DESIGNATION: C-G: General Commercial Zone. The C-G zone is designed to accommodate a
full range of retail, office, and civic uses with a citywide and even regional trade
area. Except where nonconforming, residential uses are limited to mixed-use
developments. A wide range of uses, including but not limited to adult
entertainment, automotive equipment repair and storage, mini-warehouses,
utilities, heliports, medical centers, major event entertainment, and gasoline
stations,are allowed conditionally.

Notice is hereby given that the City of Tigard Community Development Director's designee has
APPROVED the above request.The findings and conclusions on which the decision is based are noted in
Section IV.

SECTION III. BACKGROUND INFORMATION
Site Information:
The subject site is located at 13050 SW Pacific Highway (WCTM 2S102CB,Tax Lots 2600 and 2700), at
the southwest intersection of SW Pacific Highway and SW Frewing Street. The subject building is an
existing eating and drinking establishment (Sanchez Taqueria), which currently encroaches over the
property line between Tax Lots 2600 and 2700. In January 2021, a Code Enforcement Case was opened
for the subject site because two (2) patio covers had been constructed without land use approval or
building permits (Case No. DCC2021-00004). Accordingly, the applicant has applied for this minor
modification in order to obtain land use approval for these two (2) structures. The subject site is zoned
General Commercial (C-G). The rear portion of Tax Lot 2600 is partially occupied by a Tigard locally
significant wetland, stream, and Clean Water Services vegetated corridor;however, the scope of work is
located outside of these sensitive lands.
SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS
18.765 Modifications:
18.765.060 Minor Modifications
A. Definition.A minor modification has the following characteristics:
1. It has minimal impacts on surrounding properties,sensitive lands,or public facilities;and
The applicant requests land use approval for two (2) covered patio structures at 13050 SW Pacific
Highway(WCTM 2S102CB,Tax Lots 2600 and 2700). One (1) structure is attached to the front entrance
of the subject building,and one (1) structure is located over an existing outdoor dining area,directly east
of the front entrance.The two (2) structures are located on existing paved areas;therefore,the applicant's
proposal will not impact the site's existing lot coverage or landscaped areas. Additionally, the structures
will not impact the existing on-site parking lot.
The subject site is located in the C-G Zone,and minimum setbacks are zero feet for the front, side,and
street side. The lot located behind Tax Lot 2600 is zoned Medium-Density Residential(R-12);therefore,
the rear setback for Tax Lot 2600 is 20 feet (CDC Table 18.320.1, Footnote 3). The lot located behind
Tax Lot 2700 is also zoned C-G; therefore, the rear setback is zero feet (CDC Table 18.320.1). Staff
conducted a site visit on February 8, 2021,and reviewed city maps to confirm that the two (2) structures
comply with all minimum setbacks. City maps also indicate that the existing building encroaches over the
property line between Tax Lots 2600 and 2700. However, the new structures will not cause the building
to encroach further west over this property line, and will therefore not cause the building to go further
out of conformance with any applicable development standard. Accordingly, staff finds the applicant's
proposal is approvable.
The applicant did not submit scaled elevation drawings with this proposal. However, staff was able to
confirm that the structures do not exceed the maximum height of 45 feet during the site visit.
Additionally, staff will confirm compliance with this standard by reviewing the applicant's plans at the
time of building permits submittal.
As demonstrated in the findings above,the applicant's proposal complies with all applicable commercial
zone development standards. Accordingly, staff finds this proposal will have minimal impacts on
surrounding properties, sensitive lands, or public facilities, and meets the definition of a minor
modification.
2. It does not cause the development to go out of conformance with any applicable standard
or further out of conformance if already nonconforming, except where an adjustment has

been approved.
As demonstrated in the findings above, the applicant's proposal complies with all applicable commercial
zone development standards. Accordingly, this proposal does not cause the development to go out of
conformance with any applicable standard.
D. Approval criteria. The approval authority will approve or approve with conditions a minor
modification application when all of the following criteria are met:
1. The proposed modification qualifies as a minor modification as defined in Subsection
18.765.060.A;
As demonstrated in the findings above, this proposal qualifies as a minor modification as defined in CDC
18.765.060.A.This criterion is met.
2. If the proposal involves the modification of a condition of approval, at least one of the
following criteria is met:
a. The condition cannot be implemented for reasons outside the control of the applicant
or property owner;
b. The condition is no longer needed or warranted because circumstances have changed;
or
c. A new or modified condition better accomplishes the purpose of the original condition.
The applicant is not proposing to modify a condition of approval.This criterion does not apply.
CONCLUSION: This proposal qualifies as a minor modification to an existing development, as
defined in CDC 18.765.060.A, and is in compliance with all applicable standards
of this Title.

AND BECOMES EFFECTIVE ON FEBRUARY 17, 2021.

The proposed Minor Modification is for a structure (awning) at the main entrance of the
building located at 13050 SW Pacific Hwy Tigard, OR 97223 (Sanchez Taqueria).
This structure was added as a means to encourage social distancing given the current situations
local businesses are facing. We are monitoring our capacity and social distancing requirements
and when necessary asking customers to wait outside for their turn to come in. With weather
not always on our side, this covered area encourages customers to patron our business as we
are doing our best to keep them comfortable. We originally had temporary tents at the
entrance. However, we assessed the situation and found that potentially hazardous and opted
for a firm structure instead.
Attached to our application you will find what we believe are all the necessary documents to
outline and describe the project. Our landlord has provided their property returns and a copy of
their site plan as supplemental information.
This modification to the building does not affect any surrounding business, detract from the
purpose of our business or seem to cause any hazards. Sidewalks and entrances have been
respected; pedestrian access remains the same. No modifications were made to landscaping
and/or utilities.
This awning is something we hope to keep. As it appears, we are going to have to continue to
enforce social distancing and such for time to come. While it may be a minor modification we
have made, we have seen it come in handy and has encouraged safe distancing.
The awning was built by J Guadalupe and his friend who put together the sketches of the
design.

Ken, we received the letter with DCC2021-00004 compliance issue for the building my wife owns at 13050 SW Pacific
Hwy. The tenant, (Sanchez) had notified us that they were going to erect structures to create outdoor dining due to the
COVID rules, and that they need to seat people outside. We are trying to support them any way we can because they
are dealing with the greatest challenge to restaurants in our lifetimes.The temporary structures they have placed seem
to be allowing them to operate, and I was under the impression that it was allowed activity for the temporary time.
Upon getting a call from Sanchez that they would be required to get a permit,we provided them with the information
they needed. I have spoken with Stacy Sanchez a couple times and provided her with information she needed to
submit an application for the permit. I believe that they will act in good faith to comply with your requirements, and I
hope you will allow some grace due to unprecedented challenges that face businesses like Sanchez to operate. The fact
that the building department is not even open to answer their questions in person is one more reason to allow for grace.
It is a difficult time. I am a contractor,when I visited the site a couple weeks ago I was impressed with the fact that they
had brackets and hold downs and it looked so much safer than the tarps and tents I have seen at other restaurants. I
understand that safety is important. I hope this matter is resolved with the effort they have made to obtain a permit.
