intertie feasibility study with the City of Beaverton and Tualatin Valley Water District
(TVWD)?
KEY FACTS AND INFORMATION SUMMARY
The City has an opportunity to participate in a water system intertie feasibility study with the
City of Beaverton (Beaverton) and Tualatin Valley Water District (TVWD). Beaverton is
initiating a water system improvement that includes a new pipeline along SW Hall Blvd
terminating near SW Oleson Road, where an existing large transmission pipeline serves both
TVWD and Tigard. The City's waterline is the connection to the Portland Water Bureau
(PWB). Currently the water connection is used for emergencies only. PWB is transferring the
portion of pipe that is serving both TVWD and Tigard, and this transfer of pipe includes
removing the connection point between TVWD, Tigard and PWB. This removal of the
connection impacts Tigard’s ability for the transfer of water during emergency needs.
TVWD is extending their Willamette Water System piping to connect at SW Oleson Road.
Tigard may have the ability to develop a water system intertie during TVWD’s design and
construction of the SW Oleson Road connection. The proposed water system intertie
feasibility study will provide information on pressure and capacity requirements based on
hydraulic modeling and engineering review.
Beaverton’s waterline extension along SW Hall Blvd provides an opportunity for the three
water systems to partner on a three-way connection point that would allow the transfer of
water to each system in case of emergency need. The three systems have different water
system pressure and capacity and further engineering analysis is needed to ensure that a major
connection is feasible.
The proposed study will provide a basis for future design and construction of an intertie
between the three parties. As Tigard is connected to Lake Oswego through the joint water
supply system, Lake Oswego may also benefit from Tigard’s access to emergency water
supply nearby. A future water system intertie may provide benefit to both communities due
to disruption of water supply.
TVWD, Beaverton, and the City agree to allocate one-third of the cost for a water system
intertie feasibility study (approximately $110,000 total) with Tigard funding approximately
$37,000 for their portion. The feasibility study will determine if the next phase of design and
construction to provide a water system intertie is beneficial to Tigard for emergency water
supply needs. The City Attorney has reviewed the IGA as to form.
Staff respectfully recommends Council approve the resolution to enter into an IGA for the
water system intertie feasibility study.
OTHER ALTERNATIVES
Council could decide to not approve the resolution authorizing an IGA for a water system
intertie feasibility study.

A RESOLUTION APPROVING AN INTERGOVERNMENTAL AGREEMENT FOR A WATER
SYSTEM INTERTIE FEASIBILITY STUDY WITH THE CITY OF BEAVERTON AND TUALATIN
VALLEY WATER DISTRICT (TVWD)
WHEREAS, ORS 190 authorizes units of local government to enter into intergovernmental agreements for the
performance of any or all functions and activities that a Party to this Agreement has the authority to perform;
and
WHEREAS, the City of Portland (Portland) owns, operates and maintains a 24-inch diameter water line and
related water system facility assets that terminates at the intersection of SW Hall Boulevard, SW Oleson Road,
and SW Greenburg Road, commonly referred to as Bradley Corners; and,
WHEREAS, the Portland waterline and water system related facilities (Bradley Corners Waterline) were
constructed at the expense of the Parties, or their predecessors, pursuant to an Agreement dated March 12,
1973 and the Bradley Corners Waterline has since been used to provide TVWD and Tigard with Portland water
at various connection points to their water systems pursuant to long term wholesale water supply contracts
(Regional Water Sales Agreements); and,
WHEREAS, by Supplemental Agreement between TVWD’s predecessor (Metzger Water District) and
Beaverton, Beaverton was granted an opportunity to connect to the Bradley Corners Water line to obtain
Portland water if Beaverton built a connection thereto and entered into a Regional Water Sales Agreement with
Portland; and,
WHEREAS, the Regional Water Sales Agreement between Portland and TVWD is in place until 2026 and the
Portland and Tigard Regional Water Sales Agreement expired in 2016 but Tigard wishes to continue an
emergency connection with the Bradley Corners Waterline; and,
WHEREAS, the City of Portland has a small number of Portland water users on the Bradley Corners Waterline
and has agreed to transfer it to TVWD for use by TVWD for its water users and to provide water service to
Portland customers during the remaining term of the Regional Water Sales Agreement and thereafter when the
Willamette Water Supply System(WWSP) begins and TVWD uses the Bradley Corner Waterline to convey
Willamette River water to its service area; and,
WHEREAS, each Party has and will make significant infrastructure investments and interconnection of the
infrastructure would enable Parties to receive water from three sources; and,
WHEREAS, City of Beaverton is constructing new facilities on Hall Blvd; and,
WHEREAS, the Parties wish to provide for the design and construction of efficient and effective emergency
interties of their respective water systems at the Bradley Corner Waterline terminus which involves modification
of existing facilities and construction of new facilitiesto provide reliable and redundant water supply between
them.

SECTION 1: City Council approves the intergovernmental agreement for a water intertie feasibility study

SECTION 2:This resolution is effective immediately upon passage.

AGREEMENT BETWEEN TUALATIN VALLEY WATER DISTRICT, CITY OF BEAVERTON
AND THE CITY OF TIGARD FOR THE BRADLEY CORNERS EMERGENCY INTERTIES
This Agreement is made between the Tualatin Valley Water District (TVWD), the City of Beaverton
(Beaverton) and the City of Tigard (Tigard), sometimes referred to as Party or Parties, effective the XX
day of August, 2020.
RECITALS
WHEREAS, the City of Portland (Portland) owns, operates and maintains a 24-inch diameter water line
and related water system facility assets that terminates at the intersection of SW Hall Boulevard, SW
Oleson Road, and SW Greenburg Road, commonly referred to as Bradley Corners; and,
WHEREAS, the Portland water line and water system related facilities (Bradley Corners Waterline) were
constructed at the expense of the Parties, or their predecessors, pursuant to an Agreement dated March
12, 1973 and the Bradley Corners Waterline has since been used to provide TVWD and Tigard with
Portland water at various connection points to their water systems pursuant to long term wholesale
water supply contracts (Regional Water Sales Agreements); and,
WHEREAS, by Supplemental Agreement between TVWD’s predecessor (Metzger Water District) and

