Mcminnville Police Department ~ IG214002 ~ Mcminnville Police Department - Training Facility User Agreement-Firing Range- FY 2020-21 McMinnville Police Department Training Facility User Agreement The McMinnville Police department agrees to allow the Tigard Police Department, to use the City of McMinnville's training facility under the following conditions, restrictions, and procedures. 1) Liability Waiver Subject to the limits of the Oregon Tort Claims Act, The user agency agrees to hold harmless the City of McMinnville and its employees for any injuries or defense costs related to the user agency's use of this facility, to the extent such injuries or damages are caused by user agency's negligence or willful misconduct. User agency instructors will be responsible for all persons and activities taking place during user agency's use of the facility. 2) Check Out Procedures The scheduling of training facility is handled by the Firearms team of the McMinnville Police Department. User agencies may request particular dates and times up to three months in advance. Range scheduling is on a first request basis. Requests may be made by phone, email, or in person, Requests must include date and time requested, lead instructor name and contact number. 3) Specific Requirements Non law enforcement personnel will not be allowed to take part in any firearms related activities. Waivers of this policy may be granted with the approval of the McMinnville Chief of Police. Civilians may be present as observers, scenario actors, or to participate in non- firearms activities, as approved by the McMinnville Chief of Police. Firearms use must be in conjunction with Criminal ustice Training which includes practice, training, qualifications and sanctioned shooting events. The only range that is authorized for lead and FMJ founds is the rifle range (46). The five other ranges require nontoxic frangible ammunition only. Automatic weapons fire or rifled weapons .50 caliber or larger are not authorized at this range facility. Waivers of this policy may be granted with the approval of the McMinnville Chief of Police. Gas, smoke, and riot control grenades may be authorized upon your request for use of the training facility. Their use is prohibited during times of high or extreme fire danger or any time a burn ban is imposed by the fire department. A certified firearms instructor/safety observer most be present at all live fire training activities that occurs at training facility. Instructor must wear a rep cap, or coat that readily identifies them as an instructor or safety observer. Vehicles are not permitted to drive "off-road" without the consent of a range officer of the McMinnville Police Department. The yellow gate off Airport Road most be kept closed at all Page I 1 r times when not entering or exiting training facility to prevent unauthorized access to the airport. McMinnville Police Department and its assigned range officers retain final say and ultimate control of training facility. Duplication of the facility keys or unauthorized access to the facility is a violation of this agreement. Authorized firearms instructors of the McMinnville Police Department may exercise authority over training facility at any time. 4. Regulations 1. Maintain a secure facility. 2. Display the both red range flags during all firearms training. 3. Minimum required safety equipment includes radio or phone communication capability, a first aid kit, eye protection for all persons at or on the line, and hearing protection for all personnel. 4. The certified range officer must be present and clearly identified during all training. 5. Conduct a range safety briefing for all personnel prior to any firearms training. No person having any indications of intoxication due to alcohol or other substances will be allowed to enter or remain on training facility, nor will they be allowed to participate in or supervise any training exercise. The parent agency of such employee's will be notified of such an occurrence. 6. Range officers will inspect all weapons, equipment, and ranges prior to firing, 7. Conduct all activities according to range safety rules and regulations. 8. Clean up and removal of all trash, brass,and equipment must be completed at the end of training by the user agency. 9. Secure all gates when exiting the facility. 10. Return keys and other items checked out back to the McMinnville Police Department and report any damage to the facility or any injuries to anyone present at training facility. 5. Clean Up Expenses The user agency will be charged a maintenance fee if they fail to clean up after a training facility event. This includes failing to pick up and remove any trash, collect and removing of all shell casings, and failing to put away any range equipment they move or utilize. Page ( 2 The user agency will follow all City of McMinnville cleanup protocols for any hazardous spills (examples: environmental damage caused by using toxic ammunition where it is not authorized, or by dumping chemicals, oils, or cleaning supplies at training facility). Any damage to the facility or its equipment must be reported to the McMinnville Police Department when keys are returned. 6. User Fees The Tigard Police Department is responsible for paying$2,500 yearly user fee to help offset the training facility maintenance cost. This fee use is due no later than July 31"of each year. 7. Revocation of Agreement The McMinnville Police Department may immediately revoke or suspend the user agencies access to the training facility for willful damage of range property, causing environmental damage, unauthorized access to the facility, or any activity that creates an unreasonable safety hazard. The McMinnville Police Department may revoke, suspend or restrict the user agencies access to training facility for violations of range regulations or failure to clean up after the agency. A red warning flag shall be displayed during all live fire training. 2. All weapons are assumed to be loaded at all times. Treat them accordingly. 3. All loading and unloading of weapons shall be clone at the firing line, and under the control of a range officer. 4. All officers attending the range shall follow the direction and commands of the range officer at all times. Never anticipate a command! 5. When actively engaged on a course of fire, keep weapons pointed down range. At other times, handguns should be holstered, and long arms pointed down, away from others. 6. Never go forward of the firing line until the line has been cleared by a range officer. 7. Call out loudly if you do not understand a command, are not ready, or observe a safety hazard. If in doubt, don't shoot! S. Eye and hearing protection is required while at the line. 9. Smoking, eating, and drinking is prohibited on the firing line. Be aware of lead hazards; wash your hands after shooting. 10. All "dry firing" must be approved by a range officer. 11. Unless otherwise instructed, if you experience a misfire or malfunction, clear it yourself. If unable to do so, raise your hand and wait for the range officer. 12. Range officers need your attention.
