WITNESSETH: WHEREAS the said Purchaser is now obtaining or desires to obtain surplus water from City, and City is willing to furnish such surplus water upon the terms and conditions hereinafter set forth, NOW, THEREFORE, by virtue of the power and authority conferred on the Mayor and Commissioner in charge of the Bureau of Water Works by Ordinance No. 130672, Title 21, Water Regulations, of the Code of the City of Portland, Oregon, the parties hereto hereby agree to and with each other as follows: The service and commodity provided by City under the terms and Aft 410 provisions of this agreement are a special contract service and not provided by City as a common utility service. In consideration of the covenants herein set forth on the part of Purchaser to be kept and performed, City agrees to the continuance of the connection (or a new connection) between City's water system and Purchaser's system by a meter to be located rt (size and location of meter) Purchaser recognizes and agrees that City will furnish and sell only surplus water under the terms and provisions of this agreement, and it is the duty of City to furnish water at normal volume and pressure to the City of Portland and its inhabitants before selling or furnishing any water to Purchaser; however, subject to the above- mentioned exceptions and those hereinafter set forth, City will endeavor to maintain on its distribution system at the point of the IRPurchaser's connection a normal volume and pressure flow. 2 Purchaser hereby agrees to abide by and be bound by the terms and provisions of Ordinance No. 130672 , Title 21, Water Regulations, of the Code of the City of Portland, Oregon, as it presently exists or may hereafter be amended by the Council of the City of Portland during the life of this agreement. Purchaser agrees to provide on its main at a point near the connection with City 's main a compound water meter or meters of type and pattern approved by the Bureau of beater Works of the City of Portland who will maintain the meter or meters in proper working } condition at Purchaser's expense and which will at all times measure the surplus water supplied by City to Purchaser. It is understood and agreed by and between the parties hereto that City may at its discretion temporarily discontinue the supply of surplus water to Purchaser in order to relieve the burden on City's distribution system during "peak load" periods. On or before June 30 of each year, Purchaser agrees to furnish to City in writing a legal description of the boundaries of the area supplied or to be supplied by its distribution system, together with a report and maps showing all mains now existing or that may hereafter have been laid, and the location and capacity of all storage tanks. Such description, report and map or maps showing the location of mains and the location and capacity of storage tanks within the district, shall be filed with the Engineer of the Bureau of Water Works of the City of Portland. No water shall be sold by Purchaser outside of the distributing area as shown by the above-mentioned description and map or maps filed with the Engineer of the Bureau of Water Works, without first obtaining written permission so to do from the Commissioner in charge of the Bureau of Water Works. Purchaser also agrees to furnish not later than June 30 of each year to the Superintendent of the Bureau of Water Works of City, a statement showing both the total active and vacant services served is by the distributor and the total active and vacant services on any subdistributor's lines. Purchaser agrees to provide water supply to City of Portland residents in areas adjacent to Purchaser's water mains, said water to be metered by City. The total volume of such metered water, plus ten per cent (10%) will be credited to Purchaser by City . 410 - 3 - In consideration of the premises, Purchaser agrees to pay monthly to City for all water passing through said main or mains and meter or meters at the rates established by the Council of the City of Portland from time to time . In the event that Purchaser has a water supply other than that furnished by City, and during any month does not use surplus water furnished by City, then in consideration of the standby service provided by City, and during all times when surplus water of City is not used by Purchaser through said main and meter, Purchaser agrees to pay monthly the standby charge of City at the rate established by the current water rate ordinance of City. Statements for surplus water used shall be computed and rendered monthly to Purchaser by City. Should the meter at any time fail to measure accurately the surplus water passing through said meter, the charge for surplus water used during tha time the meter is out of order shall be based on the estimated volume of surplus water supplied, as the City may determine by usage averages and statistics for prior periods. Payments for water shall be made by Purchaser to City on or before the 10th day of each month for surplus water used or standby charge for the previous month. Purchaser shall furnish within ten days after the end of each month to the Superintendent of the Bureau of Water Works a statement showing the number of cubic feet of water sold, and if Purchaser has another source of water supply, the quantity of water in cubic feet supplied for the previous month from the other source. It is further understood and agreed by and between the parties hereto that this agreement is conditional upon the satisfactory performance by Purchaser of all the terms and conditions hereof which on its part are to be performed, and upon any failure so to do, City shall have the right to terminate this contract and discontinue furnishing surplus water in accordance with the terms of this contract, but such termination shall be effective only after sixty (60) days written notice to Purchaser. Purchaser further agrees that if it desires to cease its purchase of City water, it will give to City sixty days written notice of such intention prior to disconnection.