AGREEMENT
1.Consultant Retention.
The Parties, through TVWD, agree to retain Murraysmith to perform the following work:
A. A feasibility study and recommendations to the Parties regarding interties to transfer water to
and from the Parties during emergency events, as described in Section 4 below, and include
events such as main breaks, boil water notices, planned shutdowns, or when a Party’s primary
water source is unavailable. The feasibility study will consider and make recommendations
regarding, among other matters: (a) the existing connection and transfer of water between
TVWD and Tigard at the Bradley Corners Water line; (b) connection and transfer of water
between TVWD and Beaverton; (c) connection and transfer between Tigard and Beaverton; and
(d) sub-regional hydraulic model to analyze potential emergency supply scenarios. Murraysmith
will conduct such modelling as approved by the Parties to determine the range of flows and
pressures available to each Party and duration thereof.
B. When the Parties have reviewed the Murraysmith study and recommendations and agreed
upon the scope of work, Beaverton shall provide design directions to WWSP for an emergency
connection to the Tigard system. The scope of work, budget, and payment of fees and costs will
be included in a separate construction agreement between Beaverton and Tigard, as negotiated.
Similarly, TVWD shall provide design directions to WWSP to modify configurations to the
existing connection to allow emergency water to flow to the Tigard system. If the study
recommends connection between Beaverton and TVWD, and this recommendation is agreed to
by Beaverton and TVWD, TVWD shall provide design directions to WWSP for such connection.
Costs associated with design and construction of specific connections shall be negotiated
between affected partners.
C. The Parties agree that time is of the essence that that Murraysmith will complete the Phase I
work by mm/dd/yr unless the schedule is extended by mutual agreement.
2. Consultant Fees and Costs.
TVWD agrees to contract with Murraysmith for the work described in this Agreement at a cost
of $109,996. The Parties shall pay Murraysmith fees and costs on the basis of TVWD (33.3%),
Tigard (33.3%) and Beaverton (33.3%). TVWD will pay the undisputed amount of any invoice
received from Murraysmith and will in turn send a copy of the Murraysmith invoice to Tigard
and Beaverton for payment of their respective shares. Tigard and Beaverton will pay their share
of the invoice to TVWD within 30 days of receipt.
3. Project Management.
The Parties shall jointly direct Murraysmith in the performance of its services. Each Party shall
appoint a project manager:

4. Emergency Supply
A. The Parties agree that the goal is to provide emergency water to each other utilizing
multiple sources to the extent available, to wit: the Portland Water Bureau through 2026,
the Willamette River commencing in 2026, the Joint Water Commission, and the Clackamas
River.
B. Emergency shall mean unforeseen inability to provide water to a Party’s water system users
because of main breaks, boil water notices and contamination, or interruption of a Party’s
water source. It may also include planned water shutdowns for construction, repair, or
replacement at mutually agreed times.
C. Each Party hereby agrees to provide emergency supply to each other to the extent possible
without adverse impact to its own water system users. Until 2026, TVWD agrees to provide
emergency water to Tigard and Beaverton through the existing connection at Bradley
Corners. When the Willamette Water Supply System is delivering water in or after 2026,
TVWD will provide emergency water at Bradley Corners. Similarly, Tigard agrees to provide
emergency water to TVWD and Beaverton at Bradley Corners to the extent feasible and
without adverse impact to Tigard’s water system users. As those additional
interconnections are expanded with construction of new facilities identified in the Phase II
implementation of the Feasibility Study, then the Parties making those connections and
providing additional sources shall provide emergency water supply.
D. Any Party receiving emergency water agrees to indemnify and hold harmless the providing
Party from adverse financial or operational impacts directly caused by the provision of
emergency water.
E. Upon completion of construction of the facilities to effect the interconnections described in
Section 1.A., the Parties will execute a new Emergency Supply Agreement. Rates or charges
for emergency supply shall be included in this new Emergency Supply Agreement.
5. Notices.
Any notice required shall be in writing and received by the other Project Managers at the
addresses set forth in Section 3. Notice may be hand delivered or sent by first class US Mail,
postage prepaid. Electronic notice shall be sufficient if the original written notice is
subsequently placed in the mail for delivery.
6. Term and Termination.
A. The term of this Agreement is through June 30, 2026 or until the Willamette Water Supply
System is operational and delivering water to Bradley Corners. Upon the change from
Portland water to Willamette River water, the Parties will execute a new Emergency Water
Supply Agreement to account for this new source and the construction of new facilities by
Beaverton and Tigard.
B. Upon breach of this Agreement, following 10 days’written notice for non-payment or 30
days for all other breaches, the non-defaulting Party may terminate this Agreement. In such
case, the Murraysmith work will be suspended or terminated for convenience by TVWD.
Each Party shall be responsible for its allocated share of the Murraysmith agreement and
such obligation will survive termination of this Agreement.
C. If a Party breaches this Agreement regarding the terms and use of emergency water supply,
then that Party shall not be entitled to call for emergency water supply until the breach has
been cured.
7. Disputes
A.Any dispute shall be resolved at the project management level at the earliest possible time.
B. If the dispute cannot be resolved, then any Project Manager may request executive
negotiation by written notice. Within 10 days of receipt of notice, unless otherwise
mutually agreed, the TVWD Chief Executive Officer, Mayor of Beaverton, and City Manager
for Tigard shall meet to resolve the dispute.
C. If the dispute is not resolved, then any Party may pursue legal and equitable relief under
Oregon law.
D. The Parties agree that jurisdiction and venue for any legal proceedings shall be in the Circuit
Court of the State of Oregon for Washington County. In any legal proceedings, each Party
shall be responsible for its own attorney fees, but the prevailing party may recover costs and
disbursements under the ORCP 68.
8. Amendment.
This Agreement may be amended only in writing signed by all Parties.
9. Third Party Beneficiary.
The Parties acknowledge that Tigard is a member of the Lake Oswego-Tigard Water Partnership
(LO-T) and agree that the City of Lake Oswego is a beneficiary of the emergency connections
contemplated herein, either by taking water from TVWD or Beaverton supply sources, or by
providing water to TVWD or Beaverton from LO-T supply sources.
10. Mutual Agreement and Cooperation.
The Parties agree to cooperate in good faith to respond to Murraysmith as needed, to obtain
and issue permits and approvals in a timely manner, and other steps necessary to complete
their work as identified in this IGA.

