SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request. This Temporary Use Permit is valid from August 10th, 2020 to February 28`h,2021. The findings and conclusions on which the decision is based are noted in Section IV. THIS APPROVAL IS VALID FOR 12 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. BACKGROUND INFORMATION Site Information: The subject property is Lot 4 of the Erika Court Subdivision (SUB2017-00003). The address for Lot 4 is TUP2020-00007.ERIKA COURT SUBDIVISION TEMPORARY SALES OFFICE PAGE 1 OF 3 10114 SW Copperleaf Lane. The 10-lot subdivision is located north of SW View Terrace, south of SW McDonald Street,east of SW 103`d Avenue,and west of SW 100th Avenue.This is the first temporary use permit for the Erika Court Subdivision. All lots are zoned R-3.5. On August 6th, 2020, the applicant submitted the Final Buyer's Statement to show that David Weekley Homes,LLC is the property owner of Erika Court Lot 4. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS Findings for only the applicable code sections are found below: CHAPTER 18.440 TEMPORARY USES: 18.440.030 Types of Temporary Uses C. Temporary sales office or model home.This type of use includes a temporary sales office or offices either in a dwelling unit or in another temporary building for the purpose of facilitating the sale of real property in any subdivision or property within this city. This includes the use of one dwelling unit in a subdivision as a "model home" for purposes of showing prospective buyers. FINDING: The applicant proposes a temporary sales office in a 528 square foot trailer to be located on Lot 4 of the Erika Court Subdivision.The applicant is not applying for a model home with this submittal. The applicant's proposal meets the characteristics for a temporary sales office temporary use. This criterion is met. 18.440.040 Approval Process B. Approval period. An approval for a temporary use is valid for a period of 1 year unless otherwise stipulated by the approval. FINDING: The applicant requests that this temporary use permit be valid from June 30th, 2020 to February 28th,2020.The proposed duration of the temporary use permit is less than a period of one year. The temporary use permit will be approved from the issuance of this decision until February 28', 2020. This standard is met. 18.440.050 Approval Criteria C. Temporary sales office or model home. The approval authority will approve or approve with conditions a temporary sales office or model home when all of the following are met: 1. Temporary sales office. a. The temporary sales office must be located within the boundaries of the subdivision or property in which the real property is to be sold; and FINDING:The proposed temporary sales office will be located within the boundaries of the Erika Court Subdivision on Lot 4.The real property to be sold includes the subject property. FINDING: The applicant proposes to utilise a temporary trailer for the temporary sales office, which will not be permanent.This standard is met. SECTION V. PROCEDURE AND APPEAL INFORMATION Final Decision: A Temporary Use Permit is a Type I procedure. As such, the Director's decision is final on the date it is mailed or otherwise provided to the applicant,whichever occurs first.
