THIS APPROVAL IS VALID FROM DECEMBER 23,2020 TO DECEMBER 23,2021. TUP2020-00012 Foran Hills 1 SECTION III. BACKGROUND INFORMATION Site Information: The subject property (13108 SW Foran Hills Court;WCTM 2S109AC,Tax Lot 2200)was originally approved as Lot 14 of the Foran Hills Subdivision in January 2018 (Case No. SUB2017-00005). This approval was for a 15-lot subdivision for single detached houses,with a street extension(SW Foran Terrace) connecting to SW Bull Mountain Road,and a new public street with a cul-de-sac (SW Foran Hills Court). The final plat has not yet been recorded at the time of this land use application. The applicant is requesting approval to utilize the subject site for a temporary sales office and a model home. The subject property is zoned Medium-Density Residential (R-7). SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS 18.440 Temporary Uses: 18.440.030 Types of Temporary Uses C. Temporary sales office or model home. This type of use includes a temporary sales office or offices either in a dwelling unit or in another temporary building for the purpose of facilitating the sale of real property in any subdivision or property within this city.This includes the use of one dwelling unit in a subdivision as a "model home" for purposes of showing prospective buyers. The applicant proposes to construct a new single detached house on the subject property, and is requesting approval to utilize this dwelling unit as a temporary sales office and as a model home. This proposal meets the description outlined above,and this temporary use permit is being processed through a Type I procedure. 18.440.050 Approval Criteria C. Temporary sales office or model home. The approval authority will approve or approve with conditions a temporary sales office or model home when all of the following are met 1. Temporary sales office. a. The temporary sales office must be located within the boundaries of the subdivision or property in which the real property is to be sold;and The applicant proposes to construct a new single detached on the subject property, and is requesting approval to utilize this dwelling unit as a temporary sales office.The subject property is Lot 14 of the Foran Hills Subdivision (Case No. SUB2017-00005), and the proposed temporary sales office is located within the boundaries of the subdivision in which the real property is to be sold. This criterion is met. b. Sales offices approved through the provision of this chapter may not be permanent. The proposal is for a temporary sales office.This approval is valid for a period of one(1)year.This criterion is met. 2. Model home. a. The model home must be located within the boundaries of the subdivision or property where the real property to be sold is situated;and The applicant proposes to construct a new single detached house on the subject property,and is requesting approval to utilize this dwelling unit as a model home. The subject property is Lot 14 of the Foran Hills Subdivision (Case No. SUB2017-00005), and the proposed temporary sales office is located within the boundaries of the subdivision in which the real property is to be sold.This criterion is met. TUP2020-00012 Foran Hills 2 b. The property to be used for a model house must be a permanently designed dwelling unit. The applicant's submitted site plan shows that the model home will be a permanently designed dwelling unit,i.e. a single detached house.This criterion is met. SECTION V.