Staff Recommends that the Local Contract Review Board award a contract to Bridge Tech,
LLC for Tier 1 & 2 IT Help Desk Support for an amount not to exceed $750,000.00 and
authorize the City Manager to take the necessary steps to execute the contract.
KEY FACTS AND INFORMATION SUMMARY
Historically the City of Tigard has made use of internal resources to address all forms of IT
support service needs ranging from break fix engagements to implementing large scale
solutions to improve our compute environment. A year ago, the City of Tigard’s technical
team explored outsourcing basic desktop support services to get a better understanding of the
value it provides to the City. It was determined that there is significant usefulness gained in
being able to free up the technical team and by doing so allowing them the time necessary to
focus more on infrastructure and project-based work, elevating services necessary for the City
to achieve its mission.
The city issued a Request for Proposals on May 4, 2020 and on May 26th three proposals
were received from the following firms:

Arctic MSP
The RFP asked Proposers to have proven experience in supporting 300+ user environments,
be able to respond onsite to a service request within 30 minutes and have the ability to
provide configuration, deployment and end support for city technologies currently in use. A
selection committee reviewed and scored proposals based on the following criteria:

After careful consideration, including follow-up clarifications, staff recommends that the city
award the contract to Bridge Tech LLC. Mike Nolop, IT Manager and his staff will manage

The Local Contract Review Board may choose to not enter into this contract with Bridge
Tech and direct staff to issue another Request for Proposals instead. This would result in a
lapse of contracted help desk services.

ISSUE
The current City Manager, who has been in the position since December of 2011, has
provided notice that she will not be renewing her contract with Tigard following its expiration
on November 30, 2020. As a result, the City must determine what hiring standards and
selection criteria will be used in designing a process to find and select a new City Manager.
The purpose of tonight’s meeting is to gather Council input on the direction of the process
and allow an opportunity for public comment.
STAFF RECOMMENDATION / ACTION REQUEST
Staff recommend the selection and use of an executive search firm with experience in hiring at
the City Manager/County Administrator level and working with Council or Boards in those
processes. Staff further recommend the use of the existing qualifications as noted on the
attached job classification along with the necessary knowledge, skills and abilities listed to help
the search firm design a process to find and select the next City Manager. In addition, staff
recommend consideration be given in the process for what Tigard will need in a next leader
to help meet the current challenges and those likely to exist in the coming months and years.

The hiring standards and selection criteria that will be used to recruit, select and hire for a new
City Manager needs to be established. In addition, Council may consider whether an interim

The following areas are to be performed by the Search Firm Consultant including, but not limited to:
1. Develop a timeline
a. Prepare a realistic timeline to accomplish each phase of the recruitment and selection process with
clarity between search firm/City roles and responsibilities at each phase. Recommendations can
include modification to what is proposed in the scope and changes to the order of the phases, etc.
2. Candidate profile development
a. Survey, interviews or other input options to determine desired key traits (Leadership Team,
designated external city partners, department/city staff and community.) Potential one on one

c. Utilizing a networking campaign, do outreach to qualified candidates with a focus of qualified

5. Evaluation/screening of applicants
a. Using a system based on the candidate profile, search firm will conduct an initial screen of

In response to the killing of George Floyd, Mayor Snider challenged the entire Tigard
community to join him on a journey to:
Eliminate institutional racism and ensure equity within all city operations and structures

Improve the lived experience of all persons of color in Tigard such that everyone enjoys
the same safety and privilege.
Over 500 community members responded with ideas for how the city can meet the
objectives. This input was instrumental in shaping the Council's discussion about racial justice
and city action.
The creation of a Transformation Commission was one of the ideas that grew from
community input and Council discussion. The City Council refined the proposal for a
Transformation Commission in mid-July and then sought community input on the proposal.

Community should select members. One of the most important things on this proposal, in
my opinion, is the establishment of non-police responses. I would like to see an even
greater emphasis on this, as well as more preventative measures in place. For example,
the number of social workers should be increased, and their pay should be similar to that
of police officers.
I'd also like to know more details about the training that officers receive in terms of racial
equity and generalized non-discrimination practices. How frequently will these trainings
happen? Who will lead them? What kinds of action steps/homework can the officers do
to ensure the messages are heard and integrated?

that you will support the Tigard police . Both financially and emotionally. Transparency
and sensitivity training and de-escalating training is wonderful but if you tie the hands of

Community should select members. I don't see the purpose of having the police officer's
association or the police chief there and fear they may make people afraid to speak up
about their true feelings about the police department or just try to defend the
department - I think those spots of the commission should be taken away and instead
given to a student of color that leads a different affinity group and a school board
member - preferably Director Bowman. I am also confused why the commission members
need to do a full ride along shift with a police officer - I feel if individuals on the
commission already don't feel comfortable around officers this would only make it worse

what happens - especially about the SROs in Tigard. I would love to see the city branch
out from the police department more and listen to people of color in our community.
After seeing the police chief shut my requests for more body cameras and training down
in April, I believe the police department values may not be aligned with the cities and I
think it would help if the city worked more independently and listened to people of color
before they worked with the police department and made an action plan. I am not sure if
that is already happening, but from my view I am not seeing it.

I am concerned because my 32 year old daughter, college grad, liberal RN at Providence in
Portland feels white shame and COVID shame. It was surprising to hear her admit it.

My feedback is that this is just another tremendous waste of taxpayer money and the
city's time. As mentioned in the very beginning, Tigard has not had any issues around
most of the issues people seem to have nationally. I do think our local police can use
some additional training but let's not go overboard. I also have a problem that we
immediately implement any recommendation by the commission. Any recommendation
should be sent to the city council for their review. I thought Tigard was better than this.
Then you get to one of the items to consider and you talk about the police cars being to
militaristic. What? What snowflake came up with that thought. The police are here to
keep us safe. They need quality vehicles that are well equipped to handle any situation
they encounter. From my perspective, they should look intimidating to the criminals. Then
the bail thing. If you can't afford the bail then how about not committing a crime and then
you don't have to worry about bail. This whole thing is ridiculous and should be scrapped.
I have a good acronym for the name based on the City Anti-Racism Activism Program -
CRAP. Don't do this. There are better ways to deal with whatever issues people are
making up for us. Again, another over-reaction from the liberals that want us to become
socialists. I for one will not be responsible for putting another nail in our coffin. How
about we move on with important issues like transportation, fiscal responsibility and the
homeless. I think there is racial equality in Tigard. This effort is a big waste of my taxpayer
money and the city's time. Our efforts are better spent on issues that we do have instead
of placating all the snowflakes. But no one seems to want to listen to common sense
anymore. So sad to see our society reacting this way where the minority is driving the bus.
How about putting this commission formation on the ballot? There's a novel concept. Let
the people decide whether we need this or not. Oh wait. That's called Democracy. We
can't be having that. I can't wait for the city council to decide we should play Lean on Me
before meetings instead of the Star Spangled Banner. My guess is they don't start with the

Systematic racism isn’t something like seeing someone use racial slurs walking down the
street. Its built into the system. the war on drugs esp crack v cocaine (thanks Reagan
administration), etc and the prison for profit systems, check out the 13th documentary,
are a couple of examples. White generational wealth vs black generational wealth has a
huge disparity. Unemployment rates disproportionately affect bipoc. Bipoc do not hold as
many leadership/high earning positions. Congress has a much smaller number of Bipoc
then white congresspeople. Are just a couple of examples of systemic racism.

