APPROVED MMD2O2O - 00025 MODA PARTNERS , INC . NOTICE OF TYPE I DECISION MINOR MODIFICATION MMD2020-00025 11111 MODA PARTNERS, INC. T I GARD 120 DAYS = October 28, 2020 SECTION I. APPLICATION SUMMARY FILE NAME: Moda Partners. Inc. CASE NO.: Minor Modification(MMD) MMD2020-00025 PROPOSAL: The applicant proposes to remove two (2) parking spaces and 136 square feet of landscaping in order to accommodate a new emergency generator at 16100 SW 72°d Avenue. APPLICANT: Pacific Realty Associates,L.P. Attn:Robert Bumcrot 15350 SW Sequoia Parkway,Suite 300 Portland,OR 97224 OWNER: Same as applicant LOCATION: 16100 SW 7T"Avenue WCTM 2S113AA,Tax Lot 500;WCTM 2S113AB,Tax Lot 100 ZONING DESIGNATION: I-L: Light Industrial Zone. The I-L zone provides appropriate locations for general industrial uses including, but not limited to: industrial services, manufacturing and production, research and development, warehousing and freight movement, and wholesale sales activities with few, if any, nuisance characteristics such as noise, glare, odor, or vibration. APPLICABLE REVIEW CRITERIA: Community Development Code Chapter 18.765.060.D SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request. The findings and conclusions on which the decision is based are noted in Section W. MMI)2020-00025 Moda Partners,Inc. 1 SECTION III. BACKGROUND INFORMATION Site Information: The project is located at 16100 SW 72"d Avenue (WCTM 2S113AA,Tax Lot 500;WCTM 2S113AB,Tax Lot 100); south of SW Upper Boones Ferry Road, east of SW 72"d Avenue, and west of Interstate 5. The 2.03-acre site is made up of two (2) tax lots, and contains one (1)industrial building, with on-site parking, and associated landscaping. The site is zoned Light Industrial(I-L),as are adjacent properties to the north, south, and east;adjacent properties to the west are zoned Industrial Park (I-P). SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS 18.765 Modifications: 18.765.060 Minor Modifications A. Definition.A minor modification has the following characteristics: 1. It has minimal impacts on surrounding properties, sensitive lands,or public facilities;and The applicant proposes to remove two (2) parking spaces at 16100 SW 72"d Avenue, in order to accommodate a new emergency generator. The subject site contains one (1) existing industrial building that is occupied by 24,070 square feet of warehouse, and 9,999 square feet of wholesale sales. A warehouse use has a minimum off-street parking requirement of 0.5 spaces for every 1,000 square feet of floor area, and a wholesale sales use has a minimum off-street parking requirement of 0.8 spaces for every 1,000 square feet of floor area (CDC Table 18.410.3). Accordingly, the total minimum off-street parking requirement for the subject site is 21 parking spaces. Even with the proposed removal of two (2) parking spaces, staff finds there is still adequate parking at the subject site, with 69 spaces remaining. The applicant also proposes to remove 136 square feet of on-site landscaping,in order to accommodate the new generator. The subject site is located in the I-L Zone, which has a minimum landscape requirement of 15 percent (CDC Table 18.330.1). Staff reviewed the applicant's submitted site plan to confirm that even with the proposed landscaping removal, the site will continue to meet the minimum landscape requirement, with 18 percent remaining. Additionally, staff reviewed the applicant's materials to confirm that the new generator will meet the applicable development and screening standards for the I-L Zone. The generator will be located more than 20 feet away from the street property line (CDC 18.330.040.C), and will be screened to the S-1 standard with a six-foot-tall sight-obscuring fence (CDC Table 18.420.2). The applicant proposes chain link fencing with slats to screen the generator, which is allowable, because the fencing will not be visible from a public sidewalk (CDC 18.420.050.C). As demonstrated in the findings above, the applicant's proposal complies with all applicable development standards for the I-L zone, as well as the applicable standards for parking, landscaping, and screening. Accordingly, staff finds this proposal will have minimal impacts on surrounding properties, sensitive lands,or public facilities, and meets the definition of a minor modification. 2. It does not cause the development to go out of conformance with any applicable standard or further out of conformance if already nonconforming, except where an adjustment has been approved. As demonstrated in the findings above, the applicant's proposal complies with all applicable development standards for the I-L zone, as well as the applicable standards for parking, landscaping, and screening. Accordingly, this proposal does not cause the development to go out of conformance with any applicable standard. MMD2020-00025 Moda Partners,Inc. 2 D. Approval criteria. The approval authority will approve or approve with conditions a minor modification application when all of the following criteria are met: 1. The proposed modification qualifies as a minor modification as defined in Subsection 18.765.060.A; As demonstrated in the findings above, this proposal qualifies as a minor modification as defined in CDC 18.765.060.A.This criterion is met. 2. If the proposal involves the modification of a condition of approval, at least one of the following criteria is met: a. The condition cannot be implemented for reasons outside the control of the applicant or property owner; b. The condition is no longer needed or warranted because circumstances have changed; or c. A new or modified condition better accomplishes the purpose of the original condition. The applicant is not proposing to modify a condition of approval. This criterion does not apply. CONCLUSION: This proposal qualifies as a minor modification to an existing development, as defined in CDC 18.765.060.A, and is in compliance with all applicable standards of this Title. SECTION V. PROCEDURE AND APPEAL INFORMATION Notice: Notice was provided to: X The applicant and owner Final Decision: A minor modification is a Type I procedure. As such, this decision is final for purposes of appeal on the date it is mailed or otherwise provided to the applicant, whichever occurs first.
