I agree with you that it's the total square footage of the ADU that matters, regardless of whether it is new or converted
space. In both of your hypotheticals,the answer is no,they would not qualify, because they're both over 1,000 sq ft. In

the actual inquiry, no, I don't see how that would qualify either because the sq footage of the ADU is 1,688, which
exceeds the 1,000 in code.

Hello Shelby,
We need some clarification on allowed SDC exemptions for ADUs.
According to section 3.24.100.E Exemptions, it states that "Accessory dwelling units of 1,000 square feet or less that
comply with TMC 3.24.180(may not be used as a short-term rental for a period of 10 years)from city transportation and
park SDCs only."
The issue is how do we determine the square footage of an ADU that qualifies for the exemption, and here are some
examples:
• If an existing 3,000 sf dwelling converts 1,500 sf of existing space to an ADU, does this qualify for an exemption?
• If an existing 2,500 sf dwelling converts 500 sf of existing space to an ADU, plus constructs an addition of 600 sf
for the ADU, for a total of 1,100 sf of ADU, does this qualify for an exemption because the 'new addition space'
is under 1,000 sf?
For construction purposes, permit data, public record data, taxation, utilities, permit fee and SDC calculations, etc., I
believe that the total sum of the ADU should be counted, regardless if it was converted existing space or partial
converted space plus additional space.
According to Jared, the email below says the customer asked if the square footage mattered because it was using
existing space and the change in the home was just adding a second kitchen. Adding a second kitchen IS the criteria that
constitutes an ADU, so YES, whether it is existing space or newly added space,the space used for the ADU should be the
total sum that is used when determining if an exemption is allowed.
Our code language if very vague and we need a prompt resolution to this so that we can move forward with processing
current permits, editing customer information on website and updating code, as needed.

I too noticed the square footage excess.They asked if it mattered that the current home was being divided and no
additional square footage was to be added.The change in the home was to add a second kitchen.
I was unable to determine if that makes a difference (perhaps Shelby should weigh in on it) and this work has now
transitioned to Christine's group.

I am finishing review of this project and am following up on the exemption status. Did you receive these exemption
documents? I cannot confirm that I emailed them to you, and if that is the case, my sincere apologies.
In my review, I did notice that the square footage entered by the property owner on the exemption application reads
1,688 sf,which would not qualify for exemption per section 3.24.100.F, it states that ADUs of 1,000 square feet or less
may qualify for exemption from TSDC and park SDC. I have reviewed the construction plans and that figure seems to be
accurate.
Please advise.

I mis-counted the bedrooms in the main unit. There are 4 bedrooms in the existing dwelling unit and 2 bedrooms in the
ADU for 6 bedrooms total. This will change the SDC fee. I need information on how to complete the deed restriction for

however I have a couple of questions.
1. A copy of the SDC exemption application was included with the submittal package.
a. Did you send this to our finance department for review? I have copied Jared Isaksen in our finance

b. Has the document been recorded?

2. In order to determine the sanitary sewer SDC, we will need to know the total number of bedrooms combined for
the primary dwelling and the ADU.
Once we have this information, I will create the permit and notify you of the plan review submittal fee due.

Thank you for contacting us, however I believe there is some confusion as this project is not "only doing a few interior
modifications to the appliance package and adding kitchen cabinets" as you indicated in your email below. All
enforcement records, applications and plans submitted support that this is an accessory dwelling unit (ADU), and not
just "interior modifications".
History:
In May, 2020, code enforcement cases were created for development code and building code violations (DCC2020-
00032 and BCC2020-00005) for constructing a duplex or ADU, without land use approval and building permits
obtained. A parcel hold was applied and investigation fees were assessed for work without permits.
In June, 2020, an application for ADU was submitted for land use approval (ADU2020-00005). The ADU was approved by
planning on 6/17/2020, and a new address of 14303 SW 114th Ave for the ADU dwelling was assigned.
On 12/30/2020, building permit applications and plans were submitted to convert 1,688 sf of existing dwelling space to
an ADU. The applicant submitted an application for exemption of payment for some systems development charges
(SDCs) on 12/30/2020, however the square footage listed on the application was 1,688 sf, which exceeds the 1,000 sf
exemption criteria, therefore the exemption is not approved and the Tigard transportation and parks SDCs in the
amount of$11,223 must be paid with all other SDC and permit fees prior to permit issuance and to be in compliance
with code enforcement.
I have attached invoices showing the balance due for building and sewer permits. Please email the permit technicians
at TigardBuildingPermits@tigard-or.gov as soon as the fees are paid so that they can issue the permits and make them
available for pick up.

This address 14305 had a Parcel hold and stop work order for converting living space to a attached ADU. It appears
planning approved the adu and apparently a new address 14303 was issued. Electricians have pulled a permit and
scheduled a final inspection on line under the new address for wiring in the new adu but we have no structural permit\
for the creation of the adu with fire separation requirements. Chip can let me know if we want to do inspections for the)
adu with no master permit.

A stop work order was posted on site. The residence has been converted to 2 separate living spaces with separate
exterior entrances, one side has just been rented.The separated unit is being set up with a separate kitchen and laundry