There has been a lot of protests demanding things like "accountability," "justice" and
"fairness" but surprisingly little display on the part of the protesters that they themselves
should have any of these ideals placed on them. It greatly concerns me that the public
leaders have not enforced the theft, vandalism, arson and graffiti laws that exist on the
books. If the existing laws cannot be enforced by the governor, mayors, city councils and
legislature, I have little hope that limiting police actions is a good direction in the future.
I believe equality, justice and fairness are ideals we should practice regardless of the color
of a person's skin. However, once a person violates the law, their treatment by police
should match the severity of the offense. If the criminal activity warrants non-lethal force
or if lethal force is prudent, then that is the result that should be expected. Nationally, this
has not always been the case. In Tigard, I am not aware of any excess force being used by
the police.
In general, the Tigard plan seems okay. My greatest objections re with the Legislature's
actions last month which greatly compromise police enforcement of the laws. I fully
support non-lethal force to break up riots and lethal force when a suspect threatens the
life and/or safety of the public and the police. If legislators disagree with this, perhaps
they should go out on the front line and experience the issue first-hand.
First, take color out of the equation. All races have committed autrocities against each
other over the centuries. No one race is to blame. Stop the blame and work the problem
by concentrating on the future, not your tainted view of the past. The word slave came
from Slavik people (Slavs) being the first slaves, and we are reminded each Easter int he
Ten Commandments movie that the Egyptians used Jewish slaves to mine and haul the
rock to build the pyramids. Tyrants that murdered hundreds of thousands or millions
came in all colors and continents. No one has claim to being the sole oppressed nor the
sole oppressor. Humans have been bad for thousands of years and we can't change the
past. We can only change the future.

I am glad to see this draft. I do feel that a peer court needs to be reinstated. I also am
wondering if there is a discussion to be had re: educational requirements for officers. As a
teacher we are required to have continual educational opportunities, a BA and/or Masters
Degree in a specific field. I feel that police officers need to be required to have more
education to help them make educated guesses. I, personally, have seen some issues
within the police society (along with good decisions). When it results in a death, there is
no going back. Training, education, modeling, accountability and empathy are needed in
every job, especially in law enforcement. I feel that there need to be more inclusive
classes for all, possibly adding more programs at the library that include diversity. Schools
need more opportunities for others than just the mainstream white that can afford to find
sources. Officers could be more involved with youth encouraging and mentoring.

I know from what the Mayor & police chief said at the "state of the city" that Tigard is
attempting to hire more officers and keep the existing ones from leaving to higher paying
jurisdictions. I would like to know what percentage of our police force lives within Tigard
city limits (community policing) and what is being done to "embed" officers with the
neighborhoods they patrol. This may be addressed somewhere on the city's website, but,
if I don't know the answer to this, other folks may not either. Generally I think the draft
commission charter looks great. Where is the data for citizen complaints against the force
tracked, and how is it reported to the community? What is Tigard doing to push back on
Federal overreach into local, county, or state level law enforcement, or has this not really
been an issue in a city of our size?This is obviously an uncomfortable question for many
who come from privilege and represent the dominant racial group in Oregon. That being
said, there has to be a way to give a larger voice to the communities that statistically
speaking have had more police contact and exposure to the criminal justice system, than
those for which this is an academic discussion. Transparency is key. Embedding and

What I have found..is that our society will seek outlets for discriminatory behavior..I have
found that the way we legislate anti discrimination is flawed. We consistently try to
address these issues by addressing the problem "targeted demographic" - flavor of the
month..one form of discrimination at at time. This allows discrimination to work through
remaning "cracks" and return/re-surge, almost always finding new ways to negatively
impact those demographics previously attempted to be protected as well as finding new
targets... (Discrimination manifests in clear ways, through well known processes..) the
only way to finally get ahead of it is to legislate against "all discriminination" target known
unnacceptable conducts/impacts/behaviors ect.. This way we raise needed
cultural/societal awareness, stop future abuse and provide needed coverage to those
demographics not yet being focused upon to the extent required.

I agree with the topic areas. I strongly recommend that the statement, "There have not
been any incidents in Tigard that look and feel like those documented in the national
media" be eliminated. Says who? It sounds immediately defensive and doesn’t bode well
for the City being open to critical feedback.
I am very happy to see the president of the Tigard High Black Student Union or designee
and the Youth City Councilor included. I suggest adding to the business leader
qualification that people of color be given preference.
Regarding the 6 community members, I would like to see a word stronger than
"preference" for members from marginalized communities. I am concerned that only
white, straight, cisgender, able-bodied, Christian people will apply and an effort will not
be made for more outreach. I hope that if that is the case, the City will not accept the pool
and will broaden their search until there is a strong pool of people from marginalized
communities from which to choose. In fact, maybe a statement to this effect could be
added to supplement the statement that marginalized people will be given preference.
The voices we need to hear from most are those who have been marginalized, and we
shouldn’t settle for less.
Council should select. There has been talk of an outward facing DEI committee of City
employees which still hasn’t happened. Please make this happen.

I recently learned the difference between systemic and systematic racism and found it
very helpful. Systematic racism is when laws allow for racism to happen (ie, segregation)
and systemic racism is when the system itself is built upon a foundation that leads to
inequity between whites and people of color. So systemic racism persists as a result of
systematic racism even if the laws have been changed. Yes, it is illegal to discriminate
against someone because of their race, but when it was legal, it led to the after effects
decades later of people of color being more likely to live in poverty, have less access to
resources, etc.

