Minutes of November 8, 2004 meeting
Members present: Mr. Tinnin, Mr. Cancelosi, Mrs. Gillis

Citizens Present: Marti Stiven, Craig Brown, John Frewing
1. Meeting was called to order at 6:30 P.M.
2. Minutes from October meeting approved.
3. City updates:
a. Dick Bewersdorff spoke briefly about Measure 37.
4. Chapter 18 of Tigard Municipal Code discussion. The Tree Board will
present the following points for discussion to City Council at the November
16th meeting:
a. Give credit to developers for retaining trees that have diameters
when measured at four feet between 6 and 12 inches. This credit
can be applied to tree mitigation requirements as long as the trees
receive adequate and proper protection during construction and
land clearing, they are healthy and in good form.
b. Fines for tree-related infractions. The code should require the
negligent party to pay all fines in addition to all costs related to
collecting those fines.
c. Fee-in-lieu for tree mitigation requirements. Allow the developers
to pay fee-in-lieu costs at rates quoted by qualified landscaping/tree
planting organizations to plant the necessary amount of trees
required to satisfy the tree mitigation obligations.
d. Tree protection measures. Hold developers more accountable if
and when tree protection measures are moved or modified without
the approval of the project arborist and/or the City Forester. An
unbiased third party is hired by the city, but paid for by the
developer, to assess the impacts and recommend a course of
action to remedy the tree protection infractions. The third party
must be an International Society of Arboriculture Certified Arborist
as well as a member of the American Society of Consulting
Arborists.
e. Encourage creative solutions for building and developing around
trees.
