APPROVED the above request. The findings and conclusions on which the decision is based are noted in
Section IV.

SECTION III. BACKGROUND INFORMATION
Site Information:
The project is located at 7374 SW Durham Road (WCTM 2S113AB, Tax Lot 1400), at the southwest
intersection of SW Upper Boones Ferry Road and SW Durham Road.The 5.38-acre site is made up of one
(1) tax lot, and contains two (2) existing buildings, with associated parking and landscaping. The site is
zoned Industrial Park (I-P), as are adjacent properties to the north,south, and east.Adjacent properties to
the west are under the jurisdiction of the City of Durham.
SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS
18.765 Modifications:
18.765.060 Minor Modifications
A. Definition.A minor modification has the following characteristics:
1. It has minimal impacts on surrounding properties,sensitive lands, or public facilities;and
The applicant proposes to install a new overhead door on the southeast side of an existing building
located at 7374 SW Durham Road(WCTM 2S113AB,Tax Lot 1400).The applicant also proposes to install
a new retaining wall near the location of the new overhead door,and to adjust the grade of the existing on-
site drive aisle to accommodate this retaining wall. Approximately 210 square feet of on-site landscaping
will be removed as a result of this proposal. No changes to the existing building footprint or parking lot are
proposed.
The subject site is located in the I-P Zone, which has a minimum landscape requirement of 25 percent
(CDC Table 18.330.1). The applicant submitted landscaping calculations which confirm that even with
the proposed removal of 210 square feet of landscaping, the site will continue to meet the minimum
landscape requirement,with 25.57 percent remaining.Additionally,the applicant's materials demonstrate
that the remaining landscaping complies with the L-2 standard in CDC Table 18.420.1 because hardscape
areas (such as paths) do not cover more than 25 percent of the total required landscape area.
The applicant did not submit detail drawings for the new retaining wall or the modified drive aisle.
Accordingly, staff will review the applicant's plans at the time of building permit submittal to confirm the
retaining wall complies with the applicable wall standards in CDC 18.310.020,and that the drive aisle will
be paved with a dust-free, hard-surfaced material (CDC 18.920.030.E). The applicant only proposes to
modify the drive aisle's grade, and does not propose to modify the drive aisle's existing width or
configuration.
As demonstrated in the findings above, the applicant's proposal complies with all applicable
nonresidential development standards,as well as the applicable standards for landscaping and for access,
egress, and circulation. Accordingly, staff finds this proposal will have minimal impacts on surrounding
properties, sensitive lands, or public facilities, and meets the definition of a minor modification.
2. It does not cause the development to go out of conformance with any applicable standard
or further out of conformance if already nonconforming, except where an adjustment has
been approved.
As demonstrated in the findings above, the applicant's proposal complies with all applicable
nonresidential development standards, as well as the applicable standards for landscaping and for access,
egress, and circulation. Accordingly, this proposal does not cause the development to go out of
conformance with any applicable standard.

D. Approval criteria. The approval authority will approve or approve with conditions a minor
modification application when all of the following criteria are met:
1. The proposed modification qualifies as a minor modification as defined in Subsection
18.765.060.A;
As demonstrated in the findings above, this proposal qualifies as a minor modification as defined in CDC
18.765.060.A.This criterion is met.
2. If the proposal involves the modification of a condition of approval, at least one of the
following criteria is met:
a. The condition cannot be implemented for reasons outside the control of the applicant
or property owner;
b. The condition is no longer needed or warranted because circumstances have changed;
or
c. A new or modified condition better accomplishes the purpose of the original condition.
The applicant is not proposing to modify a condition of approval This criterion does not apply.
CONCLUSION: This proposalqualifies as a minor modification to an existingdevelopment, as

defined in CDC 18.765.060.A, and is in compliance with all applicable standards
of this Title.