The largest institutional racism issues in Tigard are the violence in our public schools
(starting in elementary school), not teaching children about consequences and respect,
failing to address Dyslexia in public schools (50% of inmates have Dyslexia) and public
policy that results in fewer living wage jobs. These are systematic problems that
disproportionately affect people of color, create bullies out of the privileged/entitled and
create an atmosphere of mistrust and fear. These are also base issues (root cause).

I would like to see more diversity on the commission including representatives of the
following groups: Latinos, homeless, immigrants, MET, NAMI. It seems to me that a
public defender might have special insight on this subject, having represented those who
have had conflicts with law enforcement. That insight would be valuable on the

groups and agencies. Good question. Consider who might be missing out on the benefits

I think this is a fantastic foundation. I only wonder if police have to satisfy continuing
education like many professions. I was a medical coder and had to prove a level of
knowledge about new codes and Medicare laws, etc. I could not maintain my certification
without this. At the very least are there any mandatory seminars on dealing with
challenging humans and situations? Many corporations require this just for their customer

DO support Tri-Met Transit Police Program as well as re-establishing the youth peer court.
I submitted my feedback and have forwarded your request to our Tigard Baha'i
community mailing list. Possible formation of a Community Roundtable focused on racial
justice and unity (separate from current Roundtable.) Bring more voices to the table
regularly. Listening is an important aspect of addressing racial equity. Tigard is already
doing a good job, but this could bring in more of the community members and groups.
--Possibly host regular Forums on Racial justice/unity for the community--with speakers
and break-out sessions. Education is another important aspect of addressing racial equity.

I want to say the community should select the members, but if this committee is to be
implemented sooner than later, I might be willing to suggestion city council. My only
concern is that the city council members may not have an accurate idea of the range of
citizens in Tigard. I think that the topics are broad and I am happy about that. You're
addressing not only the actions, but the causes of some of these tensions. After reading
the Transformation Commission proposal, I'm honestly not sure if there's anything the
city can do further than what they can. Much of the issues are large are on a state or
federal level, which ultimately puts it out of the city's hands. My major hope is that seeing
the actions Tigard takes will encourage other cities to take notice and join. With that kind
of support, I think the state as a whole could make some serious changes.

the United States Constitution. it is the foundation of our country and is the "supreme law
of the land" because no law may be passed that contradicts its principles. it is easy to

while making decisions on the fundamentals of our laws and civil rights.

I am one of the nearly 600 marchers that recently marched through downtown Tigard. My
family and friends felt compelled to take part in the march and were pleased to see the
city of Tigard thoroughly involved with it. I think one of the things most cities, large or
small, need to have in place is (for lack of a better term) an public Action Team. For
example: Tigard could put together a group of approximately 15 core members who can
come together in a ‘moment’s notice’ in the face of any acts of racism, prejudice or
bigotry - reported to us by liaisons from your office as well as police, fire and other
organizations. In addition to these 15 there will be a larger group of active volunteers to
assist from as wide a demographic as possible, race, age, etc., - who can bolster the
actions decided by the core 15. The reason for the action group? Too often when news
gets out that, e.g., someone defaced a minority-owned business - its been days - maybe a
week or more before we’ve heard of this. If we’re lucky we might catch news of it on one
of the local stations but that is of course hit or miss.
I’ll give you a real life example. Just days ago our friends - a inter-racial couple living in
Hillsboro - dear friends of ours - faced what certainly seemed to be a racial ‘attack’
composed of teens/young adults and at least one adult. They set off big firecrackers in
their front door and then sped away. The police came and went - there wasn’t much to go
on - but these same people did it again hours later!
What my family and our extended circle of friends have done is - in essence - create an
action team. We and perhaps 20+ friends are going over there in the next few days (the
couple is out of town now, having left the next day) -to have a block party . We are
sending a CLEAR message to everyone close by - these people are loved, are cherished,
ARE PROTECTED! Such a team in Tigard could visit nearby towns urging them to also put
together such an Action Team and those teams can then work in conjunction. To
paraphrase Martin Luther King when he said that we could not ‘legislate love’ but we
could certainly ‘legislate against racism’. Ridding ourselves of racism is a long process both
individually and collectively. But having such action teams, linked hand in hand

Topic ares and draft looks great and it shows much thought out into it. I do feel that all
violence and causes for police attention starts with parents and educating their children
from birth. There would be a significant decrease in in all police activity if families could
receive ongoing education and communication on topics of racial equality and prejudice.
EX: meeting with parents with school age kids, additional education of parents as to how
to have discussions in the home with kids. Also providing community gatherings regularly
to promote tolerance and respect of others of all races. It all starts at HOME.

Given what has recently transpired in our nation, state and city I suggest the members be

I would like to see folks who are truly interested in this commission to submit their
interest. Again, I think the City should put a preference on the 6 at large commission
members be BIPOC. AS a person of color and a leader in the community that runs a
mental health company, I am interested in being part of this commission. Love to get

To truly look and work towards breaking down institutional racism I think more training
are needed so we can share common vocabularies and languages. This work is hard and I
think working with a consultant is important to be able to make a cultural shift. Also

Would it be possible to identify institutional racism in city operations and in the
community? Eliminating something that isn't clearly identified and isolated seems like a
futile effort. Does this exist, institutionally, in the city and community? If so, first call it
out, let's ensure it is what it is, and then eliminate it. We might find it harder to qualify
and identity than to "eliminate".

What Actions Should Be Taken = The best way to ensure racial equality is to avoid policies
and procedures the lead to real and objective racial inequality as opposed to perceived or
subjective inequality. Seems in today's way of doing things, one person's perception
becomes a forced reality for someone else. Let's find if inequality does exist and if so,
address it. But this needs to be done objectively, with reason and logic as opposed to
emotion and rhetoric.

