BOARD of COMMISSIONERS MEETING

1. Call to Order, Roll Call and Introductions
Commissioner George Rhine called the meeting to order at 7:02 p.m.
2. Approval of Minutes — June 27, 2005
Commissioner Janet Zeider motioned to approve the minutes, Commissioner Marc
Delphine seconded the motion, and the minutes were unanimously approved.

4. Oath of Office for Board Members

The elected individuals, George Rhine and Charles Radley, were duly sworn in and
administered the oath of office to perform the duties of Commissioner on the Tigard
Water District (TWD) Board of Commissioners.
5. Election of Officers
• Chair and Vice Chair
• IWB Representative and Alternate
Commissioner Delphine motioned to elect Commissioner Rhine as Chair of the TWD,
Commissioner Zeider seconded the motion and the board voted unanimously to elect
Commissioner George Rhine as the Chair.
Commissioner Rhine motioned to elect Commissioner Delphine as Vice Chair,
Commissioner Zeider seconded the motion and the board voted unanimously to elect
Commissioner Marc Delphine as Vice Chair of the TWD.
Commissioner Zeider motioned to elect Commissioner Charles Radley as the
Intergovernmental Water Board (IWB) representative, however he declined the

nomination stating he was unable to serve in that capacity due to his work schedule.
Commissioner Delphine motioned to elect Commissioner Beverly Froude as the IWB
Representative, Commissioner Rhine seconded the motion and the board voted
unanimously to elect Commissioner Beverly Froude as IWB Representative.
Commissioner Delphine motioned to elect Commissioner Zeider as the Alternate IWB
Representative, Commissioner Rhine seconded the motion and the board voted
unanimously to elect Commissioner Zeider as IWB Alternate Representative.
Newly elected officers are as follows:

• IWB Representative - Commissioner Beverly Froude
• IWB Alternate Representative - Commissioner Janet Zeider
8. Discussion to Provide Water Related Educational Information to Citizens
(Change in order of agenda item.)
Commissioner Marc Delphine and Wynne Wakkila have been attempting to discuss
ways to notify and produce dissemination of information to the public about the
Willamette River.
Dennis Koellermeier questioned the type of information and whether the TWD wanted
to provide it to just TWD customers or join with the IWB to provide educational
information items to all Tigard Water Service customers. The information could be
sent with the billing cycles and/or through direct mailings. Direct mailings would be to
the actual addresses, not just the billing person.
Henrietta Cochran said she would like to serve on the educational committee also.
She has been attending Sherwood meetings and they have been publishing
informational items to educate their citizens. She was interested in researching more
items and how to get the information. Mr. Koellermeier informed the board that
information was available from the Joint Water Commission (JWC), City of Portland,
Willamette River Water Coalition (WRWC), etc.
The board felt that the key word was education. They concurred that the information
should not contain a lot of technical information, but be simple, concise and to the
point, then build on that information in future.
Commissioner Radley commented that they might want to find out how the City of
Wilsonville educated their citizens.
Mr. Koellermeier said that if the goal was to reach all citizens, the IWB should be the
deciding factor for information distributed.

There was interest on the part of the board to arrange for tours of the treatment plant
in Wilsonville that could be made available to interested citizens. Mr. Koellermeier
said he could arrange for tours in the fall; he also counseled the board to focus on
water education specifically and not word anything toward a specific campaign issue.
6. Water Supply Update — Dennis Koellermeier
Last week Tigard used 11.16 mgd of water.
Lona term sources — Portland negotiation results should go public in late August or
early September. The wholesale agencies have requested that Portland present the
contract to their contingency before the wholesalers make their presentations as they
expect Portland to make more changes.
JWC — The partners need to make a decision soon to stay in the dam raise project or
to walk away. There is a concern about acquired assets and what to do with them if
the partnerships change or the projects do not proceed. The cost will be $500,000 for
Tigard for the next phase of the project. It still appears that the project will be
approved to proceed. The 40 ft. dam raise would impact about a dozen property
owners; only one would lose their home while others would have closer waterfront
property.
Lake Oswego —A draft feasibility study is expected very soon and will be distributed to
board members when it is available.
7. IWB Update— Janet Zeider
Commissioner Zeider reported that Marc Delphine was at the meeting and
approached the board with how to start moving to the Willamette River. They
suggested waiting to gather more information.
Mr. Koellermeier reported on another item he brought up to the IWB about Sherwood's
focus on the Wilsonville Treatment Plant and that other members of the WRWC would
have 90 days to decide about joining in the membership because of Sherwood's
decision to participate. Sherwood will become a partner with 5 mgd with Wilsonville,
which is not enough to entirely meet Sherwood's and Tigard's needs for treatment
plant interests. Mr. Koellermeier should be able to get a legal opinion by the next IWB
meeting.
Mr. Koellermeier explained that there are problems in mixing some sources; it is better
to get most of the water from one source and still have secondary sources. The
agreement needs to make financial sense too.
Commissioner Rhine said that Tigard is working toward acquiring an ownership in
water rights, not just the source. Portland will not allow other agencies to acquire
water ownership rights; they just want wholesalers.

Commissioner Radley asked about the minimum purchase penalty fee issue with
Portland and Mr. Koellermeier said that steps have been made to avoid that. The
agreement is a take water or pay type contract, but the accounting aspect has been
worked on for the past year.
