Ordinance No. 17-23 CITY OF TIGARD, OREGON TIGARD CITY COUNCIL ORDINANCE NO. 17- -�3 AN ORDINANCE AMENDING SECTION 6.02.170 OF THE TIGARD MUNICIPAL CODE, RELATING TO NUISANCE VIOLATIONS AND STORAGE IN THE FRONT YARD. WHEREAS, the Tigard Development Code currently regulates storage in the front yard; and WHEREAS, this is essentially a code enforcement function more appropriately suited in the Nuisance chapter of the Tigard Municipal Code; and WHEREAS,the amendment moves the current regulations relating to storage in the front yard from TCD 18.730.050.0 to TMC 6.02.170;and WHEREAS, the Tigard Planning Commission heard this item as part of its review and cleanup of the TDC, held a public hearing on October 2, 2017, and recommended by unanimous vote that Council approve the proposed code amendment, as amended by Planning Commission; and WHEREAS, the Tigard City Council held a public hearing on November 14, 2017 to consider the proposed amendments; and WHEREAS, the Tigard City Council has considered the recommendation of the Planning Commission;and WHEREAS, the Tigard City Council has determined that the proposed code amendment is in the best interest of the City of Tigard. NOW,THEREFORE,THE CITY OF TIGARD ORDAINS AS FOLLOWS: SECTION 1: Tigard Municipal Code 6.02.170 is amended as shown in "Exhibit A" to this Ordinance. SECTION 3: This Ordinance shall be effective 30 days after passage of this Ordinance by the Council, signature by the Mayor, and posting by the City Recorder. Cook,Mayor Approved as to form: } City Ah-44y Date ORDINANCE No. 17- Page 2 EXHIBIT A Excerpt from Title 6,Nuisance Violations 6.02.170 Storage in Front Yards Storage of boats,trailers,campers, camper bodies,house trailers,recreation vehicles or commercial vehicles in excess of 3/4 ton capacity may be stored in a required front yard in a residential zone subject to the following: 1. No such unit shall be parked in a visual clearance area of a corner lot or in the visual clearance area of a driveway which would obstruct vision from an adjacent driveway or street; 2. No such unit shall be used for dwelling purposes except that one camper, house trailer or recreational vehicle may be used for sleeping purposes only by friends,relatives or visitors on land entirely owned by or leased to the host person for a period not to exceed 14 days in one calendar year,provided that such unit shall not be connected to any utility, other than temporary electricity hookups and provided that the host person shall receive no compensation for such occupancy or use; 3. Any such unit parked in the front yard shall have current state license plates or registration and must be kept in mobile condition.
