SECTION III. BACKGROUND INFORMATION
Site Information:
In 2015, the City of Tigard Planning Commission approved the Polygon at Roshak Ridge Planned
Development (Case No. PDR2015-00002) for 244 dwelling units, located at the northeast intersection of
SW Bull Mountain Road and SW Roy Rogers Road. The final plat was recorded in November 2018. The
subject property (16741 SW Darwin Loop;WCTM 2S107AA,Tax Lot 18000)was originally approved as Lot
180 of the Polygon at Roshak Ridge Planned Development. The applicant proposes to construct a new
single detached house on the subject property, and requests approval to utilize the garage as a temporary
sales office from July 1,2021 to April 30,2023.The site is located in the River Terrace Plan District and the
R-7 (Medium-Density Residential) Zone.
SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS
18.440 Temporary Uses:
18.440.030 Types of Temporary Uses
C. Temporary sales office or model home. This type of use includes a temporary sales office or
offices either in a dwelling unit or in another temporary building for the purpose of facilitating
the sale of real property in any subdivision or property within this city.This includes the use of
one dwelling unit in a subdivision as a "model home" for purposes of showing prospective
buyers.
The applicant proposes to construct a new single detached house on the subject property, and requests
approval to utilize the garage as a temporary sales office from July 1,2021 to April 30,2023.This proposal
meets the description outlined above, and this temporary use permit is being processed through a Type I
procedure.
18.440.050 Approval Criteria
C. Temporary sales office or model home. The approval authority will approve or approve with
conditions a temporary sales office or model home when all of the following are met:
1. Temporary sales office.
a. The temporary sales office must be located within the boundaries of the subdivision or
property in which the real property is to be sold;and
The applicant proposes to construct a new single detached house at 16741 SW Darwin Loop (WCTM
2S107AA, Tax Lot 18000), and requests approval to utilize the garage as a temporary sales office. The
subject property is Lot 180 of the approved Polygon at Roshak Ridge Planned Development (Case No.
PDR2015-00002), and the proposed temporary sales office is located within the boundaries of the
subdivision in which the real property is to be sold.This criterion is met.
b. Sales offices approved through the provision of this chapter may not be permanent.
The applicant requests approval for the temporary sales office from July 1, 2021 to April 30, 2023, and it
will not be permanent. This criterion is met.
18.640 River Terrace Plan District:
18.640.110 Temporary Sales Offices and Model Homes
One temporary sales office and one or more model homes may be located and used prior to final
plat approval when proposed in conjunction with a preliminary plat application for a subdivision.
Any such proposal will be processed using the approval process in Section 18.440.040 and the
approval criteria in Subsection 18.440.050.C, and it must comply with the provisions in this

section. If a temporary sales office or model home is not proposed in conjunction with a
preliminary plat application for a subdivision, one or both may be proposed at a later date in
compliance with Chapter 18.440,Temporary Uses.
The final plat for the Polygon at Roshak Ridge Planned Development (Case No. PDR2015-00002) was
recorded in November 2018, prior to submittal of this temporary use permit application. Accordingly,
the standards in this section do not apply to this application. Instead, this application is subject to the
standards in Chapter 18.440 Temporary Uses, as addressed in the findings above.

Below is the result of my review of the application materials submitted for the temporary sales office in the garage of
this dwelling.
• Building Permit Application—requires the following:
o Project valuation for the scope of work.
o Please complete the building permit application including project valuation and resubmit to
TigardBuildingPermits@tigard-or.gov.
• Mechanical Permit Application - requires the following:
o Project valuation for any additional mechanical equipment to condition the garage space.
o (2) sets of plans, including screening of any exterior equipment per development code requirements. If
you have questions, please contact the planner on duty at TigardPlannerOnDuty@tigard-or.gov.
o (2) copies of equipment cut sheets.
o Please complete the mechanical permit application including project valuation and resubmit along with
plans and cut sheets to TigardBuildingPermits@tigard-or.gov.

• Electrical Permit—does not require plan review:
o This permit is required for additional branch circuits for extra lighting, outlets, switches, mechanical
equipment, etc.
o This permit can be obtained online by a licensed electrical contractor at https://aca-
prod.accela.com/TIGARD/Welcome.aspx. This permit application will not be processed in-house and the
application submitted will be discarded.
• Plumbing Permit:
o This permit is required if you install additional plumbing fixtures for the sales office use in the
garage. There were no plumbing fixtures checked on the application submitted. Please complete the
application including fixture items to be added for use in the sales office and resubmit application to
TigardBuildingPermits@tgard-or.gov. Please let us know if there are no plumbing fixtures added to the
sales office and we will discard the application.
