APPLICATION SUMMARY FILE NAME: JACKSONS STORE NO. 519 CASE NO.: Downtown Design Review(DDR) Compliance Letter DDR2019-00002 PROPOSAL: The applicant is proposing modifications to an existing Jacksons gas station and convenience store at 11834 SW Pacific Highway. The proposal includes modifying the existing grade, relocation of a retaining wall, and adding approximately 900 square feet of additional parking area. Attn: Charles Moseley 18215 72nd Ave South Kent,WA 98032 OWNER: PacWest Energy,LLC 3450 E Commercial Court Meridian,ID 83642 LOCATION: 11834 SW Pacific Highway;WCTM 2S101BB,Tax Lot 00301 ZONING DESIGNATION: MU-CBD:Mixed-Use Central Business Zone.The MU-CBD zone is designed to provide a pedestrian friendly urban village in downtown Tigard.A wide variety of commercial,civic,employment,mixed-use,multifamily and attached single-family residences are permitted. In addition to the standards of this chapter, development within this zone is subject to the standards of Chapter 18.650. SUB-AREA: Highway 99W and Hall Boulevard Corridor.This sub-area is intended to create a "pulse-point" along the Highway 99W corridor. Located at the intersection of 99W and Hall Boulevard, the area has the high traffic and visibility to draw potential retail customers from the region. The area will accommodate higher levels of vehicular circulation,while maintaining a pedestrian scale at the ground- floor level of buildings. It would allow development of mixed-use and retail buildings that could vary in scale from 1-story retail-only buildings, to mixed-use buildings up to 45 feet tall with retail on the ground floor and residential or office uses above. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request,subject to certain conditions of approval.The findings and conclusions on which the decision is based are noted in Section IV. CONDITIONS OF APPROVAL THE FOLLOWING CONDITIONS MUST BE SATISFIED: Unless noted otherwise, the staff contact is Agnes Lindor, Associate Planner, (503) 718-2429 or AgnesL@tigard-or.gov. 1. Prior to commencing any site work, the project arborist must perform a site inspection for tree protection measures,document compliance/non-compliance with the Urban Forestry Plan, and send written verification with a signature of approval directly to the project planner within one week of the site inspection. 2. Prior to commencing any site work, the applicant must provide a fee to cover the city's cost of collecting and processing the inventory data for the entire urban forestry plan (Urban Forestry Manual, Section 11,Part 3). This fee amount will be for 18 open grown trees and one tree stand. 3. Prior to commencing any site work, the applicant must provide a tree establishment bond that meets the requirements of the Urban Forestry Manual, Section 11,Part 2.This bond amount will be for one newly planted open grown tree total. 4. The project arborist must perform semimonthly (twice monthly) site inspections for tree protection measures during periods of active site development and construction, document compliance/non-compliance with the Urban Forestry Plan, and send written verification with a signature of approval directly to the project planner within one week of the site inspection. SECTION III. BACKGROUND INFORMATION Site Information: The subject property is located at 11834 SW Pacific Highway (WCTM 2S101BB, Tax Lot 00301); at the southeast intersection of SW Pacific Highway and SW Garden Place.The 1.34-acre site contains an existing gas station and convenience store,with associated parking and landscaping.The property is located in the Tigard Downtown Plan District,Mixed Use-Central Business Zone(MU-CBD),and the Highway 99W and Hall Boulevard Corridor Sub Area. Proposal: The applicant is proposing to modify the existing southwest parking lot that serves the gas station and convenience store. The modification includes removal of the existing retaining wall, fill of the sloped area to create a larger paved area and better configured parking, and construction of a new retaining wall at the edge of the reconfigured parking lot. The modification will result in a loss of one parking space, however, there will be a total of 14 spaces that will continue to serve the site. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS DDR2019-00002 Jackson Store No.519 PAGE 2 OF 5 18.650 Tigard Downtown Plan District 18.650.020 Applicability C. Design standards applicability. 2. Expansion, modification and site improvements to existing development: An addition, expansion, enlargement, modification, or site improvements associated with such lawfully preexisting uses and structures shall be allowed, provided the application for such proposed development moves toward compliance with the applicable development standards. Only those downtown building and site design standards applicable to the proposed expansion, modification or site improvements to the existing development shall be applicable. The applicant is proposing modifications to an existing Jacksons gas station and convenience store at 11834 SW Pacific Highway. The modification includes removal of the existing retaining wall, fill of the sloped area to create a larger paved area and better configured parking, and construction of a new retaining wall at the edge of the reconfigured parking lot. No changes to the building footprint are proposed. Because the applicant is proposing modifications to an existing development, only the building and site development and design standards that specifically apply to this project are addressed below. 18.650.030 Approval Process A. Types of downtown design review approval process.To achieve the purpose of the downtown site and building design standards, there are three tracks to apply for approval. Applicants, at their option, may choose to use Track 3 with the design review board. Applicants can address design review requirements through a combination of satisfying certain design standards, and in instances where they elect not to utilize design standards,satisfy applicable design objectives. In such a case, the public hearing and decision will focus on whether or not the development meets the requirements of the applicable design objectives only. 1. Track 1. The design compliance letter provides for a Type I review process, using the clear and objective design standards. It is intended for smaller building and site renovation projects that-meet the threshold of Subparagraph 18.650.030.B.1.a. The proposal meets the threshold criteria for a Track 1 design compliance letter. B. Procedures. 