Why was there a need for a specific commission regarding race. It's been against the law
to discriminate for decades? Is the city of Tigard now stating our tax money was being
used for elected officials to disobey the law? This is disgusting, if it is true and disgusting if
it is all being put on for show when the city of Tigard has been in compliance with the law

I fear that what I think will be unwelcome, however I will share my thoughts as a member
of this community because we supposedly have the freedom to still do so. I personally
believe such a "commission" is unwarranted and unwise. Unwarranted because is accepts
the premise that there is institutional racism in our community and unwise because such
a "commission" validates the premise and promotes further fragmentation of our
community by advancing this premise.
Yes, there are racist individuals in every community. It has always been so and will
continue to be so. One cannot legislate away evil thoughts, prejudices, or intentions. Such
things are within the human heart and can only be addressed on an individual basis. When
racism is evident, it must be addressed firmly and directly.
Is there systemic racism in our community? I do not believe so. The proof is all around us.
Those crying "foul" the loudest are not people of color but white. Sadly, I believe what
may have been intended for good has been co-opted for bad by individuals with an
ulterior motive. If our nation at large and our communities in specific are truly and
systemically racist, why do people of color still flood our nation in an effort to be a part of
America?
You ask what I think. That is what I think.
Council or Community = I personally don't think such a "commission" should be created in
the first place. The "fate" of our community as relating to what is "racially equitable" will
be dependent upon the ideological opinions of six people that will have no accountability
to those they are impacting.
What Actions Should Be Taken = If the city truly wishes to address racial equity, it should
dispense with the creation of a "commission" and focus upon those things which have
proven successful in the past:

Regarding options on getting on board, for purpose of expediency, I like that Option 2
invites the community to step up, but be vetted thru a process. As far as appointment, I'd
skip the creation of a caucus to select. Just get the applications and the council select.
One step less, quicker result.

What Actions Should Be Taken = First of all, I'd like to assess how much racial INequity

At this year's Leadership Training, on DEI Day, I expressed that in my 30+ years of

ignorance -- at least FOR MY ETHNICITY. As for blacks, it just was obvious there wasn't
enough to see/cause problems, IN MY EXPERIENCE.

YES- children should be taught in schools how to respond, and how not to respond when
interacting with law enforcement. I know the PD would be happy to offer this training. I
do not believe we have a racist police force, and the notion is probably absurd. Most
people likely respond to lawful police requests appropriately, but when they don't that is
a major potential conflict, therefore I think this should be addressed in school.

Having a Transformation Commission sounds like a good idea. Maybe they can review all
policies related to our City to make sure they are equitable for all members of the
community - black, brown and white.
I've lived in this community for 27 years and do not want to create problems where we
didn't have them before. Maybe we should look at including homelessness, which we do
see in Tigard and mental illness as well as we look at transformation. No one should be
left out.

What Actions Should Be Taken = Keep in mind that we are not Portland and that we
recently voted for more policing in our City. It is clear that is what the people wanted or
we wouldn't let our taxes be raised if it wasn't important.
Maybe look at the Springfield/Eugene model of policing that uses a group that answers
911 calls vs the police. They answered 22,000 calls instead of police last year I believe I
heard. Look at other cities to get their ideas of what has already worked for them. Review
all policies we have in the City to make sure there is equity for all. Change policies where
indicated or send for vote.

This charter is comprehensive and I agree with the topic areas. From this list it is easy to
see that there is room for improvement in many areas. A lot of the accountability and
transparency is dependent on advocacy. I would like to know more about what the plan
on advocacy looks like.

I do not understand that reasoning. How are they impacted by this? Why is that role

President of THS Black Student union. But what about other minority groups like Hispanic
and Asian populations and people in our LBGTQ community.
Is there someone who would be qualified to speak for minorities as a whole? Maybe

The beginning statement "There have not been any incidents in Tigard that look and feel
like those documented in the national media" is false. In 2006, Lukus Glenn was murdered
by police and a wrongful death suit followed where a jury sided with the family. Though,
this was not a race incident, it was a mental health incident. And this issue needs to be
addressed. Mental Health professionals need to be sent out for incidents like this. Yes,
Lukus had a knife, so an officer needed to be there, but a mental health professional may
have been better suited to help this young man who was in crisis.

What Actions Should Be Taken = 1- All white City Council members, the Mayor and white
police officers should be required to attend "white supremacy-white privilege"
educational/discussions groups that are facilitated by a white person who is already doing
this personal work. This work is needed for white individuals to understand systemic
racism since the very beginning when people of European descent came to this continent.
We have been blinded for far too long. For instance: reading and discussing A People's
History of the United States by Howard Zinn, White Fragility by Robin DiAngelo , How to
Be an Antiracist by Ibram Kendi, My Grandmother's Hands by Resmaa Menakem.
2- Mandatory Trauma healing work and wellness care for all Tigard police officers along
with reading My Grandmother's Hands by Resmaa Menakem who works with police
departments concerning their trauma due to their jobs. His book is written for White
Bodies, Black Bodies and Blue Bodies (Police Bodies) and should be read and worked
through with all police departments. He works often with police departments on wellness,
trauma healing and how to care for the whole police person to minimize their trauma, so
that that trauma is not then perpetuated on the citizens they are supposed to serve.
I am passionate about this type of work, because it starts with us individually as human
beings, especially white human beings to do the work of healing, perspective, perception
and understanding of our history and our own personal complicity in it. It takes humility

I agree with the topics presented.
There was one issue I felt would be contentious depending on the perspective/audience.
When we write laws like this, it opens the door to abuse by those it intends to protect
"Consequences for calling 911 to report normal community activity based primarily on
race - Criminal law is set at the state level and local governments are generally preempted
in this area." Oregon's hate crime laws are already progressive and reasonable (I'm sure
room for improvement). Instead of going this direction, I think we should focus on
enforcing the existing laws already on the books, additional training police how to
respond to hoax calls based on race and education. My general perception is that Tigard
PD officers recognize hoax calls.

What Actions Should Be Taken = The City should advocate for the end of classroom
violence and the era of 'room clears' and teacher assaults in our public elementary,
middle and high schools. The City should advocate for parental notification when children
are exposed to violence in a public school setting. It does the community great harm to let
our youth (particularly our disadvantaged youth) to be led to believe that violence will be
rewarded or that they will escape consequences as adults just because a great deal of
violence is currently acceptable in public school with little consequence.
I think I have some concerns about this topic area: "Qualified immunity
- Qualified immunity is a legal defense to claims for certain constitutional violations.
- Tigard Action: Advocacy. This is a complex legal principle with far reaching legal
implications
and would require Congressional action."

Overall I agree with the topic areas. I'm not sure how applicable this is to Tigard's PD, but I
feel it is important to assess the culture of policing and reinforce the overarching principle
of community well-being rather than a "warrior" mentality. I also think it's important to
build positive relationships with marginalized communities, not only allowing input but
going out and seeking out the experiences of marginalized communities. I am glad to hear
the Tigard PD does not have military weapons or gear; can that be committed to moving
forward? Also, could there be more funds for drug and alcohol treatment at the city level?

