11/13/1956 - Minutes One Hundred Thirtieth Regular Meeting Tigard Water District Tigard Oregon November 13 , 1956 Present:- Leonard L.Nodland, President, C.E.Janoe, Sam Graham, A.J. Chavez Commissioners, J.P.Lohrenz Supt . The meeting was opened in the regular manner by the President. The minutes of the previous meeting and the corrected minutes of the October minutes were read and approved as read. Mr. Dresser a representive from Leonard Adams Insurance Company, of Beaverton, Oregon was given the floor. He explained about several ways to insure the Fire Hall. He suggested that a five year budget plan, where a sWnezr.° premimum is paid each year.Letters of quotation on insurance were read from George Penrose Tigard, Oregon, John Lindley Tigard, Oregon, Dooly and Co. of Portland, Oregon, and Leonard Adams. of Beaverton , Oregon. The above were subject to revision on account of the fact that the rate hasnot been set, by the Oregon Rating Bureau of Portland, Oregon. The matter of insurance was tabled until the rate has been established. A.J.Chavez moved and Sam Graham seconded that the Clerk write a letter to C.E.Wheelock Atty. to find out who is responsible for the insurence on the Fire Hall. Since the Fire Hall is leased by the Tigard Water District to the Tualatin Rural Fire District; Who by contract maintain and keep the building in repair, are responsible for the insurance. The Board wishes to get a reply from C.E.Wheelock Atty. in ten days. The motion carried. A motion was made by C.E.Janoe and seconded by Sam Graham, that the question of insurance on the Fire Hall be tabled until the next re- gular meeting of the Commissioners. The motion carried. The rules , rates , and regulations of the Tig< rd Water District were read, revised, compared with those of other districts, parts of theirs inserted, after which C.E.Janoe moved and A.J.Chavez seconded that the Superintendent prepare five typewritten copies of revised rules spaced two lines apart, and present them to the Board at the next regular meeting for study. The motion carried. A motion was made by C.E.Janoe and seconded by A.J.Chavez that the Supt. purchase the following office equipment:- 2 Steel desks, 2 Swivel chairs, 1 Desk lamp, 1 Typewriter desk, 1 Adding machine desk, and 7 Conference chairs. It is managed by its Board of Commissioners, elected by the qualified voters of the District, and serving without pay. The water supply and distribution syot em is the property of the people of the District. The supply is from 'Wells. This Board asks the coo-opera tI on of all patrons to6 insure prompt payment of rates, observance of rules, and protection of the system. Kindly notify the superintendent or any authorized person immediately of any leaky or defective condition. RULES, REGULATIONS AND RATES of the TIGARD WATER DISTRICT BE IT RESOLVED, by the Board of Commissioners, that the following rules, regulations, rates and charges for service, be, and they hereby are prescribed for the management of the water system of the Tigard Water District: Section 1. APPLICATION FOR SERVICE: No service will be supplied or water furnished to any premises except upon the written application of the legal owner of the premises, or his duly authorized agent, upon the printed forms of the District. Such owner shall be responsible for all charges for service to said premises, whether supplied to himself or to a renter or occupant thereof, and for the compliance of ``� any occupant with all rules of the District. Section 2. USE OF WATER: Water will be furnished for ordinary domestic , business and community purposes end fire protection, only. ' " Larger services will be installed upon payment in advance of a special fee, and upon special permit only. Section 4. SEPARATE CONNECTION: A separa e service Connection will be required for each dwelling, lace of business, institution , and premites served. All outlying building and premises used as a part of such dwelling, place of business, or institution may be served from such connection, as well as all buildings on such premises ( operated under the one management. No user shall furnish water to any family, business, institution or premises other than those '. occupied by himself. Provided, however, that the Board may permit a user to supply others through his service connection, in which event , such user will be charged an additional monthly minimum for each additional user so supplied. Such permit ingy be revoked and separate service connections required at any time. Section 5. MAINTENANCE OF CONNECTIONS: Each user must protect his service and the meter from damage from hot water, freezing, traffic, etc. Standard service connections will be maintained and replaced by the District, without cost to the user, except where user is at -''"" fault. Larger Services will be maintained and replaced at the cost of the user. Section 6. PRIVATE SERVICE PIPES: All pipes from the meter to the premises must be installed in accordance with good engineering practice, and maintained in good order by the user. Pipes must be laid 24 inches deep and provided with stop and waste for drainage, and all standpipes or fittings of any kind must be so located, anchored and installed as not to interfere with or endanger the meter. All pipes must be well protected from freezing. Before the pipe is covered the superintendent or authorized person must be notified that connection with the meter is desired, and, after this connection is made by the superintendent or authorized person the user should see that all joints between the meter and the premises are tight. Section 7. JURISDICTION: All service connections, meters, mains and parts of the system thru which water is served, except the pipes beyond the meter, are the property of the District, and under its exclusive control. No person other than the superintendent or authorized person shall install any service, make any extension, turn the water on or off, or otherwise tamper or interfere with the water or the system. Section $. WASTE--PLUMBING--INSPECTION: Water will not be furnished to premises where it is allowed to run to