Dear Mr. Kaplan,
The subject property (11710 SW 69th Avenue; WCTM 1S136DD, Tax Lot 2800) is located in
the Tigard Triangle Plan District, and the Triangle Mixed-Use (TMU) Zone. A residential use
is allowed in the TMU Zone.
Pre-existing development that does not meet the site or building design standards in
Sections 18.660.070 and 18.660.080 of the Community Development Code of the City of
Tigard (CDC) may be re-established or re-built if accidentally destroyed as long as repairs are
commenced within 1 year from the date of destruction. If repairs are not commenced within
the 1-year period, the development may not be re-established or re-built. Commencement of
repairs occurs when a required development permit has been issued (CDC 18.660.050.D.1).
Pre-existing development that does not meet the site or building design standards in CDC
Sections 18.660.070 and 18.660.080 may not be re-established or re-built if intentionally
destroyed unless the new development meets the site and building design standards in CDC
Chapter 18.660 (CDC 18.660.050.D.2).

I'm actually having trouble bringing up the property from that address. Do you have another address or perhaps a tax lot
number?
If it is in the area that I am assuming it is—the Triangle Mixed-Use zone—then the applicable code can be found here:

Pre-existing uses and developments that are nonconforming in this zone may be rebuilt within a limited time frame after
accidental destruction.
If you need a more formal letter stating the applicable code, you will likely need a Zoning Analysis Letter, which includes
a fee of$840.

The zoning of the property indicates that it is a commercially zoned property. However there is a single family
home on the property we are entertaining in doing a loan on.
With the difference in zoning we would need to have a rebuild letter indicating that the single family home can
be rebuilt if there is any damage to the property.
