Resolution to hold special election on August 24, 1971 to obtain authoritX to issue $980,000 in general obligation bonds. Ken Baines has prepared a detailed resolution which will authorize a bond election. Copies are enclosed. Recommendation: Approve 4. Resolution to purchase 1972 3/4-ton pickup truck per bids, including trade-in of 1966 Chevrolet 1) ton pickup truck. Quotations have been requested from six different truck agencies repre- senting Chevrolet, Ford, and GMC. Recommendation: Award sale to lowest bidder 5. Resolution to transfer $25,500 from Capital Outlay to Material & Services in 1970-71 F7 budget report. The Auditor advised that an adjustment in accounts of the FY 70-71 budget report is necessary. This is a tecldcality and does not involve actual funds. Last year the overexpenditure of the Material & Services Account was due, primarily, to the inadequate amount budgeted to purchase water from Capitol Highway Water District. The transfer of funds in the budget will correct this. Recommendation: Approve -1- ADMINISTRATOR'S REPORT (Continued) 6. Resolution to absorb difference in cost between 6" or 8" and 12" pipe installations on S. W. 98th (Mormon Church) and S. W. Hunziker (Partex Corn.) a. The Mormon Church has agreed to pay for an 8" main for 850 feet along 98th Avenue, south of Sattler Road. This main will eventually serve the high school where a 12" main is required. TWD personnel will install the line. b. Partex Corporation is required to install two fire hydrants at their new plant located on Hunziker Road. 60 feet of 8" and 340 feet of 6" pipe are necessary. STdR's study indicates that this line will serve as an alter- nate route to the Baylor reservoirs and that a 12" main is needed. TWD personnel will install the line. Recommendation: Approve 7. Lawsuit against TWD The TWD, U. S. National Bank, and Orrin Forrest, as defendants, have been summoned to answer a complaint in U. S. District Court regarding the bonds allegedly stolen from the Prairie City Branch of the 1st National Bank. Peer- less Insurance Company of New Hampshire is the surety and has agreed to defend the District and to hold the District harmless against this claim. Ken Baines will be prepared to furnish up-to-date information on this lawsuit. 8. Employee self-improvement program Congratulations are in order to John Miller and George Beaudry upon being certified as Water Works Operator's II and III, respectively. This volunteer program is sponsored by the Oregon State Board of Health and the achievements represent considerable hard work and effort. It is indicative of the high caliber of persons working for the TWD. -2- ADMINISTRATOR'S REPORT (Continued). 9. Work performed by TWD personnel a. Installed 3000 feet of 8" cast iron pipe plus 3 fire hydrants along 79th Avenue to Durham Road. (Pipe extension program). The fire hydrant in— stalled at the corner of 79th and Durham Road was tested and flows 730 GPM. b. Installed 3/4" copper services to 17 new home sites for A. J. Paterson on 114th Place, south of Tigard Street. c. Installed 100 feet of 8" cast iron pipe plus a fire department con— nection on Hi Tor Drive in preparation for new reservoir construction. (Pipe extension program) d. Installed 850 feet of 12" cast iron pipe and 1 fire hydrant on 98th Avenue, south of Sattler Road, for proposed new Mormon Church. e. Weather permitting, on Saturday, August 7th, a 12" tee, solid sleeve, and 8" gate valve will be installed in transmission main, south of Coe Manu— facturing Company, for Georgia—Pacific Corporation. Arndt-Colt will install the 8" main to the site. TWD will receive 10for overhead and 8% for engi— neering fees. f. Installed 22 meters. 10. Work schedule for next few months August a. Install 200 feet of 8" cast iron pipe plus 1 fire hydrant on King James Avenue for Tualatin Development Company. b. Install 400 feet of 12" pipe plus 2 fire hydrants north of Hunziker Road for Partex Corporation. c. Install 1450 feet of 6" cast iron pipe and 1 fire hydrant on 110th Avenue, between Park and Fairhaven (Mira Court), for Mrs. Lee Miller and Mr. A. C. Edwards. d. Install 670 feet of 8" cast iron pipe and 1 fire hydrant along 121st Avenue, north of Dakota Street, for proposed new Tigard Evangelical Church. e. Install 410 feet of 6" cast iron pipe and 1 fire hydrant aloe 116th Avenue, between Tigard and Katherine Streets. (Pipe extension program -3- ADMINISTRATCBS RLPfRT (Continued), September a. Install 1160 feet of 8" cast iron pipe plus 2 fire hydrants along Fonner Street, between 115th and 121st Avenues. (Pipe replacement program) b. Install 200 feet of 6" cast iron pipe on Johnson Street, near 106th Avenue, to complete circulation loop. (Pipe extension program). c. In conjunction with Tualatin Development Company personnel install 1800 feet of 12" cast iron pipe along Fischer Road from 124th to 131st Avenues. Fire hydrants will also be installed. d. Install 1920 feet of 8" cast iron pipe and 300 feet of 6" cast iron pipe plus 3 fire hydrants along Pacific Highway, south of Fischer Road, for Tualatin Rural Fire Protection District and Mr. Wills. e. Install 830 feet of 6" cast iron pipe plus one fire hydrant along Bull Mountain Road, west of Pacific Highway, for the new Sirloin Restaurant to be constructed. f. Develop alternate source of water; and WHEREAS, it is necessary to obtain money on the credit of Tigard Water District to pay the cost of said additions and im- provements, and the bum of $980,000.00 is now needed therefor, and WHEREAS, the present unpaid bonded indebtedness of Tigard Water District as of July 1, 1971, is $782,000.00; and WHEREAS, the population of the Tigard Water District is in excess of 300 persons; and , . I have been advised that Merrill, Lynch, Pierce, Fenner & Smith, Inc. , intends to commence an action wherein the District will be named as a defendant regarding Tigard Water District Bonds No. B-90 through B-105, which bonds allegedly were stolen from the Prairie City Branch of the First National Bank of Oregon. Mr. Orrin Forest allegedly was the owner of the bonds at the time of li,,,,, their theft. Each of the bonds was in the face amount of $1,000, and Bonds No. B-90 through B-98, inclusive, will mature November 1, 1973, and Bonds No. B-99 through B-105, inclusive, on November 1, 1974 . Mr. Forest has delivered a lost-securities bond wherein the Dis- trict is the obligee and Peerless Insurance Company of the State of New Hampshire is the surety. The face amount of the bond is $22,697.50. Peerless Insurance Company has agreed to defend the District and to hold the District harmless against this claim. To my knowledge, there are no judgments against the District. You may wish to inquire of Mr. Robert E. Page 1 - COMPLAINT FOR DECLARATORY RELIEF 1 III. 2 On or about January, 1969, Defendant FORREST was the 3 owner of the following Bearer Bonds: 4 (1) Tigard Water District Bonds numbering B90 5 through B98; B100 through B10S; each bond 6 was in the face amount of $1,000.00. 7 Said bonds were deposited by Defendant FORREST in 8 the Prairie City Branch of the First National Bank of Oregon. 9 On or about January, 1969, said bonds were stolen from said 10 Bank in a robbery. 11 IV. 12 Subsequently Defendant TIGARD WATER DISTRICT as 13 issuer, executed duplicate bonds to Defendant FORREST. 14 V. 15 On or about February 10, 1970, Merrill Lynch, Pierce, 16Fenner & Smith, Inc. , a securities brokerage firm, purchased 17 said bonds through their Salt Lake City Branch from one LOREN 18 NORTON. Merrill Lynch, Pierce, Fenner & Smith, Inc. was 19 without knowledge that said bonds were stolen. On or about 20February 11, 1971, First National Bank of Oregon agreed to 21purchase said bonds from Merrill Lynch, but upon learning of 22the theft of said bonds, rescinded the sale and notified 23Merrill Lynch that the bonds were stolen. The certificates were awarded by the Water Works Operators Certification Committee of Oregon as the result of a great deal of individual study by each man and the successful completion of a written examination. Beaudry WWO III The certification program for Water Works Operators in Oregon is a voluntary program conducted by the Operators, Oregon State University, and the Oregon State Board of Health in conjunction with the short school program here at the University. Taylors Ferry Road Portland, Oregon 97223 Gentlemen: The Board of Commissioners, Tigard Water District, has agreed to a joint meeting with you to discuss matters of mutual interest provided an agenda is prepared with proper foundation. It appears now that two subjects could be discussed; namely: (1) the mutual use of the Baylor Street reservoirs, and 2) a joint venture for a Bull Run connection to the existing 24—inch main on Multnomah Boulevard. Specifically, the Board desires that Elden