SECTION III. BACKGROUND INFORMATION
Site Information:
The proposed temporary use will be located in the parking lot at Washington Square Mall (9585 SW
Washington Square Road;WCTM 1S126, Tax Lot 300); south of SW Hall Boulevard, east of Highway
217, and west of SW Greenburg Road. The property is located on a 46.24-acre tax lot (WCTM 1S126,
Tax Lot 300),and is part of the larger Washington Square shopping center.The property is located in the
Mixed Use Commercial (MUC) Zone, and the Washington Square Regional Center Plan District.
SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS
18.440 Temporary Uses:
18.440.030 Types of Temporary Uses
A. Seasonal or special event.This type of temporary use is a use that by its nature will last less than
one year. Examples of this type of use are those associated with the sale of goods for a specific
holiday,activity,or celebration,uses associated with construction,or seasonal use.This type of
use does not apply to businesses seeking a temporary or interim location. These types of
temporary uses include:
3. Use associated with festivals or celebrations or special events;
The proposed temporary use is associated with the sale of goods for a specific activity; therefore, this
proposal meets the description of a special event. This temporary use permit is being processed through a
Type I procedure.
18.440.050 Approval Criteria
A. Seasonal and special events. The approval authority will approve or approve with conditions
seasonal and special events when all of the following are met:
1. The use occurs only once in a calendar year and for no longer a period than 30 consecutive
days,except as provided in Paragraph 18.440.050.A.6;
The proposed temporary sales event will take place only once this calendar year. Additionally, the use will
occur between July 15, 2020 and August 13, 2020, which is a period less than 30 consecutive days. This
criterion is met.
2. The use is allowed in the applicable base zone;
This proposal is for sales-oriented retail use,which is allowed in the MUC Zone.This criterion is met
3. The applicant has proof of the property owner's permission to place the use on the property;
This application included the property owner's written authorization.This criterion is met.
4. There will be no parking utilized by the customers and employees of the temporary use that
is required to meet the minimum parking requirements for the other uses on the property,
as required by Chapter 18.410,Off-Street Parking and Loading;
In February 2019, the City of Tigard Planning Division determined that the minimum off-street parking
requirement for all existing uses at the Washington Square shopping center was 4,268 spaces (Case No.
MMD2019-00003).Additionally,city staff determined there was adequate parking at the shopping center,
with 7,005 spaces provided. No subsequent modifications have been made to the subject site that would
impact vehicle parking calculations.

The proposed temporary sales event requires two (2) parking spaces (3.0 spaces for every 1,000 square
feet of floor area for a sales-oriented retail use),and the proposed tent and 26-foot refrigerated truck will
occupy an additional 18 spaces in the parking lot.Accordingly,the new total minimum off-street parking
requirement for the shopping center is 4,270 spaces,and there is adequate parking provided on site,with
6,987 spaces remaining.This criterion is met.
5. The use will provide adequate vision clearance, as required by Chapter 18.930, Vision
Clearance Areas,and not obstruct pedestrian access on public rights-of-way.
The applicant's site plan demonstrates that vision clearance would not be adversely impacted by the
proposed temporary sales event, which will not be located within any public right-of-way. Additionally,
this temporary use will not obstruct pedestrian access. This criterion is met.

AND BECOMES EFFECTIVE ON JULY 14, 2020.

Homestead Steaks, LLC event at Washington Square Mall
We will have a 20 x 20 tent and a 26 ft reefer truck to keep product frozen. We will be selling
prepackaged frozen USDA food, Our truck's temperature is controlled and monitored by a built
in thermometer. We will take up approximately 10-12 parking spaces. Due to us being in a
parking lot, there will be plenty of customer parking surrounding us. There will be no sampling
or seating of any kind. We will use no electricity or water.