waste to prevent freeaing, or through defective plumbing, or otherwise. Plumbing should be of high test and first clans, and, where pressures may become heavy, a pressure regulator should be installed by the user to prevent damage to his plumbing. The District will not be re- sponsible for damage from varying pressures. The superintendent or authorized person may inspect pipes and plumbing at proper times. Now Section 9. READING--BILLING; Meters will be read on or about the 24th day of each calendar month, for the preceding month. Fif- teen days, or less, will be billed as a half-month. Over fifteen days will be billed as a full month. Section 10. PAYMENT--DELINQUENCY: All bills are due on the 10th day of the calendar month following service. They must be paid to the superintendent or authorized agency. Unpaid bills become de- linquent on end of such month. When a bill is not paid before it becomes delinquent, or a rule is violated, the water will be shut off and service discontinued until payment in full, tOz-X418=-wh as the expene of tur off and turn-on, and full compliance with all rules. If the water is turned on without authority, the service will be disconnected at the main, and a fee of five dollars made for the disconnection and reconnection.q Section 11. THE SUPERINTENDENT AND EMPLOYEES are not authorized to make any changes in these rules, or to extend the time of payment of bills. Section 12. RATES: The rates charged for water service per calendar month shall be as follows: Minimum ----/-?14, 7 /• 9$- First 600 Cu. Ft. 2.00 The next 400 Cu. Ft. .25 per 100 Cu. Ft. The next 5000 Cu. Ft. .20 per 100 Cu. Ft. All after 6000 Cu. Ft. .15 per 100 Cu. Ft. Section 13 . DISCONTINUANCE OF SERVICE for 20 days or more will be made upon written application, without charge, provided all bills are paid. ,//, Gt, �,e6 Section 14. Water may be turned on or off by the Superintendent or authorized person only. Amy Section 15 . INTERRUPTED SERVICE--CHANGES IN PRESSURE: The water may be shut off at any time for repairs or other necessary work without notice. Qonditions may cause a variation of the pressure. Section 15 - Continued The District will not be responsible for any damage caused by interruption of service or varying pressure. When service is interrupted hot water faucets should be kept closed to prevent Alaw backflow of hot water or steam. Damage to the meter by such back- flow will be charged to the user. Section 16 -- SERVICE CONNECTION MAINTENANCE: The Water District will maintain all standard service connections in good repair without expense to the users. Nach user is required to use reasonable care and diligence to protect the water meter and meter box from loss or damage by freezing, hot water, traffice hazards and other causes, in default of which, such user shall pay to the Water District the full amount of the resulting damage. Section 17. EXTENSIONS: All extensions of mains and laterals of the District shall be paid for by the person or persons desiring such extensions or their assigns, at cost plus ten per cent for overhead, supervision and engineering, and the estimated cost thereof, together with such ten per cent, shall be deposited with the District upon making application for such main extensions. Size of such extensions, kind of pipe, location, gates, fixtures, ' fire hydrants and other fittings shall be under District specifica- tions and subject to District approval, and such mains shall be laid from the end of the existing mains to the center of the property to be served. No lines or laterals shall be laid until the estimated • cost thereof, as hereinabove set forth, shall have been deposited with the District and all such extensions of mains and laterals, and installation of fire hydrants shall be the sole property of the District, without right of refund on the part of the person or persons paying %y.• for such extension or on the part of any person or persons whomsoever. No extension of main will be permitted, accepted or served by the District, as hereafter laid along any travelled street, unless such line be at least 2-inch O.D. pipe. NOTE: This section subject to Chapter 346, Oregon Laws 1951, and any amendments thereto. Section 1$. TEMPORARY OR TRANSIENT SERVICE: Temporary or transient service for construction work will be rendered upon de- posit in advance of connection charge and one month's estimated "` water bill, and payment on the first of each month of all accrued charges. Upon discontinuance of service, refund will be made for all connection materials usable by the District at their depreciated value, less the cost of removal and all charges due, but no tempo- rary service shall be installed for any residence or building where a permanent service connection may later be installed. Section 19. LIMITATION OF THE USE of water as to hours, purpose or manner, may be prescribed from time to time by the board. Section 20. FIRE HYDRANTS: Fire Hydrants will be installed by the Board, where suitable mains are available, upon the written application of the property owners sponsoring same, and the payment in advance of the estimated cost of the hydrant, fittings and install- ation, plus ten per cent for overhead. Section 21. METER OUT OF ORDER--TEST: If a meter shall fail to measure accurately, the charge shall be the average for the past six months. Tests will be made periodically without charge to the user. A user may demand a test, upon payment of X2.00 charge for such test. If the meter reads five per cent or more over, such charge shall be rebated to the user. Section 22. REPORTING LEAKS-REWARD: A reward of One Dollar will be paid to the person first reporting a leak in the District mains . Section 23 . AMENDMENTS--SPECIAL RULES--CONTRACTS: The Board may at any time amend, change or modify any rule, rate or charge, or make any special rule, rate or contract, and all water service is subject to such power. Section 24. GRIEVENCES: Any grievences as to service or complaint shall be reported to the Water Commissioners or Superintendent and Section 24. --Continued will be debated at the reular monthly meeting only.