Carter, as our mutual con— sulting engineer, be prepared to provide facts and figures on the conse— quences of proposed changes or ventures. If computations on growth, re— quirements, and resources vary with the recently completed water study by Stevens, Thompson & Runyan then such differences should be fully justified Sege and explained. (Three copies of the study were delivered to your office). There has been much misunderstanding regarding the use of the Baylor Street reservoirs. Because of the floor level elevation of these reservoirs, the lower half of each tank is incapable of supplying other reservoirs in the system by gravity flow. However, the upper half of each tank (or 1—million gallons) performs as designed and is vital to our system. The lower half of each reservoir serves, essentially, as "legs", except in emergency situations when the remaining 1—million gallons are necessary to serve the lowlands of the district. Three years ago the construction of the second 1—million gal— lon tank was recommended by Elden Carter as essential to the Tigard Water District. There are no known significant events which have occurred that would change this requirement. The Board is particularly interested in developing an alternate source of water which will suffice to year 2000 and beyond. Capacity and pipe sizes should be planned within that time frame. Pacific Highway Tigard, Oregon 97223 Gentlemen: My letter of May 5, 1971 provided you with detailed information on the estimated cost and pipe line route for supplying water to Tigard High School. The installation of 3000 feet of 8-inch main along S. W. 79th Avenue to Durham Road has been completed by district personnel. The fire hydrant installed at that corner was tested and flows 730 gallons per minute. (static pressure = 140 psi; residual pressure = 34 psi). Officials at the Oregon Insurance Rating Bureau indicate that a class 7 rating is war- ranted if the following criteria are met: Structure area: 15,000 square feet or less Distance from fire hydrant: 500 feet or less Skov Flow rate: 600 gallons per minute or more It appears that Durham Grade School meets the minimum standards for a class 7 rating. Your insurance agents should be so notified. The pipe line route to the high school has been modified in accordance with a recommendation of the engineering firm of Stevens, Thompson & Runyan. This alternate course is independent of any other water districts or agencies. Again, there are three separate projects to accomplish the task, as follows: (1) 3400 feet of 12" main from reservoirs located at 104th and Canter- bury Lane to 98th and Settler Road. (2) 2200 feet of 12" main from 98th and Sattler Road to 98th and Durham Road. (3) 3450 feet of 12" main along Durham Road from 98th to Highway #217 plus late>rals behind the school. r' -2- Funds for the pipe installation of paragraph (1) above must he apeloved by the Tigard Water District customers as part of a bond issue No, election which is scheduled for August 24th. Authority to issue bonds totalling $980,000 will le requested. Construction project (2) above which is along 98th Avenue will be completed with the cooperation of adjacent property owners and the Tigard Water District. Installation of 850 feet of this line commenced yesterday with the proposed Mormon Church participating in the cost. You will notice that the length of pipe required for paragraph (3) above is identical to the former plan. Therefore, the previous cost estimate is still valid as far as the School District is concerned. It is suggested that only the 3450 feet of 12-inch pipe plus five hydrants along Durham Road be installed during this fiscal year and the laterals completed after July 1, 1972. Funding in this manner would reduce the burden on the School District during the present fiscal year. Your assistance is requested in supporting the bond election on August 24th. Projects planned from the bond issue will be of direct benefit to the School District and to the community. Enclosed is a memorandum which will be promulgated to the public. I would appreciate the names of any individuals who would support this worthwhile cause and who may desire to encourage others to vote. A public hearing will be held at 7:30 p.m., August 16th at the Fire Station in Tigard. We have made considerable progress since March when the urgent need for water at the high school became known.