What Actions Should Be Taken = I like the history of all of Tigard's people, which
intentionally includes the experiences of marginalized communities, which has been

I'm impressed with how extensively this charter seeks to begin community based analysis
on a very complex subject. A few thoughts:
Commission composition
* Does the City Attorney primarily represent the City's legal interest relative the laws
which bind the City? The Municipal Court Judge may represent a neutral arbiter and both
sides of issues which typically come before the court, or not. In the context of a broad
class of people feeling discriminated against, who is representing those specific people's
experiences within the legal system? Would representation from a public defender be
beneficial?
* Community representatives: I value the expressed preference toward BIPOC, LGBTQIA+,
faith. But could this detract for some from the legitimacy of any finding? I wonder if a
community member of the majority race should also be preferred, perhaps with a specific
chartered goal of establishing and sharing some type educational syllabus on the topic of
institutional racism back out into their community.
* Is a 15 person commission too big to reliably get a quorum of attendees? Is this too
many, versus a smaller set of people with established passion and dedication to persist on
the task to completion? What will happen if members regularly do not attend meetings or
have not done their pre-work?

* While I wonder at comm. too big, I also wonder if it's too small. I'm skeptical 15 people
can efficiently operate through fact finding, analysis, proposal, and consensus building on

The 3 outcomes stated on page 1 of the draft charter talk about ALL Tigard operations and
talk about the community experience. And, yet, the remaining pages are ONLY about the
police. While the police are certainly an obvious issue, systemic racism and treatment of
BIPOC is much more involved and insidious than just the police.
So, yes, what's missing is an approach that will address systemic racism in all City of Tigard
operations and in the community!
And, please, you MUST have BIPOC as integral members of this commission. You can't
have a lily-white commission. It would have no credibility, especially among those BIPOC
in Tigard who you want to have "lived experiences" of inclusion and equality. You need to
include leaders of the BIPOC community, not so they do the work for you, but for the
Whites on the commission to hear their truth. I recommend that you contact Dr Shirley
Jackson, chair of the Black Studies dept at PSU. She is a sociologist by training and could
certainly recommend some qualified people to be on this commission.
And, you should never use the word "never"! For example, the second sentence says
"there have not been any incidents that look and feel like those documented in the
national media". You don't know that. You just may not be aware of it because it hasn't
been officially reported through official channels. And, to start off the entire document
with how great the police are belies your openness to truly listen to BIPOC about their
experience and about systemic racism in the City of Tigard operations.
As someone who was an Asst Regional Director for Civil Rights for the federal government
in the early 80s and as a woman activist, I can easily tell you that this work is very difficult,
especially if you only focus on the obvious (the police). Racism is so much deeper than we
have allowed ourselves to think about. It's time to do the heavy lifting now and I applaud
Tigard for knowing that something needs to be done.

I am mostly in agreement with the draft Commission charter and I agree with the topic
areas. In my opinion in the deployment of resources section:

This seems like an empty statement. As a mother of a child with a serious mental illness I
have been in the position to need assistance. After calling the Washington County mental
health crisis line & having police officers show up to help I can say this is a terrifying
situation and it triggers further mental instability in the person needing help. I cannot
imagine the terror that a mother of a black child would feel in this same situation. In no
way should mental
health crisis services ever be based on availability. This is the crux of how we need to
change our current police force: we MUST have fully trained mental health professionals
working side by side with the police on the front lines 24/7. De-escalation goes hand in
hand with this. Not just training. There needs to be a cohort dedicated to more
appropriate police response, even here in Tigard. Even though I have been grateful for the
Tigard Police department’s help, I have also experienced situations that made me
question motives. I am hesitant to open up in such a public way to protect my loved one
but it is important for those of us with a voice and an insight to speak out for those who
are more vulnerable.
Please make real progress and change for good. Let’s not just phone this one in.

= Just to include another idea, since I'm impartial to either a Council Appointment or
Community Vote— what if it was a hybrid process where one of the groups decides to
select Commission Member candidates, and then the other decides based on the
provided candidates. Like Council picks candidates and the Community decides, or vice

Improvements for Existing Proposal = My main concern is with the Commission Training,
specifically with the ride-along requirement. In addition to COVID-19 being a safety
concern, I fear that this will dissuade BIPOC community members from applying to serve
as a Commission Member, due to the triggering and fear-inducing environment that, that
could create for them. As a POC, I know that I would be hesitant and fearful to do a 1:1
ride-along with an officer, and it isn’t anything personal, but rather my cultural upbringing
and past experiences that create this reaction. If there could be a virtual ride-along or
virtual training by law enforcement, I think you would get greater participation from folks
and it would be more appropriate for our BIPOC voices who should be centered in the
Commission Member selection. Additionally, if the community members are required to
gain exposure to law enforcement as training, I believe it would behoove the process to
have law enforcement have some form of cultural or social training/experience with the
community stakeholders. I have no other areas of improvement that I'd like to see. After
reviewing the entire document, I was impressed and appreciative of the topic breakdowns
and the Tigard Action context provided.
What Actions Should Be Taken = After this Commission completes its responsibilities to
the community and city on institutional racism, policing, injustice, and inequality in Tigard,

steps. Right now these are very surface level steps that don't get the root of the issue.

decrease the Tigard police budget, steps to demilitarize Tigard police (would love it if
police responded to non-urgent calls without guns), and I would like to see all Tigard
police contracts be ended with schools, social services, care services and government

the police dept. I'd just like to say I think they're doing a great job. However, the fact that
wearing cameras is not yet mandatory for all officers at all times leads to inevitable he
said/she said situations. Worse, in controversial events the camera is turned off, which
allows circumventing it's purpose. Cameras are meant to protect BOTH sides of each
encounter. So that topic should be #1. While "Color and style of uniforms and color of
cars are intimidating/militaristic" is nit-picky and just plain silly. How else can I easily
recognize a law officer? That topic should be at the bottom of the stack.
What Actions Should Be Taken = As a white senior raised in an all-white town, I've been
sadly oblivious to the challenges minority members face when trying to rent or buy
housing. I suppose there're local laws about that, but is there an EASY way for people to
make it publicly known if they face housing discrimination in our city? It should be EASY
for them to complain to Tigard officials (NOT the police dept.) so we an ensure that
everyone has an equal opportunity to live in Tigard. And those complaints should be made
public, not just pushed across the desk of an employee who may have their own
prejudices. I personally would want to know if my neighbors are refusing to sell to a black
family, or if someone is being asked their race when applying for an apartment. Or of they
have to appear in person first in order to pass the unspoken "what do you look like" test.

