PARCEL 'SB•: Together with a non-exclusive right of way
and easement for access road and for the installation of
trunk water lines and power lines, on, over and across
the Easterlymost twenty-five (25) feet of the South
901.38 feet of the following described tract:
Beginning at a point on the North line of the Southwest
Quarter of Section 10, T2S, R1W, W.M. , Washington
County, Oregon, 202.4 feet East of the quarter corner
on the West line of said Section 10; thence running
Easterly along the North line of said Southwest Quarter
a distance of 431.2 feet to the Northeast corner of the
tract conveyed to Louise Z. Bradford et al by deed re-
corded on Page 417, Book 408, Washington County, Oregon,
Deed Records; thence S 3°15 ' E along the Easterly line
of the said Bradford Tract 1051.38 feet to the center
of S. W. Beef Bend Road; thence S 47°45 ' W along the
southerly line of said Bradford Tract 3 .13 chains
(206.58 feet) ; thence continuing along said Southerly
line S 59°16' W 304. 1 feet to a point; thence N 3°15 ' W
1348.8 feet to the point of true beginning.
The premises and rights hereby conveyed to Grantee shall be
subject to the following uses, conditions, restrictions, reserva-
tions and obligations, to each of which the Grantee by accepting
this Deed does bind itself, its successors and assigns:

8 6 5 7 1. For the benefit of Grantors' remainder lands, of which
the above Parcels A and B heretofore constituted a part, any water
storage tank, pump house or structure other than fence structures
placed on Parcel A shall not protrude more than five (5) feet from
the natural surface of the ground along the north side thereof at
any point within said parcel for a period of twenty-five (25)
years from the date hereof.
2. Grantee shall construct a seven (7) foot high "cyclone"
type fence on the boundaries of Parcel A to enclose the same,
including entrance gate on the South boundary thereof, construction
of same to be completed within ninety (90) days from date of com-
pletion of construction of said water facility.
3. For the benefit of grantors' remainder lands, in the
event that Grantee shall construct a water supply well within the
granted premises and should the water supply in Grantors' existing
well be depleted or substantially reduced by construction of said
well or pumping therefrom by the Grantee, Grantors shall be
entitled to the installation of a meter by the District, and
there shall be no hook-up charge made, provided that Grantors
shall pay the cost of actual installation of such water line,
and the Grantors shall be entitled to free water service to
Grantors existing residence so long as same is personally occupied
by Grantors, or either of them.
4. For the benefit of Grantors' remainder lands, Grantee
shall install a fire hydrant of usual and customary size at or
near the north line of S. W. Beef Bend Road near the south boun-
dary of Parcel B.
5. For the benefit of Grantors' remainder lands, the Gran-
tee shall construct a roadway within Parcel B and shall improve
same for all weather use, including graveling thereof, and Grantors
in granting said easement reserve the right to use said easement
area for any purpose not unreasonably interfering with Grantee ' s
use thereof as an access road, and Grantors reserve the right to
grant equal but not greater rights to the use of said easement
area to any other person or parties of Grantors' selection,
including the right to grant the use thereof or to dedicate the
same for public road purposes in connection with the platting or
other development of the Grantors' remainder lands, provided that
Grantee shall not be required to maintain said road for the benefit
of any other than the Grantee and Grantors' personal use.
6. Grantee shall install a chain or other barrier at the
South extremity of Parcel B with a suitable lock and shall provide
Grantors with a key thereto, and said barrier shall be closed or
in place at all times other than when Grantee or its agents are
utilizing said right of way.

Gentlemen:
I am building the house adjacent to the west of your
water tank just off Beef-Bend Road. The Water District
has just completed fencing the area around the tank.
Pursuant to my request,they did not not fence a small
triangle of ground approximately 25 X 25 in th.e south-
west corner. It does not seem that this small parcel of
ground is of muchvalue to the Water District. Th.e
triangle, however, is beneficial to me for driveway
purposes.
I believe that now would be a good time to arrive at some
formal, written agreement as to the disposition of this
triangle of land. I would like to propose three options
for your consideration:
1. Would I be allowed to purchase this triangle from
the Water District.
2. Th.e Water Board grant me an easement for driveway
purposes over the southwest corner.
3. That I lease this parcel from th.e Water Board with.
adequate renewal options.
I told Jake Lorentz that I would maintain this triangle,
however, possibly in the near future I would like to have
the opportunity to pave over it, which in essence would
require approval in the form of an easement. This is the
main reason for this request.

Dear Mr. Baines:
I received the attached legal description from Robert E.
Santee, Administrator of the Tigard Water District, sug-
gesting that we change one of the dimensions on the
north-south line (3°15 ' vs 3°30 ' ) .
I have dismissed this with the surveyor and we will
agree with the attached legal description with one ex-
ceptions In the original description that I had mailed
to you, we referred to a distance of 130' running
"parallel " with the Tigard Water District 's east line.
In the attached description, you state "along the Tigard
Water District tract's (east) line"; the word "east"
should read "west' .
Thank you for your prompt attention in this matter.