1. Track 1: Design review compliance letter using design standards. c. Approval Criteria. The approval authority will approve or approve with conditions an application when all of the following are met: tho applicable Building and Site Desig n standards for the development in Section 18.650.070 or the applicable Additional Standards in Section 18.650.080. The proposal only includes modification to the site, all of the standards in Section. 18.650.070 relate to the building and do not apply. The standards in Section 18.650.080 are addressed below. 18.650.080 Additional Standards Applications must conform to all applicable standards in the following chapters: A. Chapter 18.410, Off-Street Parking and Loading Requirements. B. Chapter 18.420, Landscaping and Screening. C. Chapter 18.435, Signs. D. Chapter 18.920,Access Egress, and Circulation. H. Chapter 18.930,Vision Clearance Areas. The only applicable chapter above is Chapter 18.420,because the proposal includes tree removal as part of modifying the parking lot.The proposal is required to meet the tree canopy standards provided below. 18.420.060 Tree Canopy Standards A. An urban forestry plan is required to demonstrate compliance with site and parking lot tree canopy standards and must meet the requirements of UFM Sections 10 through 13.An urban forestry plan must: 1. Be coordinated and approved by a project landscape architect or project arborist, i.e. a person that is both a certified arborist and tree risk assessor, except that land partitions may demonstrate compliance with effective tree canopy cover and soil volume requirements by planting street trees in open soil volumes only; The applicant submitted an urban forestry plan prepared by Jeff Varley; Barghausen Consulting Engineers, Inc, a landscape architect. This standard is met. 2. Demonstrate compliance with UFM tree preservation and removal site plan standards; A tree preservation and removal site plan that meets the standards set forth in the Urban Forestry Manual has been submitted. Eight trees on the site are proposed for removal.This standard is met. 3. Demonstrate compliance with UFM tree canopy and supplemental report standards and provide the minimum effective tree canopy cover; A tree canopy site plan that meets the standards set forth in the Urban Forestry Manual has been submitted. In addition,the project landscape architect has included a signature of approval and statement attesting that the tree canopy site plan meets all of the requirements in Section 10, Part 2 of the Urban Forestry Manual. This standard is met. A supplemental report was prepared and submitted by the project landscape architect, Jeff Varley; Barghausen Consulting Engineers, Inc.This report includes the required inventory data for existing open grown trees, as outlined in Section 10, Part 3, Subsection D of the Urban Forestry Manual. The site is zoned Mu-CBD;accordingly,the minimum required effective tree canopy for the entire site is 25 percent (Section 10, Part 3, Subsections N and 0 of the Urban Forestry Manual). The plan shows 17 preserved trees and one planted tree for a total canopy square footage of 9,848 square feet of canopy(34.3 percent), as provided below. This standard is met. Demonstrate compliance with parking lot tree canopy standards, where applicable, by providing the minimum effective tree canopy cover of 30 percent for all parking areas, including parking spaces and drive aisles. Only the percentage of tree canopy directly above parking areas may count toward meeting this standard; and The proposal includes modification to the existing parking, which increased the parking area by 991 square feet.The applicant shows that the modified area meets the 30 percent canopy standard by planting one Katsura,which provides 565 feet of canopy, or 57 percent. This standard is met. 5. Include street trees where right-of-way improvements are required by Chapter 18.910, Improvement Standards. The proposal does not require right-of-way improvements and street trees are not required.This standard does not apply. FINDING: The proposal complies with all applicable standards. SECTION V. From and after the Effective Date until March 3, 2023, or a market withdrawal by Grantor affecting the Premises, as defined by the Petroleum Marketing Practices Act, 15 U.S.C. § 2802(b)(2)(E), whichever is earlier ("Termination Date"), if motor fuel is stored, advertised or sold at or from the Premises,the motor fuel stored, advertised or sold shall be sold under the "Shell" trademark ("Brand Covenant"), all as more fully set forth in that certain Branding and Product Purchase Commitment Agreement dated as of the Effective Date, by and between Grantor and Grantee ("Branding Agreement"). The Brand Covenant and the remedies for breach thereof, as provided in the Branding Agreement, shall run with the land, and pass with each and every portion of the Premises, and shall apply to and bind the respective successors, assigns and transferees and subsequent owners in interest thereof. The Brand Covenant is imposed upon the entire Premises. Breach of the Brand Covenant shall not divest Grantee or any successor or assign of Grantee from title to the Premises. Unless the Premises is a "Released Premises" as defined in the Branding Agreement, Grantee agrees to include the Brand Covenant in any conveyance or assignment of the Premises to a successor grantee prior to the Termination Date and, as a condition of any conveyance of the Premises, to require successor grantees to enter into an agreement assuming all obligations of Grantee under the Branding Agreement. 2.
