08/18/1938 - Special Meeting Minutes FOURTH REGULAR MEETING lorIA Regular Meeting August 18, 1938: The regular monthly meeting of the Board of Commissioners of Tigard Nater District, Washington County, Oregon, was held at the residence of Secretary G. M. Leslie, at 7°30 P.M., August 18, 1938. Present: Leslie, Vincent, Johnston, Lewis. Minutes of the regular meeting of July 21, 1938, and of the special meet- ing of August 12, 1938, read and approved. Seal: Ordered, that seal for the Tigard Nater District, as imprinted on the margin of this paragraph, is hereby adopted. Carried. Public Liability Policy: Ordered, that the Treasurer procure policy safe-guarding the Tigard eater District fully against damages to persons or to property arising by reason of the proposed construction of a water system. Carried. .. Hydrants: Mr. Bernard was present and offered the Board six fire hydrants, used for several years, and taken from the ground and kept in storage for the past sixteen years, for $26.50 each. Referred to C. E. Carter, Engineer. Mr. Carter stated that these hydrants were necessarily very much out-of- date, and that according to the description did not have the proper connec- tions, and that it would be poor economy to make a small saving by purchasing and installing them. Recommendation adopted. Bills--Payment between Meetings: Ordered, that the Chairman or Secretary and the 'reasurer are hereby authorized to audit and pay bills where necessary to save discounts, or for other seasons. J wr.w r- RESOLUTION providing for the issue of $40,000 bonds of Tigard Water District, Washington County, Oregon; fixing their interest, date, numbering, maturities, form of bond and coupon and place of payment; authorizing the execution, sale and delivery thereof; and declaring an emergency: WHEREAS, at a special election duly called and held for the purpose, on August 4, 1938, the legal voters of the District duly authorized this Board to issue bonds of the District in the sum of $40,000 to do all acts and things which may be requisite, necessary or convenient in carrying out the objects of the District for the purpose of supplying its inhabitants with water for domestic use. Said interest shall be payable semi-annually, on '"` January 1, and July 1, of each year, and shall be represented by ooupons attached bearing the facsimile signatures of said Officers. Both principal and interest shall be payable in lawful money of the United States of America, at The United States National Bank of Portland, Oregon. At said election said indebtedness and interest thereon was authorized by said eleotors to procure the necessary funds to enable said District to do all acts and things which may be requisite, necessary or convenient in carrying out the objects of said District, or exercising the powers conferred upon it by law, for the purpose of supplying its inhabitants with water for domestic, purposes. It is hereby certified that every requirement of law relating to the issue hereof has been duly complied with, and that this bond is within every debt and other limit presoribed by the Constitution or laws of Oregon. For the punctual payment of principal and. i=bwrest hereon the full faith and credit of Tigard Water District is hereby irrevocably pledged. Leslie, Secretary. law RESOLUTION Confirming Sale, and Authorizing Execution and Delivery of Forty Thousand Dollars, par value, of Bonds of Tigard Water'District: "WHEREAS, pursuant to authorization of the electors of Tigard Water District, Washington County, Oregon, at a special election on said question held on August 4, 1938, this Board has, by resolution of this date authorized the execution sale and delivery of forty thousand dollars general obligation bonds of Tigard 'Mater District, to be dated as of July 1, 1938, in denominations of $1000 each, numbered from 1 to 40, inclusive, mature in the order of their number- ing, $1000 on January 1, 1945 to 1954, inclusive, $2000 on January 1, 11955 to 1959, inclusive, $3000 on January 1, 1960 to 1964, inclusive, and $5000 on January 1, 1965, to bear interest on the first maturing $20,000, numbered 1 to 20, inolusive, at the rate of three and three-fourths per cent (3-3/4ths %) per annum, and on the last maturing $20,000, numbered 21 to 40, inclusive, at the rate of three and one-half per cent (3-102 %) per annum, as represented by interest coupons thereto attached, payable semi-annually on January 1 and July 1, each year, both principal and interest payable in lawful money of the United States of America, at The United States National Bank of Portland, Oregon; and," "WBEREAS, ATKINSON, JONES & CO., and BAKER, FORDYCE, TUCKER CO., have bid for said bonds $100.07 for each $100.00 par value of said bonds, and, in addition thereto the interest accrued to date of delivery, whioh bid is the highest and best offer obtained, and is the fair market value of said bonds, now, therefore," "BE IT RESOLVED, that said bonds are hereby sold to said ATKINSGN, JONES & CO., and BAKER, FORDYCE, TUCKER CO., upon the terms above set forth, and the officers of this Board are hereby authorized to execute and deliver said bonds to said purchaser upon payment for the account of Tigard Water District of said purchase price." Lewis, Chairman, G. M. Leslie, Secretary. Truck for °DTPA work: C. E. Carter, Engineer, reported that the truck used by ' Collins Water District in its DTPA work just finished, that cost Collins 445.00, plus cost of box and pipe rack, plus insurance, of which seven months yet re- * mained, could be purchased for 425.00, and asked for any suggestions as to other trucks to be had. Ordered, that Isar. Carter is authorized to look over the truck field, and if he finds no better purchase, to close the deal for the Collins truck. Carried. buildings: C. E. Carter, Engineer, was authorized to rent Stedman's Machine Shop, at 45.00 per month, Mr. Stedman to put on a new roof, for storing materials for project, and to rent space of Tigard' Lumber Company, for mapping crew. Carried. Changes: C. E. Carter, Engineer, recommended change of about 10,000 feet of pipe from 2" to 3", at an additional cost of about 41,000; and change from galvan- ized pipe to copper tubing, at a cost of about 4500. Adopted. Installation of Service Connections: Ordered, that service connections be placed at the following prices and termsi: Services ordered during '/PA construction: Price, 420.00 Terms: 45.00 with application, and 42.00 per month. Services ordered after present N. P. A. project completed: Price, 430.00 Terms: 45.00 with application, and 43.00 per month. All new services installed to remain the property of the District, and to be repaired, replaced, relocated, lowered and maintained at the expense of the District, except where damaged thru fault of the user, or thru his neglect. All present services transferred to be taken over by the District, if the user so desired, under the same conditions of maintenance, etc. All present services the ownership of which was retained by the user to be repaired, replaced, relocated, etc, by the District, at the expense of the user.
