APPLICATION SUMMARY FILE NAME: Spruce Street Salon CASE NO.: Minor Modification (MMD) MMD2020-00015 PROPOSAL: The applicant is proposing a change of use to an existing building at 7115 SW Spruce Street.The 1,188-square-foot building is changing from an existing household living use (single detached house) to a personal services use. The C-P zone is designed to accommodate civic and professional services and compatible support services, for example convenience retail, personal services, and restaurants, in close proximity to residential areas and major transportation facilities. Heliports, medical centers, religious institutions, and utilities are allowed conditionally. Developments in the C-P zone are intended to serve as a buffer between residential areas and more intensive commercial and industrial areas. APPLICABLE REVIEW CRITERIA: Community Development Code Chapter 18.765.060.D SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request.The findings and conclusions on which the decision is based are noted in Section IV. MMD2020-00015 Spruce Street Salon SECTION III. BACKGROUND INFORMATION Site Information: The property is located at 7115 SW Spruce Street,on the north side of SW Spruce Street,west of SW 71 s` Avenue,and east of SW 72"a Avenue.The property is currently occupied by an existing nonconforming household living use(single detached house)in the Professional/Administrative Commercial(C-P) Zone. The property also contains an existing two-car garage and a paved driveway.According to the Washington County Assessment and Taxation Report, the existing house measures 1,188 square feet in size, and the existing garage measures 440 square feet in size. The applicant proposes to change from an existing nonconforming use (household living) to an allowed use (personal services)in the C-P Zone. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS 18.765 Modifications: 18.765.060 Minor Modifications A. Definition.A minor modification has the following characteristics: 1. It has minimal impacts on surrounding properties,sensitive lands,or public facilities;and The applicant proposes a minor modification to an existing development at 7115 SW Spruce Street. Specifically, the applicant proposes to change from an existing nonconforming use (household living) to an allowed use (personal services) in the C-P Zone. No changes to the existing building footprint, exterior building facades, on-site parking, or on-site landscaping are proposed. Accordingly, staff finds the proposal will have minimal impacts on surrounding properties, sensitive lands, or public facilities. Because the proposed new use requires the application of a higher parking quantity requirement than the previous use, a review of the site's off-street parking area is required to ensure that it complies with the city's minimum off-street parking requirements. The subject 1,188-square-foot building will be changing from a household living use (single detached house) to a personal services use,which has a minimum off street parking requirement of 2.5 parking spaces for every 1,000 square feet of floor area (CDC Table 18.410.3).Accordingly, staff finds that a minimum of three (3) parking spaces are required for the entire development,taking into consideration the change of use discussed above.The applicant's materials show there is a two-car garage and a paved driveway at the development site, which will provide adequate parking for the new use. 2. It does not cause the development to go out of conformance with any applicable standard or further out of conformance if already nonconforming, except where an adjustment has been approved. The applicant is only proposing a change of use to an existing 1,188-square-foot building,which primarily affects off-street parking regulations. As demonstrated in the findings above, there is adequate parking provided at the subject development site. Additionally, the applicant proposes to change from an existing nonconforming use (household living) to an allowed use (personal services) in the C-P Zone. Accordingly, the applicant's proposal complies with all applicable standards,and is therefore approvable. D. Approval criteria. The approval authority will approve or approve with conditions a minor modification application when all of the following criteria are met: 1. The proposed modification qualifies as a minor modification as defined in Subsection 18.765.060.A; As demonstrated in the findings above, this proposal qualifies as a minor modification as defined in CDC 18.765.060.A.This criterion is met. MMD2020-00015 Spruce Street Salon 2 2. If the proposal involves the modification of a condition of approval, at least one of the following criteria is met: a. The condition cannot be implemented for reasons outside the control of the applicant or property owner; b. The condition is no longer needed or warranted because circumstances have changed; or c. A new or modified condition better accomplishes the purpose of the original condition. The applicant is not proposing to modify a condition of approval.This criterion does not apply. CONCLUSION: This proposal qualifies as a minor modification to an existing development, as defined in CDC 18.765.060.A, and is in compliance with all applicable standards of this Title. SECTION V.