Council or Community = I think we might struggle to achieve a healthy amount of
community participation but I generally believe it should be the community who selects
the commission members.I didn't have time to completely digest all of the topic areas but
I do think this is being addressed in good faith. I do think that decisions being
"implemented as soon as practicable" is a little too loose. I think the commission should
be tasked with working with the police force to set a reasonable date by which a new
policy should be implemented to maintain a level of accountability. Additionally, I think all
of these current policy considerations and reviews of current policies / practices should be
routinely reported on via virtual video presentation or a newsletter so the community
knows how we are progressing on these considerations and reviews.

My two comments:
[1.1] I note first that you are using the typical undefined terms that are extremely broad
and gaseous. Terms such as “institutional racism” and “equity.” Other terms come up
elsewhere in the proposal that also need to be defined, such as racism, implicit bias,
cultural awareness [meaning you need to define “culture”], restorative justice [meaning
you need to define “justice”], and extremist/racist groups.
Without precise definitions you are just babbling incoherently. Once such terms are
defined, in order to “identify” them, you will need to adopt reliable and valid objective
measures and methods of measurement that can prove and measure the existence of
such “bad things.” You cannot just assume they exist or that they exist to an unacceptable
level, otherwise how can you possibly ever determine that any such “bad things” have
been “eliminated”?
[1.2] We have innumerable laws and regulations in place at the federal, state, county, and
city levels. The Commission’s purpose cannot possibly be to investigate and find violations
of such laws. If such laws have been violated, the injured parties, police, and district
attorneys can pursue whatever legal processes are available. If there have been such
violations and neither the mayor, the rest of the city council, the city attorney, nor the
police have done anything about these, they should all resign.

I believe the majority of Tigard's draft Transformation Commission Proposal is appropriate
and timely. My only suggested subtopic is for police recruits. Besid e the Basic Police
Academy srecruit be required to participate in additional live fire target acquisition and
discernment traininging. Existing officers participate in semi-annual day-long live fire
target acquisition and discernment training

Triangle/Tigard/ Bridgeport Village real estate and major right-of way space the

Please be very careful about who you are aligning yourself with as this "movement" we
are seeing may not be what it seems.
I hate having to provide this feedback under a pseudonym, but unfortunately any voice
going against the narrative is labeled racist and the "woke mob" shifts into gear.
Please know, I am a long term Tigard resident, I pay my taxes, and all around I'm fairly
boring; but I'm part of a vary large, quiet group of people that will keep Tigard from
turning into a failed experiment like we are seeing with Portland and Seattle.
We need law and order in Tigard. We need officers on the street and they need to be
equipped to do their job safely; including being allowed to use the right tools to preserve
their heath and safety. We passed that levy under the promise of more patrol hours -
Don't shift those resources elsewhere.
There is a movement out there who's sole focus is destroying the traditional family
structure. When you say black lives matter, I hope you saying it in the general term and it
is not a statement of endorsement of Black Lives Matter, LLC by the City of Tigard. Black
Lives Matter explicitly states their goal is to "disrupt the Western-prescribed nuclear

"Western-prescribed nuclear family" is central to the success of any community
REGARDLESS of color; embracing policies who's aim is to disrupt this foundation is
reckless.

regardless of the color of their skin or their place of origin. I also believe there should be
consequences for persons who break the law. I do not recall any incidents in Tigard
involving the police where there was racial inequality. I do not believe that "institutional
racism" is real, I think it's an excuse. I have the same stories to tell about being turned
away from businesses, not because I was white, but because my appearance did not meet
up with their standards of decorum or wealth. I have been denied jobs because I am a
white male and would be concerned if the new transformation would deny me further
even though I was more qualified because of my experience and educational background.
In other words, you should neither be denied access to a job, etc. because of your race or
given that opportunity because of your race. Calling it "institutional" seems like a call to
lower the standard from the "most qualified" to "anyone with a pulse." I base this on the
examples I hear on the news like SAT scores which can no longer be the basis for college
admission - math skills and verbal skills are no longer important (an A student should have
no more advantage than a D student, really?). I do not wish to see our society spiral
downward to mediocracy. America will not be able to complete on the world market if we
do not value achievement as a basis for employment and education. Instead of blaming
others for our lack of success, we should be focusing on how to make more Americans
successful. In other words, raise the bar, don't lower it. Thus, the whole idea of a
Transformation Commission to rid the world of measurements of worth is a direction I
cannot support. This is not a racial issue, this is a competitive issue. Don't compromise
quality by thinking you are achieving equality.

creates an "us vs. them" environment. "Black is King" is just as racist as "White

Improvements for Existing Proposal = The first thing I would like to point out is an issue of
accuracy with second sentence in the proposal:
"There have not been any incidents in Tigard that look and feel like those documented in
the national media"
There have been a couple of cases where police have used lethal force, though I'm not
aware of any across racial lines. Lukus Glenn in 2006 comes to mind, and I believe there
was one more such case within a year or two of that incident as well. I'm not meaning to
re-open that case as a question of whether or not lethal force was *justified*, but I hope
we can all agree that it was *highly regrettable*. In fact, a coworker at the time told me
he would think twice about calling 911 if his teenage son came home apparently on drugs
out of fear the police would kill him, even *justifiably*.
The movement right now is in part racial equality, and in part police brutality. Police
brutality has cost African Americans disproportionately, but it has affected all ethnic
groups. Therefore, I would urge the commission to not only consider accountability, but
instead find ways to practice peace.
Personally, I would feel safer if our officers rarely carried guns. I know that may seem
unfathomable and unreasonable but please allow yourself to imagine what that might do
for the trust of police officers in the community.

considerations that are brought up. While it is true that some of topics being considered
have constraints outside the purview of the city, I think there is always room for creative

feel very strongly that the city council SHOULD NOT be responsible for appointing
commission members, as they have pre-existing relationships with the parties and policies
being investigated. I also do not think it is appropriate to give even more power to people
